Executive Session

Attendees:
Commissioners: Messrs. Ames, Hughes, Burditt, and Swyter
RMLD Staff: Messrs. Rucker, and Cameron
Guest: Mr. Paul Carson of the RMLD, and Mr. Barra and Mr. Shapiro of Rubin and
Rudman
1. Minutes of June 8, 1998
Mr. Swyter moved and Mr. Ames seconded to approve the Executive Session Meeting Minutes of
6/8/98
The motion carried 4:0.
2. Board Discussions
a. Darlene Hansen Law Case (Paul Carson)
Mr. Carson presented this case. The RMLD has been questioned regarding the status of the lights
on that evening in that location.
Mr. Rucker advised that legal counsel has not been engaged as the RMLD is not listed as an
involved party at this time. This is being presented so that the Board is kept abreast of this
lawsuit in case things change.
b. Stony Brook Pipeline Case
Mr. Barna and Mr. Rubin presented the status of the Stony Brook Pipeline Case. Discussion
ensued regarding strategies being used.
Mr. Burditt asked what is required of the board?
Mr. Rucker stated that he was looking for direction on this matter from the Board.
It was agreed that Mr. Rucker would report to the Board in executive sessions at each
phase/pertinent points.
4. Tine Issue was brought up for discussion by Mr. Ames with Atty. Barna.
Tine sued the Department and lost. The next appeal step would require new information, of which there
is none. Mr. Barna stated that he basically has no further appeal.
5. Motion to Adjourn
Mr. Swyter moved and Mr. Ames seconded that the Board return to the Regular Session for the sole
purpose of adjourning.
The motion carried by a poll of the Board Members 4:0
Mr. Ames - Aye; Mr. Hughes - Aye; Mr. Burditt - Aye; Mr. Swyter - Aye.
