Case # 05-17 A Public Hearing on the petition of David P. Johnson who seeks a Special Permit under Section(s) 6.3.12/6.3.17 of the Zoning By-laws in order to raze the existing non-conforming structure and to construct a new single family dwelling on the property located at 126 Howard Street. The Board was concerned about the size of the proposed dwelling so the Applicant agreed to research alternative plans. On a motion by Robert Redfern, seconded by John Jarerna, the Zoning Board of Appeals moved to continue the hearing to August 18"' so that the Applicant could research alternative house plans and, if necessary, prepare a new certified plot plan. The vote was 3-0-0 (Miller, Redfern, Jarema). Case # 05-18 A Public Hearing on the petition of Kneeland Construction Corp. who seeks a Variance under Section(s) 5.0 (setbacks) of the Zoning By-laws in order to re-connect a pool deck to the existing dwelling on the property located at 7 Pine Avenue. The connection of this deck will be a violation of side and rear yard setbacks. The Applicant did not attend the hearing but submitted a letter requesting a continuance. On a motion by John Jarema, seconded by Robert Redfern, the Zoning Board of Appeals moved to continue the hearing to August 18th at the request of the Applicant. The vote was 3-0-0 (Miller, Redfern, Jarema). Other Business: Case # 05-14 - 9 Norman Road: On June 16"' at their initial hearing, the Applicants had requested a continuance to August 18"' so they could get additional information from Engineering and also do a title search. They were told at the meeting on June 16"' that the Board needed to receive their request for a continuance in writing by August 1st. A letter was sent via certified mail on July 19t" to the Applicants reiterating what was needed. The Board did not receive a letter back from the Applicants requesting the continuance and therefore the Board decided to vote on the case. On a motion by Robert Redfern, seconded by John Jarema, the Zoning Board of Appeals moved to accept the withdrawal without prejudice of Case # 05-14 but the Applicants can renew the appeal by filing it again. The motion was approved by a vote of 3-0-0 (Miller, Redfern, Jarema). Board Reorganization: The Board reorganized for the next year. On a motion by Robert Redfern, seconded by John Jarema, Susan Miller was nominated to continue her position as Chairman of the Zoning Board of Appeals. The motion was approved by a vote of 4-0-0 (Redfern, Jarema, Dustin, Conway). On a motion by John Jarema, seconded by Paul Dustin, Robert Redfern was nominated to continue his position as Vice Chairman of the Zoning Board of Appeals. The motion was approved by a vote of 4-0-0 (Miller, Jarema, Dustin, Conway). On a motion by Robert Redfern, seconded by Paul Dustin, the Zoning Board of Appeals moved to adjourn the meeting.
