A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the
Town Hall, 16 Lowell Street, Reading, Massachusetts at 7:00 P.M. Also present was Glen
Redmond, Commissioner of Buildings.
Case #03-05
A Public Hearing on a petition by Kenneth Carter who seeks a Special Permit under Section(s)
6.3.17 of the Zoning By-Laws in order to demolish an existing non-conforming dwelling and to
construct a new single family dwelling on the property located at 211 Pearl Street.
The Applicant showed the Board proposed house plans and elevations. The house that is there
now has a three foot square hole in the roof and needs repair. The house, which has been
unoccupied, has been transferred to the owner's son. Certified plot plans were passed out to the
Board members and they noted the flood hazard areas. The Applicant stated he met all the
requirements of the Conservation Commission.
The Building Inspector said the plans met requirements and the Applicant just needed a Special
Permit from the Board. It will be a two-story single family dwelling and not even close to the 35
foot limit. It meets all setbacks except for frontage. It was agreed that it was larger than the
surrounding houses but it does meet all the requirements. The Chairman said he just wanted to be
sure it met the height requirement and that measurements should be taken from the street line.
On a motion by Susan Miller, seconded by Edmund Balboni, the Zoning Board of Appeals voted
to grant the petitioner a Special permit under Section 6.3.17 of the Zoning By-Laws for the
reconstruction of a single-family dwelling after voluntary demolition of the existing dwelling, as
described on the Plot Plan of Land prepared by O'Neill Associates of North Reading,
Massachusetts, dated April 1, 2003, and the accompanying four-page set of drawings, subject to
the following conditions:
1. The Plot Plan showing the proposed reconstruction is submitted to the Building Inspector
prior to the issuance of a building permit; and
2. An as-built plan(s) submitted to the Building Inspector prior to issuance of an Occupancy
Permit.
The motion was approved by a vote of 3-0-0.
Case #03-06
A Public Hearing on a petition by C & C Rocksolid Houses LLC who seeks a Special Permit
under Section(s) 6.3.17 of the Zoning By-Laws in order to demolish the existing dwelling and to
construct a new single family dwelling on the property located at 15 Priscilla Road.
The Applicant stated that this is the same proposed plan as in the previous case and the design
will cover less ground area than the current structure. The house sits in a dip and it will not dwarf
the neighboring house as the one that is there now does. He stated this will allow the
homeowners to stay in the town.
It was noted at this time that the homeowner, John Tangy, must sign the application as a Special
Permit cannot be issued to a contractor but only to the homeowner.
On a motion by Edmund Balboni, seconded by Susan Miller, the application was amended to
reflect the owner, John Tangy. The motion was approved 3-0-0. The application was amended by
the homeowner and he signed the application.
The Applicant said they took the neighborhood on Pricilla Lane into account and this house is
consistent with the neighborhood. He said they tried very hard to conform...
On a motion by Susan Miller, seconded by Edmund Balboni, the Zoning Board of Appeals voted
to grant the Petitioner a Special permit under Section 6.3.17 of the Zoning By-Laws for the
reconstruction of a single-family dwelling after voluntary demolition of the existing dwelling, as
described on the Plot Plan of Land prepared by O'Neill Associates of North Reading,
Massachusetts, dated November 7, 2002, and the accompanying ten-page set of drawings
prepared by J. Saia, Jr., subject to the following conditions:
1. The Plot Plan showing the proposed reconstruction is submitted to the Building Inspector
prior to the issuance of a building permit; and
2. An as-built plan(s) is submitted to the Building Inspector prior to the issuance of an
Occupancy Permit.
The motion was approved by a vote of 3-0-0.
Case #03-07
A Public Hearing on a petition by Wayne Webster who seeks a Special Permit under Section(s)
6.3.17 of the Zoning By-Laws in order to remove in part a portion of an existing non-conforming
structure and to construct a new structure on the property located at 21 Line Road.
Board member Edmund Balboni excused himself from the case because the applicant is a
personal friend of his.

The Applicant said his house is poorly constructed and the addition on the rear has insect damage
and is in danger of collapsing. He said they want to rebuild exactly the same size. The contractor
he hired was not honest and he has come before the Board to correct the problem.
The Building Inspector said he had talked with the contractor, told him he could not issue a
building permit and the contractor did not tell him he had already repaired the foundation. The
plans showed a new foundation. They are working without a building permit which means
inspections have not been done. They need a Special Permit to do this particular project.
What has been done do far would have to be straightened out with the Building Department. The
dimensions are handwritten and this is a problem.
The Chairman said if they were to grant the replacement of that portion of the house consistent
with what is there now the Board would need the correct dimensions and a certified plot plan
would be necessary. The Building Inspector will do an assessment and return to the Board with a
report at the May 22"d meeting.
On a motion by Robert Redfern, seconded by Susan Miller, the Zoning Board of Appeals voted
to continue the hearing to May 22, 2003.
The motion was approved by a vote of 3-0-0.
Minutes
On a motion by Robert Redfern, seconded by Edmund Balboni, the minutes of February 27,
2003 were accepted with changes.
The motion was approved by a vote of 3-0-0.
On a motion by Robert Redfern, seconded by Susan Miller, the minutes of March 6, 2003 were
accepted.
The motion was approved by a vote of 3-0-0.
On a motion by Robert Redfern, seconded by Edmund Balboni, the minutes of March 13, 2003
were accepted.
The motion was approved by a vote of 3-0-0.
The Chairman acknowledged a letter from John Gannon regarding the canceling of the executive
session on tonight's Agenda. The Applicant said there is no written proposal to submit to the
Board at this time and he will contact the Board when he is prepared and reschedule.
On a motion by Edmund Balboni, seconded by Susan Miller, the Zoning Board of Appeals voted
to adjourn the meeting.
