The Commission asked questions and made suggestions. They advised he contact the Town Forest Committee also Finch moved, Greene seconded to approve project. Vote 5-0. 105 Libby Avenue, Order of Conditions, DEP 270-435, RGB 2004-36 Paul Pandolfo, owner, presented proposal to remove or trim several trees. Finch moved, Goldy seconded to accept proposed work as minor plan change. Vote 5-0. 40 Sunset Rock Road - Enforcement Order The Commission determined that owner has not begun any work to correct violation and has missed deadlines. Goldy moved, Finch seconded, to issue daily fines for the days since the deadline passed and to send a letter stating that additional fines will be issued if work is not done by October 12, 2005. Vote 5-0. Pondview Lane Subdivision - Enforcement Order The Commission reviewed site visit reports, and partial as-built plans, and information from the developer. The Commission did not find any lots ready for Partial Certificates of Compliance. A letter will be sent to the developer asking for actions to stabilize the site. 337 Ash Street - Enforcement Orders The Commission determined that owner has not done work to correct violation and has missed deadlines. Finch moved, Greene seconded, to issue fine for missing deadline, and to send a letter stating that additional fines will be issued if work is not done by October 12, 2005. Vote 4- 0 - 1 abstained. Hearin2s• Public Hearing, Notice of Intent, William Stantial, 335 Main Street, RGB 2005-29 Minutes, Reading Conservation Commission, September 28, 2005 Jack Sullivan, engineer, presented revised site plans and drainage calculations. He stated that a proposed lot line change has been submitted to CPDC. The Commission asked questions. Administrator provided comments. Maughan moved, Finch seconded to close hearing. Vote 5-0. Maughan moved, Goldy seconded to accept proposed plan and draft Order of Conditions for the next Commission meeting. Vote 5-0. Public Hearing, Abbreviated Notice of Resource Area Delineation, Vale Realty Trust, 335 Main, DEP 270-455, RGB 2005-30 Jack Sullivan, engineer, presented revised site plans. The Commission reviewed the soils report from Peter Fletcher. Mr. Hecht gave site visit report. The Commission reviewed draft Findings. Joe Westerman, 17 Avon Street, asked about impacts on neighbors if wetlands are filled. Mr. Hecht said that no work was proposed in the ANRAD, but if proposed in future, it would require a Notice of Intent, public hearing, and drainage system. Maughan moved, Finch seconded to close hearing. Vote 5-0. Finch moved, Maughan seconded to issue Order of Resource Area Delineation as drafted. Vote 5-0. Public Hearing, Notice of Intent, Kevin Fulgoni, 26 Rear Summer Avenue, DEP 270- 454, RGB 2005-27 Present: Libby Wallis, wetlands scientist, Lisa Mead, lawyer, Kevin Fulgoni, applicant Ms. Wallis presented revised site plans, watershed analysis, comments from NHESP requiring a Conservation Restriction, and request for variance. Ms. Mead provided history of lot and recent court decisions. Nancy Osoro, abutter on Summer Avenue questioned reason for parking lot on Willow Street. Mr. Hecht explained zoning requirement. The Commission commented on the importance of the proposed Conservation Restriction to protect habitat and allow public trail access. The Commission discussed the information concerning where the stream becomes perennial at length. The Commission asked questions. Maughan moved, Goldy seconded to continue hearing to October 26, 2005. Public Hearing, Notice of Intent, Deer Run Developers, Inc., Kylie Drive Subdivision (150, 160 and 166 Wakefield Street), RGB 2005-41 Present: John Ogren, engineer, Joe Byrne, Deer Run Developers Mr. Ogren presented plans for an 8-lot subdivision including storm water management system. The Commission asked questions. Mr. Hecht gave the site visit report. 2 Minutes, Reading Conservation Commission, September 28, 2005 Nancy Eaton spoke for Reading Open Land Trust, abutter. She asked whether detention basin would make ROLT land wetter, and whether public trail access would be provided to connect existing open space parcels in the area. Mr. Ogren said the developer might donate the lower parcel to the Town for Conservation purposes, and that the detention basin would discharge away from the ROLT land. Administrator provided comments and noted that Town Engineer was still reviewing the plans. She asked about blasting and 21E assessments. Diane Meyers, 159 Wakefield and speaking for Old South United Methodist Church, another abutter, submitted a letter and comments on drainage concerns and fill. Greene moved, Maughan seconded to continue hearing to October 12, 2005. Vote 5-0. Public Hearing, Notice of Intent, Town of Reading Public Works Department, Strout Avenue, DEP 270-445, RGB 2005-14 The Commission postponed the hearing until November 30, 2005, at the request of the applicant. Old/New Business: 25 Pinevale Avenue - Enforcement Order Present: Mr. and Mrs. MacKinnon, owners, and Mark Favaloro, lawyer Mr. Favaloro submitted planting plan and letter from insurance company. The Administrator gave a site visit report, describing lack of compliance with Enforcement Order. The Commission asked questions and set guidelines for planting to be completed by October 12, 2005. Reading Memorial High School, DEP 270-416, RGB 2003-51 The Commission reviewed the status of work and made plans for a joint meeting on October 3, 2005 with the School Committee. Drinking Water Supply Protection Grant application, Kieran Road Administrator reported that grant application had been submitted to EOEA and she is preparing background information for Town Meeting Warrant. Maplewood Village, Order of Conditions, DEP 270-423 Finch moved, Greene seconded to authorize the Administrator to sign off on occupancy for Building C, provided that the flood storage compensation area is graded per approved plan. Vote 5-0. Hunt Memorial Park Administrator gave site visit report. Finch moved and Greene seconded to close files for recent projects. Vote 5-0. Meeting adjourned. F~
