Absent: Annika Scanlon; Tina Ohlson; Brian Tucker Old/New Business 1 d•r 112 Belmont Street, RGB 2010-8 Present: Mrs. Nelson, applicant Mrs. Nelson wants to remove four trees. She is worried about them being angled towards the house and that they would fall on the house during a storm. Motion made by Ms. Stewart to allow the removal of the four trees. Mr. Sullivan seconded. Vote was 4-0-0. 28 Summer Avenue, DEP 270-454, RGB 2005-27 Present: Kevin Fulgoni The Commission did a site visit. Motion made by Ms. Stewart to require moving one ZNV bound on another property to the ZNV on site. Mr. Greene seconded. Vote was 4-0-0. Kylie Drive, DEP 270-462, RGB 2005-41 The Commission reviewed site visit reports, correspondence and a plan revision for Lots 4 and 5. The Chairman said there is erosion and the slope is too steep,but the plan change should fix the situation. Motion made by Mr. Sullivan to approve the plan revision. Mr. Greene seconded. Vote was 4-0-0. 10 Torre Street, DEP 270-538, RGB 2008-35 The Commission reviewed site visit reports. The site is clean, the grass is growing, and the trees are leafing. The Track Road area has trees leafing, but some of the loam needs to be reseeded.and the boulders need to be moved. Ms. Fink will send a letter requesting the spring-cleaning of the drainage and removal of the boulders by July 1, 2010. 1310 Main Street, DEP 270-522. RGB 2007-39 Ms. Fink did a site visit with the builder and there is a short list of areas that need to be completed. RMLD, Causeway Road/West Street Substation, DEP 270-570, RGB 2010-3 Ms. Fink reported on a meeting with Kevin Sullivan of RMLD. They have put a bid out for the removal of the contaminated material on site. Further excavations will be made and removal as appropriate will be done. They are also waiting for approval from EPA before the next phase of the project begins. They will remove everything that needs to be removed except if prohibited by structural reasons. RMLD also requested to remove three trees on the west side of West Street that are too close to the transmission lines. 1 Conservation Commission, May 12, 2010 Motion made by Mr. Stewart to allow trees to be removed if they are on conservation lands. Mr. Sullivan seconded. Vote was 4-0-0. 323 Main Street and Benjamin Lane Present: Larry Ramdin, Health Administrator Mr. Ramdin said there are a large number of rodents nesting in this area. He is working with owners to close gaps in the fence, keep the dumpster area clean, and trap the rodents. Some traps will be set in or near the wetlands. Motion made by Ms, Stewart to approve the removal of the rodents. Mr. Greene seconded. Vote was 4-0-0. 119 Lilah Lane, DEP 270-171, RGB 1987-12 The Commission did a site visit and reported that work is complete. Motion made by Ms. Stewartto issue a partial Certificate of Compliance under the Order for the subdivision. Mr. Greene seconded. Vote was 4-0-0. 85 Lilah Lane, DEP 270-526, RGB 2008-5 - Request for Certificate of Compliance The Commission did a site visit and reported that work is complete. Motion made by Ms. Stewart to issue a Certificate of Compliance. Mr. Greene seconded. Vote was 4-0-0. Motion made by Ms. Stewart to release the bond in full. Mr. Greene seconded. Vote was 4-0-0. 105 Lilah Lane, DEP 270-514, RGB 2007-26 - Request for Certificate of Compliance The Commission did a site visit and reported that work is complete. Motion made by Ms. Stewart to issue a Certificate of Compliance. Mr. Greene seconded. Vote was 4-0-0. Public Meeting, Request for Determination of Applicability, Rebecca Poulin, 235 Lowell Street, RGB 2010-10 Present: Robin Parker, Architect, Rebecca Poulin, applicant Ms. Parker presented the proposal for an addition to the existing house. The dumpster will be placed in the driveway. The Commission reviewed site visit reports and plans. They noted an existing erosion problems on the slopes beside the driveway. They reviewed the draft findings and conditions. . Motion made by Mr. Greene to issue a negative Determination of Applicability with the findings and conditions as drafted. Ms. Stewart seconded. Vote was 4-0-0. 