A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the
Town Hall, 16 Lowell Street, Reading, Massachusetts at 7:00 P.M. Also present were Chris
Reilly, Town Planner and Joan Langsam, Town Counsel.
Case # 04-09
Continuance of a Public Hearing on the petition of Maplewood Village Development LLC who
seek a Comprehensive Permit under MGL Chapter 40B of the Zoning By-Laws in order to
construct 36 age-restricted condominium units on the property located at 201-275 Salem Street.
Joan Langsam, Town Counsel, said she had reviewed the Purchase & Sales Agreement and it
gave the Petitioners the right to be before the Zoning Board. The proforma looked fine and they
had the best "guesstimates" as to the cost of lumber and what the units will sell for.
The Chairman stated that since there were no issues or comments from other town staff they
would review the conditions of the draft agreement.
The Town Planner went though the conditions that included the history of the project to date
including the LIP process the applicants went through with the Board of Selectmen. There was
also a spreadsheet outlining the Design Review Team and town staff comments as well as things
the Petitioners did to the site plan in response to these comments.
Some of the changes made to the draft conditions were:
The Board wanted chain link fencing on the Dunkin Donuts side of the project while under
construction and assurance to the Town that the site will be secure.
There was a discussion as to whether C.H.A.P.A will agree to be the agent for the affordable
housing units. They had refused to be the agent for another smaller 40B project in Reading. The
Petitioners said if that happened they would choose an alternative agent upon the approval of the
Board. The condition was added that if C.H.A.P.A. is unwilling to be the monitoring agent then
the applicant shall submit a proposal for an alternative monitoring which shall be subject to the
approval of the ZBA.
Changed the review period for Town Counsel to 45 days.
Changed the outdoor prohibitions to just prohibiting drying racks and clothes lines.
Added a construction-sequencing plan.
On a motion by Robert Redfern, seconded by Susan Miller, the Zoning Board of Appeals voted
to close the public hearings.
The motion was approved by a vote of 3-0-0.
On a motion by Robert Redfern, seconded by Susan Miller, the Zoning Board of Appeals voted
to continue the hearing to June 24, 2004.
The motion was approved by a vote of 3-0-0.
On a motion by Susan Miller, seconded by Robert Redfern, the Zoning Board of Appeals voted
to adjourn the meeting.
The motion was approved by a vote of 3-0-0.
