MINUTES R E PO G , MASS Reading Conservation Commission Meeting Selectmen's Meeting Room, 7:00 PM Wednesday, June 24, 2009 Present: Mark Wetzel, Chairman; Bill Hecht; Tina Ohlson; Barbara Stewart; Doug Greene; Annika Scanlon; Fran Fink, Conservation Administrator; Brian Sullivan, Associate Member; Maureen Knight, Recording Secretary. Old/New Business 565 Haverhill Street, DEP 270-516, RGB 2007-27 - Request for Certificate on Compliance The Commission reviewed site visit reports. Motion made by Mr. Hecht to issue a Certificate of Compliance for this property. Ms. Stewart seconded. The vote was 4-0-0. 88/98 Walkers Brook, DEP 270-489, RGB 2006-39 - Plan revision (sign), status of work The Commission did not think this sign is ready for approval. They have submitted three different site plans with three different locations for the sign. There also is some soils information that is not acceptable. The Commission will request more information. 188 and 194 Van Norden Road, DEP 270-541, RGB 2008-33 - Status of work The Commission did a site visit and bounds have been installed in the back. There is no spill-over to 202 Van Norden. As-built plans must be provided to ensure all is done properly. 25 Walkers Brook Drive, DEP 270-470, RGB 2005-51- As-built plan Ms. Fink received an as-built plan, but it is not complete. The developer is working with Town Counsel to prepare the drainage easement document. Motion made by Mr. Hecht to waive the requirement for TSS sampling. Ms. Stewart seconded. The vote was 4-1-0 (Mr. Greene opposed). 8 Walkers Brook Drive, DEP 270-525, RGB 2008-3 - Plan revision (flagpole), as-built plan Ms. Fink did not receive a flagpole design yet. She will meet with the landscaper to insure they know where they may not mow and to discuss invasive species and tree planting. There is also excessive mulch that should be removed from the Riverfront area and replaced with plantings. Reading Memorial High School, DEP 270-416, RGB 2003-51-Status of work Ms. Fink and Mr. Hecht met on site with the new contractors for the preconstruction meeting. Ms. Fink said she walked around with them where there are erosion problems. They are going to put riprap on the steep area at the loading dock. They have a surveyor gathering additional as-built information. Ms. Fink is meeting again on site tomorrow. DPW should be involved in planning long-term maintenance. Public Hearing, Notice of Intent, Wande Li, 16 Varney Circle, RGB 2009-12, remove trees, fr repave driveway ` This hearing is postponed until the next meeting on July 8, 2009. Conservation Commission Meeting, June 24, 2009 Public Hearing, Notice of Intent, David Mancuso, 129 Howard Street, RGB 2009-14, construct shed, deck, and covered porch; resurface driveway, patio, and walkway; remove trees and r extend lawn Present: Jack Sullivan and David Mancuso Mr. Sullivan reviewed the draft Order of Conditions and said they wanted references made to flood plains to be removed. The Commission explained that what he wanted removed was standard language and should be included. Other items were discussed and some modifications were made. Ms. Fink did not find the tree locations on the site plan and Mr. Sullivan pointed them out. Ms. Fink said the Commission needs time to review the tree locations on site and she would like to do one more site visit. The Commission members did not think another site visit was required. Motion made by Mr. Hecht to accept the modifications regarding the tree locations as shown on the site plan. Mr. Greene seconded. The vote was 6-0-0. Mr. Sullivan and Mr. Mancuso continued to list multiple conditions they wanted removed. The Commission explained that these conditions were standard boilerplate language, part of the Town by-laws, and must remain. Motion made by Mr. Hecht to issue the Order of Conditions as amended. Ms. Stewart seconded. The vote was 5-0-1 (Ms. Scanlon arrived during this hearing and did not vote.) Public Meeting, Request for Determination of Applicability, Elaine and Kenneth Connolley, 49 Louanis Drive, RGB 2009-18, three season porch Present: Scott Sica Mr. Wetzel gave a site visit report. Motion made by Mr. Hecht to issue a negative Order of Conditions. Ms. Ohlson seconded. The vote was 5-0-0. Public Hearing, Notice of Intent, Donald and Tammy Stapleton, 26 Bond Street, RGB 2009- 19, addition to house, landscaping Present: Donald Stapleton Mr. Stapleton plans to add a two-story addition to his house. He provided a revised site plan. Ms. Fink said the Commission has issued previous permits in this area because the land all slopes down into the wetlands. The Commission reviewed the setbacks. Ms. Fink will prepare the draft order for the next meeting on July 8, 2009, based on the revised site plan. Motion made by Mr. Hecht to continue the hearing to July 8, 2009. Ms. Scanlon seconded. The vote was 6-0-0. Public Hearing, Notice of Intent, Darren Abreu, 2 C Street, RGB 2009-20, grading and landscaping Present: Bruce Eaton and Darren Abreu Conservation Commission Meeting, June 24, 2009 Mr. Abreu wants to widen his driveway and add some fill. An 80,000 lb. truck fell into the wetlands off the slope. The Commission received site visit reports. Ms. Fink reviewed her memo to the Applicant. Stabilizing the slope may require a retaining wall, and the wetlands boundary is not correct on the site plan. The proposed driveway expansion would be in the 25' do not disturb buffer zone. Mr. Wetzel thinks the plan should be revised.. Mr. Hecht said there is no benefit to the Town or to the