(Mr. Tucker and Mr. Sullivan arrived after the Johnson Woods matter.) Absent: Annika Scanlon Public Meeting, Request for Determination of Applicability, Jon and June Ewing, 17 Partridge Road, RGB 2009-37 The Commission heard site visit reports and reviewed the proposed work. They want the six trees that will be removed to be replaced with new trees of the Applicant's choice. The draft conditions were amended to reflect this. Motion made by Mr. Hecht to issue a negative Determination.of Applicability with the conditions as amended this evening. Ms. Ohlson seconded. Vote was 4-0-0. Old/New Business 25 Walkers Brook Drive, DEP 270-470, RGB 2005-51- Request for Certificate of Compliance and bond release Present: Taryn Warren of Dickinson Development. The Commission reviewed as-built information. Motion made by Mr. Hecht to issue a Certificate of Compliance with continuing conditions. Ms. Stewart seconded. Vote was 4-0-0. Motion made by Mr. Hecht to release the surety in the amount of $20,000. Ms. Stewart seconded. Vote was 4-0-0. Public Hearing, Notice of Intent, Town-wide, RGB 2009-36, Public Trail construction and improvements The Commission reviewed comments from NHESP and the DEP file number notice. The Commission reviewed the draft findings and conditions, and made revisions. Motion made by,Mr. Hecht to issue the Order of Conditions with the findings and conditions as amended this evening. Ms. Ohlson seconded. Vote was 4-0-0. Motion made by Mr. Hecht to close the public hearing. Ms. Stewart seconded. Vote was 4-0-0. Public Hearing, Notice of Intent, Max Gabriello, 285 Main Street, DEP 270-564, RGB 2009 28, restaurant and parking lot This hearing was postponed to January 13, 2010, at the request of the Applicant. 1 Conservation Commission Meeting, December 16, 2009 Old/New Business 285 Main Street, DEP 270-540, RGB 2008-34 - Status of work Ms. Fink reported recent email correspondence with the LSP and others concerning pending tank removal. Plans have not been submitted yet. Johnson Woods, DEP 270-416, RGB 2004-10 Request for Extension, site plan revision Bob Gargano, Project Manager, was present and submitted several documents and a letter from Ted Moore, developer. They are working on plans for Buildings 22 and 23, on updated as-builts for completed areas, and other items requested by the Commission in late November. Motion made by Mr. Hecht to issue an Extension Permit until July 23, 2013. Ms. Ohlson seconded. Vote was 4-0-0. Motion made by Mr. Hecht to authorize Ms. Fink to approve the plans for grading and drainage at Buildings 22 and 23. Ms. Stewart seconded. Vote was 4-0-0. Mr. Sullivan and Mr. Tucker arrived. Athletic Fields, Symonds Way, DEP 270-324, RGB 1999-21 and Minor Project Permit The Commission did a site visit. The silt fence has not been removed and the hole near the sprinklers has not been repaired. Ms. Fink said the forested land around the ball field on three sides was supposed to be subdivided and transferred to Conservation, but this has not been done yet. An ANR plan was recorded and votes were taken by Town Meeting and Selectmen. Town Counsel is working on a deed needed to complete the transfer, and also on deeds for several other sites that Town Meeting voted to transfer in 2001. Kylie Drive, DEP 270-462, RGB 2005-41-Status of work, fall maintenance The Commission reviewed a letter from Michael Philips, the developer. He said the owner of Lot 5 hired a landscaper who did not install the usual wall stabilization materials. The Commission asked. Ms. Fink to send a letter to the owner of Lot 5 asking for corrections. Mass. Highway Depot, Causeway Road - Response Action Outcome Statement, RTN 3-13565 and RTN 3-17716 The Commission received the Response Action Outcome Statement for this area. Ms.. Fink will contact Mass Highway about a Certificate of Compliance for the Order that governed the work. 292 Grove Street, Meadow Brook Golf Club, DEP 270-431, RGB 2004-18; RGB 2006-5; and DEP 270-472, RGB 2006-8 - Status of work The Commission reviewed site visit reports and the records on file. The irrigation Rrder, RGB 2006-8, still has work to be performed. . Motion made by Mr. Hecht to issue a Certificate of Compliance for the pool house, DEP 270-431, RGB 2004-18.. Ms. Stewart seconded. Vote was 5-0-0. Motion made by Mr. Hecht to release the surety in the amount of $5,000 for the pool house. Ms. Stewart seconded. Vote was 5-0-0. Motion made by Mr. Hecht to close the Determination for part of the irrigation system, RGB 2006- 5. Ms. Ohlson seconded. Vote was 