U:._La i SS. r` SS. A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the Town Hall, 16 Lowell Street, Reading, Massachusetts at 7:00 P.M. Also in attendance was the Commissioner of Buildings, Glen Redmond. Case #05-17 Continuation of a Public Hearing on the petition of David P. Johnson who seeks a Special Permit under Section(s) 6.3.12/6.3.17 of the Zoning By-laws in order to raze the existing non- conforming structure and to construct a new single family dwelling on the property located at 126 Howard Street. David Johnson presented information and drawings for a proposed dwelling along with a revised certified plot plan. The dwelling will not exceed the 25% lot coverage and will be approximately 26' high. The Board did not have any additional questions regarding the proposed project but thought the new dwelling was a better fit for the lot than the previously submitted house plan and will fit better with the surrounding neighborhood. On a motion by Robert Redfern, seconded by John Jarema, the Zoning Board of Appeals moved to grant the Petitioner a Special Pen-nit under Section 6.3.17 of the Zoning By-laws to demolish the existing dwelling and construct a new single family dwelling as shown on the submitted revised Certified Plot Plan with the following conditions attached: 1. The Petitioner shall submit to the Building Inspector a Certified Plot Plan of the proposed construction and proposed foundation plans prior to the Building Inspector's issuance of a foundation permit for the work. 2. The Petitioner's final construction plans for the new dwelling and addition (including Certified Plot Plan) shall be submitted to the Building Inspector prior to the building Inspector's issuance of a Building Permit. 3. As-built plan(s) showing the completed construction shall be submitted to the Building Inspector immediately after the work is completed and prior to the issuance of an Occupancy Pen-nit, The motion was approved by a vote of 3-0-0 (Miller, Redfern, Jarema). Case # 05-18 Continuation of a Public Hearing on the petition of Kneeland Construction Corp. who seeks a Variance under Section 5.0 (setbacks) of the Zoning By-laws in order to re-connect a pool deck to the existing dwelling on the property located at 7 Pine Avenue. The connection of this deck will be a violation of side and rear yard setbacks. Neither the Applicant nor their representative attended the hearing. The Board agreed to send the Applicant a letter stating that their original hearing scheduled for August 4t1' had been continued at the request of their representative, Kneeland Construction. And now at this hearing no one appeared. The Board will vote to continue the hearing but will send the Applicant a letter stating that if the Board does not hear from the Applicant in writing, or if they fail to appear at the hearing on September 15`i', the Board will take action at that hearing, including the possibility of dismissing the appeal. On a motion by John Jarema, seconded by Robert Redfern, the Zoning Board of Appeals moved to continue the hearing to September 15th at the request of the Applicant. The motion was approved by a vote of 3-0-0 (Miller, Redfern, Jarema). On a motion by John Jarema, Seconded by Paul Dustin, the Zoning Board of Appeals moved to adjourn the meeting. The motion was approved by a vote of 5-0-0 (Miller, Redfern, Jarema, Dustin, Conway).
