MEMBERS PRESENT: JOHN JAREMA, CHAIRMAN Q6 SUSAN MILLER EDMUND BALBONI BERNARD O'SHAUGHNESSY A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the Town Hall, 16 Lowell Street, Reading, Massachusetts at 7:00 PM. Building Inspector Glen Redmond and Town Planner Anne Krieg were also in attendance On a motion by Edmund Balboni, seconded by Susan Miller, the Zoning Board of Appeals voted to approve the minutes of their November 2, 2000 meeting. The motion was approved by a vote of 3-0-0. On a motion by Edmund Balboni, seconded by John Jarema, the Zoning Board of Appeals voted to approve the minutes of their November 16, 2000 meeting. The motion was approved by a vote of 3-0-0. On a motion by Edmund Balboni, seconded by Susan Miller, the Zoning Board of Appeals voted to approve the minutes of their January 4, 2001 meeting, as amended. The motion was approved by a vote of 3-0-0. On a motion by Edmund Balboni, seconded by Susan Miller, the Zoning Board of Appeals voted to approve the minutes of their January 18, 2001 meeting, as amended. The motion was approved by a vote of 3-0-0. Case #00-31 Continuance of a Public Hearing on the petition of Angelo Salamone who seeks a comprehensive permit under Massachusetts general Laws Chapter 40B in order to construct ten units of housing with an affordable component as required under the New England Fund, administered by Stoneham Savings Bank, a member of the Federal Home Loan Bank of Boston, the proposed housing is for property located at 45 beacon Street (Map 123, Plot. 200) in Reading, MA Atty. Steven Cicatelli stated he has met with Town Engineer Joseph Delaney and Mr. Delaney has requested additional information. Atty. Cicatelli requested a continuance to prepare the additional information. On a motion by Edmund Balboni, seconded by Bernard O'Shaughnessy, the Zoning board of Appeals voted to continue the hearing on Case #00-31 on the petition of Angelo Salamone for the property located at 45 Beacon Street (Map 123, Plot. 200) in Reading, MA, until March 22, 2001. The motion was approved by a vote of 3-0-0. Zoning Board of Appeals Minutes of 2/15/01 page 2 Case #01-02 A Public Hearing on the petition of Scott Wolter who seeks a Variance and/or Special Permit under section 5.0/6.3/6.3.3.3/6.3.3.4 of the Zoning By-Laws in order to construct a 2nd floor addition over an existing non-conforming garage on the property located at 218 Forest Street, Reading, MA. Chairman John Jarema swore in the applicants. Scott Wolter stated this house was in conformance with the zoning by-laws when it was built in 1984. He purchased this property in 1997. It is a single family home with an attached garage. The garage is 12'6" from the property line, not the required 15'. Scott Wolter contacted the builder of the house, Mr. Johnson. Mr. Johnson stated, because the garage was attached to the house, the set back requirement was reduced. The second floor addition will be built on the existing foundation. Scott Wolter submitted letters from his neighbors in support of this project. Building Inspector Glen Redmond stated there are a number of houses in town with this problem. This resulted from the past interpretation of the zoning by-law. On a motion by Susan Miller, seconded by Edmund Balboni, the Zoning Board of Appeals voted to grant Scott Wolter, for the property located at 218 Forest Street, Reading, MA, a Special Permit, under Section 6.3.3.4 of the Zoning By-law, in order to construct a second floor addition over the existing garage, as shown on the plan submitted by the petitioner, dated December 2000. The motion was approved by a vote of 3-0-0. On a motion by Susan Miller, seconded by Edmund Balboni, the Zoning Board of Appeals voted to grant Scott Wolter, for the property located at 218 Forest Street, Reading, MA, a Variance, under Section 5.0 of the Zoning By-law, in order to construct a second floor addition over the existing garage, as shown on the plan submitted by the petitioner, dated December 2000, provided the addition does not exceed a setback of 12'6" from the westerly lot line. The motion was approved by a vote of 3-0-0. Old/New Business Anne Krieg stated she is in the process of revising the wording of Section 6.3 of the Zoning By-law. She will submit a copy to the Zoning Board at their next meeting for their review. Anne Krieg also stated she is considering raising the fees for the applicants.
