Those present at the meeting were Barbara Meade, David Singer and staff liaison Jane Fiore. Business: • Minutes of June 9, 2005 were accepted as read (vote3:0:0.) • Barbara Meade reported on the Logan Airport Fly Over Committee. She is a member in absentia. The minutes and notification of any changes effecting Reading. There have been no scheduled meetings for the LAFOC in July and August. • Tobacco youth sale compliance check update. 26 tobacco vendors were all part of the third quarter check on sale to minors by the Tobacco Coalition Coordinator, Ron Beauregard. The results were 4 sales. The Shell station second offense in one calendar year. Fine $200. The owner must document retraining of staff. The other three establishments have sold in previous years. The fine remains at $100. The recommendation to the BOH is to amend regulations to enforce all sales of tobacco products to be identified as Federal Code regulates at age 27 years. The Tobacco Coordinator will come to any fall BOH meeting requested of him for further discussion. The BOH has voted 3:0:0 to list results of tobacco sale to minors in the local news paper. • Mosquito species identification and mosquito total count for all 5 traps discussed. The BOH recommend to continuing the use operation principals designed by State Department of Public Health - epidemiologist for the decisions to adulticide. • Review of 2006 goals and objectives for the Board and Division was tabled to review at a later date. Septic Case review before the Board regarding 113 Longwood Road: The Board accepted the written request from Timothy and Barbara Leary, 113 Longwood Road owners of record to review the Septic Order Letter 310 CMR 15.000 received by the Leary's on June 22, 2005 as a result of an abutter's complaint and Health Division Title 5 inspection by the administrator on June 21, 2005. Following introduction the chairman, Colleen Seferian ask the Leary's for what reason they had come to the Board. Mr. Leary discussed the inspection his response to the orders excluding the order to connect to Town Sewer by December 1, 2005. Comments by the administrator: The Leary's have produced their pumping record as well as the repair of the primary system cover. There has only been the initial complaint and to date and no evidence of odor has occurred at anytime of inspections. Mr. Leary reported his easement deed with the abutting property 111 Longwood Road indicates his overflow tank is within the easement. The title is filed with Middlesex county registry of Deeds. The Board discussed further to connecting to Town Sewer by December 2005. Order: 310 CMR 15.229 The homeowner will have the system pumped twice (2) a year October and April. The records of pumping to be forwarded to the BOH. The October record will contain a Title 5 verification of all system components. This order will not be adjusted. (Unchanged) 310 CMR 15.293 There will be a condition attached to any construction/ building permit for an addition to the main house to have the property connect to the town sewer . (Adjusted to family's home construction project time table) 310 CMR 15.305 both the primary tank and overflow tank shall be abandon. (Unchanged) Vote 3:0:0 Written documentation of BOH decision shall be sent to 113 Longwood Road. Health Administrator's Report • Public Health Emergency Dispensing Site Plan - The Health Administrator reported on progress of EDS plans. Sites, staff and operation plan near completion. The next step is. training of greeters and record keepers. Signs and content under design with Jane and public health nurse. Temporary Morgue plan completed the next step will be to review the agreement with the Fire Chief. The plan to arrange for over the counter (OTC) medication for emergency shelter needs to be reviewed with new pharmacist at CVS and Brooks. Staff has changed. By October 1, 2005 the Reading's full public Health Emergency plan will be complete and ready to start training meetings with other town departments. • Public Health Nurse has begun planning fall public flu clinics. 3 large clinics and 5 smaller clinics, as in the past. Trish is doing a very good job. I have time to work on other issues. Note for the minutes: first time in 3 years the health Administrator has not planned for flu season. This is a major planning function 30-40 hours. Construction projects - schools moving along Barrows will be ready for September 6 in all public health areas the procedure and inspections have flowed 7 inspections through the summer. This has been a great improvement over the Wood End process of last summer. Renovation of retail site to as a restaurant.. - Jimbo's Roast Beef owner will present to the BOH. Request before the BOH by James Garabedian owner of Jimbo's Roast Beef, 454 Main Street To receive a waiver not to install a grease trap. History Since June 20 each week at time 2 - 3 times per week Mr. Garabedian came to the Health Division counter to ask one or two questions regarding the renovation of 454 Main Street former flower shop). He was told to bring a plan; equipment cuts sheets when he applied for his building permit. July 26, 2005 sketch of plans reviewed. He was told again about the grease trap and equipment cut sheets and cert. documents. The plan was reviewed and corrected for health code compliance and again was asked for equipment cut sheet. Each time at the counter or in conference room Mr. Garabedian received an NCR copy of the points made in our discussion. July 27, 2005 some cut sheets and certification copies were delivered to the health division. Mr. Garbedian was told depending on the number of seats in the restaurant the requirements can change. He agreed. But did not agree to the grease trap installation. At this point he stated he has had many restaurants how can this change. A BOH waiver if you prove there is no need. August 8, 2005 the request for waiver is before the BOH. Mr. Garabedian feels he does not need the grease trap. As his letter to the Board states he is not ethnic or McDonald's. After lengthy discussion, Board member Barbara Meade read aloud Mr. Garabedian request for a waiver. It was pointed out that he needed documentation of his "beliefs". Chairperson Colleen Seferian noted if documentation recommend by the Health Administrator such as records of grease flow through grease commodities company, volume of food and customers in past restaurant and perhaps a letter of documentation from one of the past Health Departments from town he operated restaurants in over the last five years that would give written support that there had been no sewer back-up in the main line directly attributed to Mr. Garabedian's food operation the BOH could make an informed decision to grant a waiver or follow regulations. After further discussion Mr. Garabedian agreed to this approach only if the BOH could meet before their next meeting and decide. They would inform him after the documentation was delivered to the Health Division and carefully reviewed before a decision would be made. If there was a possibility to meet before September 8, 2005 the regular BOH meeting that would be entertained by the BOH. • Construction site update continued- Archstone Apartment complex on schedule - BOH has responded x3 regarding dust- Developer will wet roads and also use water tanker truck Pest Management Company is to trap and bait on the SW boundary of property after health responded to rodent complaint. RMHS - cafeteria and BR, labs progressing Johnson Woods ongoing no health complaints Outdoor water use restriction- discuss regarding low water level of Ipswich River Basin and the town's response. All citizens notified of restriction by reverse 911, newspaper, and other media. The private wells will be asked to follow restrictions not mandatory to do so. The BOH permits and follows well installation and decommishing. The BOH maintains the registered well list. Presently no wells under construction. Only 2 permits have been issued for 2005. Vote 3:0:0 to hold permitting of well installation until October 31 and at that time re- evaluate water table and environmental conditions. Notification will be in media, web page and posted. Well drillers association will receive notification of moratorium on permits for 8 weeks. • Brief discussion regarding keeping of Dog regulations. No specific communication from BOS to date. Surrounding BOH regulations do not include breed specific regulations. This is strongly discouraged by the State Dept. Public Health and MSPCA as well as the CDC Rabies control project. Further discussion necessary. Wood End School Indoor Air Quality case discussed. The Board reviewed the inspection and outcome of the July Inspection. The email from the Phillips family to the superintendent, Town Manager and School Committee members was responded to by the Town Manager with an included time line and documentation from the State indoor air quality expert who which the administrator discussed the inspection. All references to lack of proper inspection and honesty of Jane was addressed by the Town Manager and sent to the complainant, superintendent and school committee. Mr. Gary Philips asked to address the BOH. He apologized for the comments and stated they were not true. Further limited discussion was held. A second and third apology for the poor judgment and untrue statement were made. Mr. Philips apologized for his wife Linda and offered a bouquet of flowers. He left the meeting.
