ZONING BOARD OF APPEALS
MINUTES OF JUNE 1, 2000

A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of
the Town Hall, 16 Lowell Street, Reading, Massachusetts at 7:00 PM.

A Public Hearing on the petition of Kevin and Carol Sheehan who seeks a variance
and/or a special permit under Section 5.0/6.3.3 of the Zoning By-laws in order to remove
an existing 2 story portion of the structure and to construct a new two story (16.5' x
23.0') on the property located at 11 Eaton street, Reading, MA.
Christopher Vaccaro swore in the applicants. Kevin Sheehan stated they are removing an
existing 16' x 19' structure and replacing it with a 16.5' x 23' structure. They are
expanding 3 1/2' on the northerly side. There is 10' to the property line on the southerly
side of the house. The foundation is failing and needs to be repaired. It is currently on
wood beams and will be changed to a full basement. They are adding a 1/2 bath and a
wheelchair accessible entry way. The existing house was built around 1900 and the
petitioner purchased it in 1992. The lot size is 8,990 sq. ft. The property is in a S 15
District. Mr. Sheehan submitted letters from four of his neighbors in favor of this project.
Christopher Vaccaro stated the petitioner is not expanding on the non-conforming side so
a variance is not needed, only a special permit.
On a motion by Michael Larkin, seconded by Susan Miller, the Zoning Board of Appeals
voted to close the public portion of the hearing.
The motion was approved by a vote of 3-0-0.
On a motion by Michael Larkin, seconded by Susan Miller, the Zoning Board of Appeals
voted to grant Kevin and Carol Sheehan a Special Permit under 6.3.3.4 of the Zoning By-
laws to remove an existing 2 story structure and replace it with a new 16.5 x 23' as
shown on the plans prepared by Dennis O'Brien, submitted by the petitioner.
The motion was approved by a vote of 3-0-0.
Kevin and Carol Sheehan requested to withdraw their petition for a variance without
prejudice.
On a motion by Michael Larkin, seconded by Susan Miller, the Zoning Board of Appeals
voted to grant Kevin and Carol Sheehan the withdrawal for their request of the variance.
The motion was approved by a vote of 3-0-0.

A Public Hearing on the petition of Mark Richards who seeks a variance and/or special
permit under Section 5.0/5.1.2/6.3.3.3 of the Zoning By-laws in order to construct a two
story addition (20' x 25.6') to the rear of an existing dwelling on the property located at
30 Harrison Street, Reading, MA.
Christopher Vaccaro swore in the applicants. Mark Richards stated the current house is
17' x 24'. He is adding a third bedroom and extending the kitchen and basement. He is
removing the existing 10.4' porch. The lot size is 10,245 sq. ft. The house was built in the
1950's. Mr. Richards purchased the property 3 years ago.
Christopher Vaccaro stated this property is in a S 15 District. The petitioner will need a
variance because of the non-conforming lot size. Christopher Vaccaro also stated he
doesn't see any record of the porch and believes it was added on illegally. He asked if the
addition could be designed so the setbacks are not changed. In order to receive a variance
the property needs to be unique and that would be hard in this neighborhood because all
the lots are the same.
Mark Richards requested to withdraw his request for a variance without prejudice.
On a motion by Bernard O'Shaughnessy, seconded by Michael Larkin, the Zoning Board
of Appeals voted to close the public portion of the hearing.
The motion was approved by a vote of 3-0-0.
On a motion by Bernard O'Shaughnessy, seconded by Michael Larkin, the Zoning Board
of Appeals voted to consent to Mark Richards's withdrawal of his variance request
without prejudice.
The motion was approved by a vote of 3-0-0.
On a motion by Michael Larkin, seconded by Bernard O'Shaughnessy, the Zoning Board
of Appeals voted to approve the minutes of the April 6, 2000 meeting, with changes.
The motion was approved by a vote of 3-0-0.
The Zoning Board of Appeals unanimously voted to adjourn their meeting at 8:15 PM.
