ZONING BOARD OF APPEALS Minutes of April 30, 2003 i € 1Q, 2 Members Present: John Jarema Edmund Balboni Paul Dustin Susan Miller A meeting of the Zoning Board of Appeals was held in the Berger Room of the Town Hall, 16 Lowell Street, Reading, Massachusetts at 7:00 P.M. Also present was Christopher Reilly, Town Planner and Joan Langsam, Town Counsel. Case #02-05 A Continuance of a Public Hearing on a request for a Comprehensive Permit to construct 250 condominiums called Johnson Woods on the property located at 468 West Street. The Board began the discussion with a March 24th memo from Fran Fink, Conservation Administrator and her request for an extension. The Board stated that even though the Conservation Commission felt there were still some issues, the Board was satisfied at this point that sufficient consideration had been given to the conservation issues. The final draft was reviewed and minor changes were made at the requests of both the Board and the Applicant. One of the conditions that was discussed was the mitigation fee and how it was to be paid. The Town Manager had requested that the Board find a manageable way to schedule payments for the mitigation fee that would require simple bookkeeping. It was agreed upon by the Board and the Applicant that four payments would require minimal bookkeeping. There were some changes in the number of units discharging to Kelch Road. The Town Planner said this was not an issue with engineering. The MWRA buy-in was discussed and it was explained that this is a one-time buy-in fee and then the Town pays a yearly assessment based on the amount of water that is used. To give the Town some flexibility the Applicant said they could bring in a 6" water main until half the buildings are complete and then bring in a 12" water main. A discussion was held regarding subdivision of the land. If the Applicant did not subdivide then the 26 acres would belong to the condo owners. Town Counsel did not feel it necessary to require that subdivision be in the conditions as it would be in the best interests of the Applicant to do this. It was decided to take a vote, write up the minor changes and get the Board's signatures by the following Friday. Town Counsel said they would be voting to adopt the decision. The Chairman said since they were so close there was no point in holding it up any longer if they all agreed that there were just minor wording changes. On a motion by Susan Miller, seconded by Edmund Balboni, the Zoning Board of Appeals voted to grant the petitioner a Comprehensive Permit under MGL Chapter 40B to place 250 condominium units on the property located at 468 West Street, subject to the rules and provisions in the Comprehensive Permit and Decision. The motion was approved by a vote of 3-0-0. On a motion by Edmund Balboni, seconded by Susan Miller, the Zoning Board of Appeals voted to adjourn the meeting.
