A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of
the Town Hall, 16 Lowell Street, Reading, Massachusetts at 7:00 PM. Building Inspector
Glen Redmond and Town Planner Anne Krieg were also in attendance
Case #00-17
A continuance of a Public Hearing on the petition of H.B. Development Corporation who
seeks a Comprehensive Permit under Section M.G.L. Chapter 40B in order to construct
eight buildings containing a total of 32 condominium units on the property located at 443
Grove Street, Reading, MA
Atty. David McBride requested to formally withdraw his petition under Chapter 40B,
without prejudice. John Jarema requested the petitioner submit his request in writing to
Town Planner Anne Krieg.
On a motion by Susan Miller, seconded by John Jarema, the Zoning Board of Appeals
voted to continue the public hearing for Case #00-17, H. B. Development corporation, for
the property located at 443 Grove Street, Reading, MA, at the request of the petitioners
attorney, until March 1, 2001.
The motion was approved by a vote of 3-0-0.
Case #01-01
The Zoning Board of Appeals will hold a Public Hearing in the Selectmen's Meeting
Room at the Town Hall, 16 Lowell Street in Reading, MA on Thursday, February 1, 2001
at 7:00 PM on the petition of Joseph L. Hozid, Trustee of the Joseph L. Hozid Trust who
seeks a variance/special permit under section 5.1.2/6.3.3.4 of the Zoning By-laws in order
to rebuild a portion of a building destroyed by fire in a Business B District on the
property located at 12 Woburn Street, Reading, MA
Chairman Larkin swore in the applicants. Atty. Anita Reinold represented the applicant.
The petitioner is seeking a special permit/variance to rebuild the portion of their building
that was destroyed by a fire on February 9, 2000. The footprint of the building will
remain the same and the existing foundation will be used.. The building is 1,365 sq. ft..
They have a 15.05' setback. The height of the building is not increasing. This is in a
business district. The boundary along Woburn Street is 29' and the westerly boundary
46'.

On a motion by John Jarema, seconded by Edmund Balboni, the Zoning board of Appeals
voted to grant a Special Permit under Section 6.3.3.4 of the zoning by-laws, in order to
allow Joseph L. Hozid to rebuild the property at 12 Woburn Street, Reading, MA, as
depicted on the plan submitted on January 30, 2001 and drawn by Robert W. Smith of
Bay State Road, Reading, MA.
The motion was approved by a vote of 3-0-0.
On a motion by John Jarema, seconded by Edmund Balboni, the Zoning board of Appeals
voted to grant a Variance under Section 6.3.3.4 of the zoning by-laws, in order to allow
Joseph L. Hozid to rebuild the property at 12 Woburn Street, Reading, MA, as depicted
on the plan submitted on January 30, 2001 and drawn by Robert W. Smith of Bay State
Road, Reading, MA, to set the building 15.05' from the rear lot line.
The motion was approved by a vote of 3-0-0.
Case #00-35
Continuance of a Public Hearing on the petition of Joseph & Wendy Calaresso who seeks
a variance/special permit/appeal from the decision of the building Inspector under
Section 4.2.2/6.1.1.2 of the Zoning By-laws in order to place goods outside the canopy
and not consider this open storage on the property located at 122 Main Street, Reading,
MA.
Atty. Latham stated this case was continued to allow the applicant time to submit a list of
items they display outside. All items on this list grow outside and beautify the area. The
items are displayed outside by the purchasers. Atty. Latham submitted a list and
requested the addition of shrubs to the list.
On a motion by John Jarema, seconded by Edmund Balboni, the Zoning board of Appeals
voted to grant a Special Permit to the Caleresso Farm Stand, for the property located at
122 Main street, Reading, MA, a Special Permit under section 4.2.2 of the Table of Uses,
for the other uses section. to display outside, to include trees (Christmas trees or other
small potted trees and plants capable of being carried by one person), plants, objects cut
or crafted from trees or plants (such as wreaths, boughs, swags, pine tips, boxwood tips,
decorative roping), flowers (including those that are potted, in flats, cut and/or arranged
in containers), memorial baskets, pumpkins, gourds, squash, hay bales and corn stocks.
This is on the condition they do not impede upon pedestrians access to the building and
access to required parking spaces as specified to the earlier site plan.
The motion was approved by a vote of 3-0-0.
Case #00-33
A Public Hearing on the petition of Rangeway Farms, LLC c/o Carter & Coleman, 248
Main Street, Reading, MA who seeks a comprehensive permit pursuant to M.G.L.
Chapter 40B to construct twelve unit townhouse project on the property located at 1375
Main Street, Reading, MA.

Chairman Michael Larkin swore in the petitioners. Atty. Denise Moynihan, Carter &
Coleman, represented the petitioner.
Atty. Moynihan stated this property is not on the State or the National register and she
submitted a copy of the State Register of Historical Places. Clay Jones from the Reading
Historical Commission will make a site visit to this building on February 2, 2001. He
stated the historical issue is still open. Town Planner Anne Krieg stated there are a lot of
repairs needed, but it doesn't appear to be an impossible task. The petitioner stated it
would cost $400,000 to repair this building. He could make the house one of the units,
but would have to charge more for the other units.
The petitioner, Rocco Smith stated he has reduced the amount of units from 12 to 8. He
has met with the abutters and is trying to address their concerns. The height of the units is
reduced from 42' to 33'. The window height is under 20'. The decks are eliminated. The
first floor is the kitchen, dining room and living room. There are 2 bedrooms and a den
on the second floor. The building is 38' from the back lot line. All water will flow into
chambers contained on the lot and will not add any additional water to the area. The
coverage is reduced to 19%, because of the aquifer protection district. They will not hard
top, but are using pavers instead.
Town Engineer Joseph Delaney stated he is not that familiar with the pavers. He would
like to do a little more research on before he approves their use. He is concerned with the
effect on the aquifer protection district. The Town will be looking into this area for

- additional wells.
Conservation Commissioner Nancy Eaton stated it is not the pavers, but what is
underneath the pavers. It depends on the bed of material that is underneath. The buffer
zone acts as purifier. The Conservation Commission has not been on site. They must
approve this site before the petitioner proceeds. Rocco Smith stated he knows he needs
the Conservation Commission's approval, but believes the jurisdiction of the wetlands is
a separate issue. Anne Krieg stated the petitioner should establish the wetland line before
proceeding.
James O'Day, the engineer for this project, submitted a drainage study. He stated all the
roof drainage will be collected and discharged into the infiltration system. They could
divert some of the roof run off to the wetlands if that is desirable.
On a motion by John Jarema, seconded by Edmund Balboni, the Zoning board of Appeals
voted to continue the public hearing on the petition of Rangeway Farms, LLC c/o Carter
& Coleman, for the property located at 1375 Main Street, Reading, MA, for the purposes
of securing more information from the Town Engineer, the conservation commission, and
the Historical Commission.
The motion was approved by a vote of 3-0-0
