HomeMy WebLinkAbout2005-04-13 Conservation Commission MinutesMinutes, Reading Conservation Commission, April 13, 2005 Minutes of the Reading Conservation Commission Selectman's Meeting Room, Town Hall April 13, 2005 i` 4- 3i"I Present: Will Finch-Vice Chairman, Doug Greene, Becky Longley, Steve Goldy, M ark Wetzel, Jamie Maughan, Commissioners; Fran Fink, Administrator The meeting was called to order at 7:00 p.m. Old/New Business: Camp Curtis Guild, Order of Conditions, DEP 270-440, RGB 2005-5 The Commission reviewed a letter from NHESP dated March 28, 2005. Mr. Greene moved to accept it as an insignificant plan change under the Order. Ms. Longley seconded. Vote 6-0. The Commission asked Ms. Fink to contact the DPW concerning suitable sites for snow dumping. Maplewood Village, Order of Conditions, DEP 270-423, RGB 2004-13 The Commission reviewed a proposed planting plan and draft condominium documents and determined that modifications are needed. Longfellow Road, Order of Conditions, DEP 270-415, RGB 2003-52 Ms. Fink reported on the status of appeals by the applicant. 553 Haverhill Street, Order of Conditions, DEP 270-409, RGB 2003-38 Mr. Procopio, owner, was present. The Commission reviewed an as-built site plan and comments from Ms. Fink. They determined that the deck does not meet the 35' setback as constructed. To offset this problem, Mr. Procopio will be required to plant native shrubs and set bounds to restore a 25' Zone of Natural Vegetation between the deck and the wetland. Public Hearing, Notice of Intent, 23 Criterion Street, DEP 270-441, RGB 2005-7 The Vice Chairman opened the hearing. James Lordan, Sage Building and Development Corp., and and Libby Wallis presented revised site plans dated April 11, 2005. Ms. Fink and the Commission reported site visit observations. After further discussion, Mr. Maughan moved to close the hearing. Ms. Longley seconded. Vote 6-0. Mr. Maughan moved to permit the project as presented this evening, subject to final Order of Conditions to be drafted for the April 27, 2005, meeting. Mr. Greene seconded. Vote 6-0. Mr. Greene moved to approve the work as proposed within the 25' Zone of Natural ° Vegetation. Mr. Maughan seconded. Vote 6-0. Minutes, Reading Conservation Commission, April 13, 2005 Public Hearing, Notice of Intent, Town of Reading Public Works Department, Strout Avenue, DEP 270-445, RGB 2005-14 The Chairman opened the hearing. Peter Tassi, Water Superintendent, was present along with Dwight Dunk and Isabel Simoes from CDM. Ms. Simoes reported that additional survey work had been done, a meeting had been held with the Town Engineer, and the wildlife survey had identified venial pool species present in the proposed work area, including blue-spotted salamanders. CDM will meet with NHESP soon to review the wildlife findings and applicable regulations. The Commission discussed, and NHESP authority. Mr. Tassi would like the Commission to issue an Order of Conditions at their next meeting to support the grant and bid timing requirements. The Commission had questions about the NHESP implications, wetlands delineations, alternative work locations, the drainage design, and floodplains. They were not certain that they would have enough information by the next meeting to draft an Order. Mr. Greene moved to continue the hearing to April 27, 2005. Ms. Longley seconded. Vote 5-0. Public Meeting, Request for Determination of Applicability, TEC Associates, Mass. Bay Commuter Railroad Right-of-way, RGB 2005-10, vegetation management The Commission reviewed site visit reports, maps, and draft Findings. Mr. Greene moved to issue a negative Determination of Applicability with the Findings as drafted. Mr. Maughan seconded. Vote 6-0. Old/New Business: 80 New Crossing Road, Order of Conditions, DEP 270-285, RGB 1996-9 The Commission reviewed a request for a revised Certificate of Compliance. 13 Harvest Road, Emergency Certification The Commission reviewed an Emergency Certification issued by Ms. Fink after an order by the Fire Department to remove a leaking heating oil tank and surrounding contaminated soil. Mr. Greene moved to ratify the Certification. Ms. Longley seconded. Vote 6-0. 48 Pasture Road Mr. Maughan moved to approve a Minor Project Permit for tree cutting. Ms. Longley seconded. Vote 6-0. 42 Lawrence Mr. Goldy moved to approve a Minor Project Permit for a shed. Ms. Longley seconded. Vote 6-0. 641 Pearl Street, Violation Ms. Fink reported a site inspection following a complaint about machinery, solid wastes, and brush located in and near wetlands at 641 Pearl Street. 2 Minutes, Reading Conservation Commission, April 13, 2005 Mr. Greene moved to issue a Notice of Violation and order clean-up. Ms. Longley seconded. Vote 6-0. Reading Memorial High School Ms. Fink reported observations from a recent site inspection and the Commission reviewed recent correspondence concerning several problems. The Commission asked Ms. Fink to begin issuing fines if the silt fence is not completed by the end of the week. The meeting adjourned.
