HomeMy WebLinkAbout2004-12-02 Zoning Board of Appeals MinutesTown of Reading ZONING BOARD OF APPEALS Minutes of December 2, 2004 --r~ CD , Members Present: John Jarema Robert Redfern ' ' Paul Dustin ' r Michael Conway t co Members Absent: Susan Miller Mark Gillis A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the Town Hall, 16 Lowell Street, Reading, Massachusetts at 7:00 P.M. Also in attendance was Glen Redmond, Commissioner of Buildings. Robert Redfern chaired in the absence of Susan Miller. CASE # 04-29 A Public Hearing on the petition of Brien J. Lafferty who seeks a Special Permit under Section 6.3.17 of the Zoning By-laws in order to remove (demolition) the existing non-conforming dwelling and construct a new single family on a non-conforming lot on the property located at 16 Track Road. This property is located in an S-15 district. Brien Lafferty said the new house will improve the neighborhood and he submitted a new plot plan that shows a 35' setback on one side. He presented two options but said he would rather the Board choose Option Two that also would give more conformity. The Board told him that by choosing Option Two he would have more problems with the Conservation Commission because of the move back of the new dwelling. The Board preferred Option One because it was more conforming. A letter was presented from Fran Fink, Administrator for the Conservation Commission. The Board told the Petitioner that he would have to file a Notice of Intent with the Commission. A copy of the letter was given to him when he indicated he had not received one. The Building Inspector said the project was a typical rebuild and he did not have any problems with the proposal. On a motion by Paul Dustin, seconded by John Jarema, the Zoning Board of Appeals voted to' grant the Petitioner a Special Permit under Section 6.3.17 of the Zoning By-laws to permit the demolition of the existing dwelling and for the construction in its place of a single family dwelling on a non-conforming lot as shown on the certified plot plan, prepared by JM Associates, 325 Main Street, North Reading, MA, dated May 3, 2004, revised on November 4, 2004, with the usual three standard conditions. The plan is further identified as B662, Option #2. The motion was approved by a vote of 3-0-0 (Redfern, Jarema, Dustin). On a motion by John Jarema, seconded by Paul Dustin, the Zoning Board of Appeals voted to adjourn the meeting. The motion was approved by a vote of 3-0-0 (Redfern, Jarema, Dustin).