wetlands to allow the widening of this driveway. Stabilizing the existing slope would be a different plan. The Commission discussed possible solutions that might be acceptable to stabilize the driveway but they were not in favor of increasing the size of the driveway. Mr. Eaton will assist Mr. Abreu with alternative solutions and present revised plans to the Commission. Motion made by Mr. Hecht to continue the hearing to July 8, 2009. Mr. Greene seconded. The vote was 6-0-0. Public Meeting, Request for Determination of Applicability, Mass. Highway Department, Interstate Route I-95, RGB 2009-20, remove and replace signs and guardrails Present: Andrea Norton-Wenzel The Commission reviewed the conditions and made a minor modification. Motion made by Mr. Hecht to issue a negative Determination with the conditions as amended this evening. Ms. Stewart seconded. The vote was 6-0-0. Public Hearing, Notice of Intent, Reading Public Works Department, DEP270-552, RGB 2009- 9, reconstruction of West Street and intersecting streets between Longwood Road and Border Road This hearing postponed until the next meeting on July 8, 2009. Old/New Business: 105 Lilah Lane, DEP 270-514, RGB 2007-26 - proposed planting plan Mr. Burke was present. The Commission reviewed a site visit report, and discussed to location of the new fence in the back yard, and the planting requested in a letter sent last November when the fence was approved. The Commission asked Mr. Burke to submit a planting plan including two trees and sufficient shrubs to restore the 25-foot zone of natural vegetation near the fence, as set forth in the November letter. Mr. Burke asked questions and then said that he would submit a planting plan. Old Mill Lane, DEP 270-283, RGB 1995-31- Request for Certificate of Compliance The Commission received site visit reports. Motion made by Mr. Hecht to issue a Certificate of Compliance. Ms. Ohlson seconded. The vote was 6-0-0. Conservation Commission Meeting, June 24, 2009 Kylie Drive, DEP 270-462, RGB 2005-41- Easements and covenant, Lot 5, spring maintenance The Commission received site visit reports and reviewed the status of work requested in recent correspondence. The developer has not maintained necessary erosion controls, has not submitted necessary documents, and has not called for necessary inspections. The Commission directed Ms. Fink to order that framing not begin on Lot 5 until these matters are addressed. The Commission also requested that, if work was not done by July 8, 2009, daily ticketing should commence. The owner of Lot 8 will be asked to bring the driveway into compliance. The owner of Lot 7 will be asked for information about the enclosure in the back yard. . 3 Indiana Avenue, DEP 270-394, RGB 2003-10 - Request for Certificate of Compliance The Commission did a site visit and the property looked good. Motion made by Mr. Hecht to issue a Certificate of Compliance. Ms. Stewart seconded. The vote was 6-0-0. 134 Fairchild - Draft Conservation Restriction Kevin Simard received the marked up draft and he will meet with Ms. Fink next week to review. Ms. Fink reviewed the restrictions with the Commission. Town Counsel will need to be involved in the drafting of the final document. 1381 Main Street, Enforcement Order - Status of work The deadline for the survey was moved to July 10. There are some weeds but no grass had been planted yet. Mr. Hecht said a ticket should be sent and another site inspection will be done on July 6. 20 Benjamin Lane, DEP 270-466, RGB 2005-49 - Status of work The Commission did a site visit. The swale has been planted on Lot 3 and the restoration areas have been planted on Lot 4. Court of Honor for Eagle Scout Pat Gildea Ms. Ohlson will attend the ceremony on behalf of the Commission. 10 Torre Street, DEP 270-538, RGB 2008-35- Revised site plan for approval The owner has submitted a revised site plan as requested in the Order. There are some additional changes needed. A letter will be sent to the owners of 12 Track Road about the off-site mitigation. Charles Street Cemetery The eroding area in the back has not been stabilized yet. Ms. Fink will speak to Bob Keating. Trail Committee - June 16 meeting, summer plans, Recreational Trans Grant There are new trails going in: Longwood, Maplewood, Kylie, etc. The Commission needs to invite the abutters to a meeting and explain exactly what is going on before the boy scouts appear with supplies and tools. There should be established Town guidelines for these situations. A town-wide Order of Conditions is recommended. Bill for supplies for Maplewood Village trail submitted for reimbursement Motion made by Mr. Hecht to pay the bill from Justin Cymbal. Ms. Stewart seconded. The vote was 6-0-0. 4 Conservation Commission Meeting, June 24, 2009 Minor Projects: 56 Pasture Road Motion made by Mr. Hecht to approve a minor project permit. Ms. Stewart seconded. The vote was 6-0-0. 708 Pearl Street Motion made by Mr. Hecht to approve a Minor Project Permit. Ms. Stewart seconded. The vote was 6-0-0. 3 Old Mill Lane Motion made by Mr. Hecht to approve a Minor Project Permit. Ms. Stewart seconded. The vote was 6-0-0. 23 Osbourne Lane Motion made by Mr. Hecht to approve a Minor Project Permit. Ms. Hanlon seconded. The vote was 6-0-0. July and August meeting dates Meetings in July will be on July 8 and July 15. August will be as scheduled, August 12 and 26. Minutes for approval May 27 and June 10, 2009 Motion made by Mr. Hecht to approve the minutes for May 27, 2009. Ms. Stewart seconded. The vote was 6-0-0.