5-0-0. Conservation Commission Meeting, December 16, 2009 134 Fairchild Drive, DEP 270-475, RGB 2006-13 - Site plan revision The Commission reviewed a letter from the owner, Mr. Simard, dated 12/14/2009. Because he could not attend the meeting this evening, the matter will be discussed on January 13, 2010. Maplewood Condominium, Salem Street - Proposed trail easement Ms. Fink reviewed and revised the draft trail easement document and returned it to the lawyer and site manager who represent the condominium for review. The Commission received copies. Mattera Cabin fundraising Ms. Fink said that press releases have been sent out and she has received some donations to date, and also several phone calls. Suggestions have been made how to purchase a discounted furnace. Technical advice has also been offered. There is also the possibility of a grant from a family trust with ties to Reading. Friends of Reading Recreation has agreed to will pursue this opportunity with the Commission. The Commission will mail the announcement of the fundraising campaign to people who have taken an active interest in trails and the cabin. 508 West Street Motion made by Mr. Hecht to approve a Minor Project Permit for a shed, pending receipt of the application from the owner. Ms. Stewart seconded. Vote was 5-0-0. 56 Van Norden Road Motion made by Mr. Hecht to approve a Minor Project Permit for removal of fences, brush, and debris in the Buffer Zone. Ms. Stewart seconded. Vote was 4-1-0. Minutes for approval: Motion made by Ms. Stewart to approve the minutes for October 28, 2009 as submitted. Mr. Hecht seconded. Vote was 5-0-0. Motion made by Mr. Hecht to approve the minutes for November 18, 2009 as submitted. Ms. Stewart seconded. Vote was 5-0-0. Motion made by Ms. Ohlson to approve the minutes for December 2, 2009 as submitted. Ms. Stewart seconded. Vote was 5-0-0. 10 Torre Street A neighbor was complaining that the boulders were in the right of way at the Track Road restoration area. The Town Engineer advised that boulders should not be placed in the right-of-way unless permission is obtained from the Selectmen. Ms. Fink sent an email to owner asking for the boulders to be relocated out of the street, but the owner refused. The Commission will send a letter and require that the owner move the boulders. Haverhill Street near #572 The Commission reviewed the Response Action Outcome Statement for the fuel release from the truck accident. The spill was contained and removed without damage to the wetlands. 306 Main Street The LSP did more soil borings at the request of DEP. Ms. Fink will do a site visit. Conservation Commission Meeting, December 16, 2009 Bare Meadow Conservation Area, near 695 Pearl Street The two dead trees will be removed by DPW. They are located at the trail entrance and next to the utility wires. St. Athanasius Church, 306 Haverhill The Commission reviewed a letter from the church. Instead of resetting the chain link fence and stone. level spreader as previously agreed, they suggest that the storm water runoff might be resolved by adding curbing at the edge of the parking lot and directly flow into the swale north of the community center building. The Commission would like an engineer to design the system and would like an erosion barrier to be sent at the wash-out site for the winter. Ms. Fink will send a letter to the church. Reading Memorial High School The Commission reviewed a complaint from an abutter about high water levels in the wetlands and drainage systems at the high school. The dam has been installed recently to fill Castine Field for skating. The Commission will ask DPW to check the drainage systems for blockages and clean them as needed. 29 Partridge Road Ms. Fink gave a site visit report. Motion made by Mr. Hecht to close the Minor Project Permit for a shed. Ms. Stewart seconded. Vote was 5-0-0. Parker Middle School Ms. Fink reported a site visit report with Ryan Percival from Engineering and John Feudo from Recreation. The playing field is done and the grass is in around it. The drainage systems are all installed and working. DPW will schedule catch basin cleaning soon. The area under the bleachers has erosion gullies that need stabilization. The brush pile near the stream is still there and should be removed. Portions of the stream banks may need to be graded to a more gentle slope and seeded. A site visit will be scheduled in the spring. Engineering will submit an as-built plan. Adjournment Motion made by Mr. Hecht to adjourn the meeting. Ms. Ohlson seconded. Vote was 5-0-0. 4
