Case #01-22 Continuance of a Public Hearing on the petition of Charles and Deborah Capobianco who seeks an appeal from the decision of the Building Inspector under Section 7.4 of the Zoning By-laws in order to question the issuance of a building permit to construct/install an 8' fence on the property located at 23 George Street, Reading, MA Michael Larkin stated he has not received a review of this case from the Building Inspector. The Building Inspector was not able to attend the hearing this evening due to medical reasons. Atty. Ciccatelli asked how many other 8' fences have been issued a permit in the Town of Reading. Michael Larkin stated, since 1997, there have been three permits issued, including the one at 23 George Street. Atty. Ciccatelli also stated Chapter 40 section 21 is an "action in tort" and not grounds to deny this permit. Atty. John Lamond stated he would wait for the continuance before responding. On a motion by John Jarema, seconded by Edmund Balboni, the Zoning Board of Appeals voted to continue Case #01-22 on the petition of Charles and Deborah Capobianco, for the property located at 23 George Street, Reading, MA, until November 1, 2001. The -motion was approved by a vote of 3-0-0. Case #00-36 Continuance of a Public Hearing on the petition of Walter and Daniel Arsenault who seeks a variance/special permit/appeal from the decision of the Building Inspector under section 4.2.2/6.1.1.2 of the Zoning By-laws in order to display goods as open storage and to allow parking serving a neighboring property located at 126 Main Street, Reading, MA Atty. John Lamond stated the petitioner is meting with the Building Inspector and the Town Planner on Monday, October 22, 2001. He requested a continuance until after that meeting. Zoning Board of Appeals Minutes of 10/18/01 page 2 On a motion by John Jarema, seconded by Edmund Balboni, the Zoning Board of Appeals voted to continue Case #00-36 on the petition of Walter and Daniel Arsenault for the property located at 126 Main Street, Reading, MA, until November 15, 2001. The motion was approved by a vote of 3-0-0. Case #01-24 A Public Hearing on the petition of Donald L. Wood who seeks a special permit under Section 6.3 of the Zoning By-laws in order to alter/extend a nonconforming structure (existing 3 family dwelling) on the property located at 34 - 36 Bancroft Avenue, Reading, MA. Chairman Michael Larkin swore in the petitioner. Atty. John Lamond submitted a referendum for the special permit. This is a 2 1/2 story , 3 family house in a S 15 district. It was built around 1900. The current owner purchased this property 25 years ago. The previous owner had owned the property for 40 years. The three family use has been grandfathered in. The east setback is 121/2' and the front setback is 15'. The rear setback is 71'. There is no setback violation on the west side. The petitioner is requesting to increase the rear apartment from 500 sq. ft. to 1,100 sq. ft. This would add an additional 5 1/2' to the rear of the house. The petitioner will change the attic stairs to meet all building code requirements. Donald Wood stated the house will meet the lot coverage requirements with the addition. - Atty. Lamond read a letter from Marilyn T. Gilligan, 30 Bancroft Ave., Reading, MA, stating she has no objections to the addition. John Stosez, 35 Bancroft Avenue, stated he has no objections to the addition. Michael Zwicker, 42 Bancroft Avenue, stated he has no objections to the addition. John Jerema requested a copy of the plot plan drawn by Robert W. Smith and a copy of the architectural drawing designed by Pheonix Collaborative Architects, Wakefield, MA. On a motion by John Jarema, seconded by Edmund Balboni the Zoning Board of Appeals voted to grant a special permit to Donald L. Wood for the property at 34 - 36 Bancroft Avenue, Reading, MA, to reconstruct and enlarge the dwelling as depicted on the plot plan drawn by Robert W. Smith and the architectural drawing designed by Pheonix Collaborative Architects, Wakefield, MA, under Section 6.3.11.1 and 6.3.11.2 of the Zoning By-laws. The motion was approved by a vote of 3-0-0. Zoning Board of Appeals Minutes of 10/18/01 page 3 Case #01-20 Continuance of a Public Hearing on the petition of David Barrett and Kevin Cunniff who seeks a variance/special permit under Section 4.0/6.3/5.1.2 of the Zoning By-laws in order to demolish an existing structure and construct a new four family structure on the property located at 73 - 75 Woburn Street, Reading, MA Chairman Michael Larkin stated the continuance of this hearing had not been posted and the abutters were not notified. David Barrett stated he had spoken with the abutters and would like to proceed with the hearing. David Barrett stated he has increased the front setback and changed the side set back to 13'. The rear setback meets the zoning requirement. The building's style is Greek Revival, to blend in with the existing neighborhood. There will be four townhouse style condominiums. There are three bedrooms in each unit. There is a total of six off street parking spaces. The height of the building is 35' from grade level. The petitioner displayed a drawing dated October 18, 2001. Michael Larkin stated this property has been used as a 4 family unit for over six years. John Jarema requested a more specific set of drawings displaying the egresses. He also requested the petitioner give a plan to the neighbors for their review. Christopher Vaccaro, 57 Woburn Street, Reading, MA, stated the design and style of the condominiums suits the neighborhood. On a motion by Edmund Balboni, seconded by John Jarema, the Zoning Board of Appeals voted to continue the public hearing for Case #01-20 on the petition of David Barrett and Kevin Cunniff for the property located at 73 - 75 Woburn Street, Reading, MA, until November 1, 2001. The motion was approved by a vote of 3-0-0. New/Old Business On a motion by Robert Redfern, seconded by Edmund Balboni, the Zoning board of Appeals voted to approve the minutes of their October 4, 2001 meeting, as amended. The motion was approved by a vote of 3-0-0. John Jarema requested additional clerical support from Community Development. On a motion by John Jarema, seconded by Edmund Balboni, the Zotting board of Appeals voted to schedule a business meeting on October 25, 2001. The motion was approved by a vote of 3-0-0.
