The Board of Health meeting was called to order on October 12, 2006 by Chairmen.
Barbara Meade at 6:00 pm at the Town Hall, Berger Room. Those present at the meeting
were Colleen Seferian, David Singer and staff liaison Jane Fiore.
Business:
• Minutes of September 14, 2006 were accepted as read 2:0:0.
• Next order of business
• Review of Board of Health Regulation publication for Library, Town Clerk and
Community Services for public review and use.
• Board comment letter to Board of Selectmen on Atlantic Food Mart plan for
display and sale of alcoholic beverages was sent but no comment received from
BOS.
• Mosquito Control report issued to BOH by administrator: 2nd treatment of storm
drains completed, dead bird collection fro tracking of WNV ended by MDPH on
September 24, 2006. No reported human cases in Reading of WNV, EEE. Work
with recreation division and school athletic department on prevention was very
positive. Coaches and parents responded well to all mailing and educational
presentations by Health Division
Next Order of Business appeal by Owner of Venetian Moon administrative hearing
before the Board regarding $25 fine against 105 CMR 590.009 (E)
Carmen Cavallo and Joshua Latham, Esq. presented to the Board. Mr. Latham's client
refuses to pay fine stating he did have his staff take Choke Saver in September. The
documentation was not received by the Health Division by September 30, 2006. As
noted in the initial certified letter documentation must be filed with the BOH before 5
pm on the first day of the next month. The attorney noted the course was taken but the
documentation was not received by the BOH. It was requested the Board forgive the
fine. The Health Administrator had called the restaurant partner and he noted the
verification and payment of the fine would be done by 5 pm on October 2, 2006. This
was not carried out. The Health Division received the documentation on October 6,
2006 after the owner noted he was taking the BOH to court. The Board took the issue
under advisement and would notify the owner by certified mail what their decision
would be. The chairman noted the goal of the BOH to protect the community's health.
Colleen Seferian moved to keep the fine in place the motion was seconded by David
Singer The Board voted 3:0:0 to leave the fine standing with the response this has
been used with a variety of restaurants to insure compliance with the state and federal
food code. The Health Administrator will send the decision as noted by the certified
mail on October 13, 2006.
New Business
• System to annually reaffirm all agents of the Board of Health to carry out legal
responsibilities of the Board under MGL 111 Section 40 Town of Reading bylaw
5.11.5 issuance of non-criminal disposition. The individuals and the enforcement
powers as noted in the attachment to these minutes was moved by David Singer
seconded by Colleen Seferian and voted 3:0:0 as noted in the attached.
• 113 Longwood Road regarding septic was discussed. The homeowner has
complied with filing of all requested pumping records. Non-compliance on filing
accurate as built plan for the existing septic system. The Board voted 3:0:0 to send
a certified letter to the home owner requesting a copy of the plan by a date certain.
The certified letter will be sent October 13, 2006.
Reports:
• Reading Coalition Against Substance Abuse (RCASA) by Barbara Meade- bylaws
and 501c3 have been filed with the Attorney General's office the second meeting
will be held on October 24. at 5 pm Town Hall. Jane Fiore reported the health
Division and the School wellness coordinator have filed for a $10, 000 planning
grant through MDPH Healthy Communities.
• Town-wide construction reports were tabled.
• Emergency Response Update
o Volunteer Information Guide letters sent out to all school employees 700
requesting volunteers for EDS. At present time early response. Late fall
training for volunteers will be planned when 25 have volunteered.
o RN and paramedic training on chemical response planned for October 19,
2006. Emergency response back packs to be distributed at this training.
Barbara Meade and David Singer will attend training to represent the BOH.
Invitation will be sent to BOS chairman Ben Tafoya.
o Killam Flu clinic to be used as an Emergency Dispensing Site for training
exercise for regional Coalition
o . CDC auditing MDPH and local pandemic plans in October.
o Cable program on pandemic discussed - opening all set. Health Admin has
not completed script - DPH is rolling out cable program Nov 1.
• Public Information
o Web page progressing should be up and running by October
o Weekly News Column getting very positive response - increase in
cholesterol clinic appointment. Calls increased on mercury exchange
- program and increase sharps exchange program. Many comments just on
general information.

On October 12, 2006 the Reading board of Health voted 3:0:0 to reaffirm the referenced
individuals to act as their agents to inspect and enforce all By laws, Regulations state and federal
codes pertaining to public health.
The following individuals will be annually installed as agents of the BOH: to enforce and to have