2 Conservation Commission, May 12, 2010 Public Hearing, Notice of Intent, Michael Fabiano, 20 Fox Run Lane, DEP 270-572, RGB 2010-7 Present: Michael Fabiano, Brain Corrigan, attorney Mr. Corrigan presented t a revised plan for cutting and replacing trees, fencing, and landscaping. He also requested that the bond be waived for financial hardship issues. The Applicant wants to do the project in phases with the project being completed during 2011. The Commission reviewed the draft findings and conditions and revised them. Motion made by Ms. Stewart to issue the Order of Conditions with the findings and conditions as amended. Mr. Greene seconded. Vote was 4-0-0. Motion made by Ms. Stewart to close the public hearing. Mr. Greene seconded. Vote was 4-0-0. Public Hearing, Notice of Intent, Max Gabriello, 285 Main Street, DEP 270-564, RGB 2009-28 Present: Max Gabriello; Kristine Sheehy,attorney, Paul Alunni and David Petkewich, engineers, Scott Morrison, wetlands consultant, Rene Mugnier, structural engineer, Chris Huntress, landscape design Ms. Sheehy reviewed recent submittals and introduced the various consultants in attendance.. Ms. Fink distributed a memo to the Commission, the Applicant and the consultants. She said some progress had been, made but she still had questions. Ms. Fink reviewed the memo and voiced her questions and concerns with those present. The Commission requested additional information, as well as a site visit to review the BVW delineation and the proposed drainage outfall area. Ms. Fink said she had not received comments from Town staff regarding the submitted plans. She relayed the opinion and concerns of the Building Inspector regarding the foundation. The Chairman. said the structural engineer and the Building Inspector should have a discussion about these concerns. The Chairman said the Commission's main concern is some restoration of the slope that is eroding into the stream. They also asked about removal of the existing pavement that extends into the abutting site. Ms. Sheehy said she will speak with the abutters, but her client cannot be responsible for the adjoining site conditions. Ms. Sheehy said the CPDC's site plan review determined that there should not be a fence in the rear of the site. The Chairman said a mechanism should be put in place to prevent parking. There was discussion about the drainage design, utility routes, and other details. The Commission would like the Town Engineer to review the plans. Motion made by Mr. Greene to continue the hearing to Mayl9, 2010. Ms. Stewart seconded. Vote was 4-0-0. 39 Old Farm Road, DEP 270-563, RGB 2009-27 The Commission reviewed a site visit'report and discussed the condition of the tree canopy and vegetative cover on the slopes at 39 and 33 Old Farm. The elevation of the pool deck is high. The Commission reviewed a proposal from the owner to reduce the number of trees they were supposed Conservation Commission, May 12, 2010 to plant. The four trees on the revised plan will be approved with an additional hemlock to replace the cherry tree. Motion made by Ms. Stewart to approve the plan change. Mr. Sullivan seconded. Maplewood Condominium, 243-261 Salem Street Ms. Fink has received comments from the Association's lawyer on the proposed trail easement, but has not yet had a chance to review them. 10 Cory Lane Ms. Fink is working ti.wh DCR and the owner on revisions for the Conservation Restriction document. 18D Carnation Circle, DA Ms. Fink reported that work has begun. Erosion controls are in place. 2F Carnation Circle, DA Ms. Fink reported that the trees have, been removed and the site is stable. Motion made by Mr. Greene to close the case. Ms. Stewart seconded. Vote was 4-0-0. 20 Briarwood Road Ms. Fink reported that the work is nearly complete and the site is stable. Motion made by Mr. Greene to ratify sign off on the request for occupancy. Ms. Stewart seconded. Vote was 4-0-0. 717 Pearl Street Ms. Fink reported that landscaping work is taking place in the Buffer Zone without a permit. A violation notice will be sent. 41 and 43 Wilson Road Ms. Fink received a call that landscapers were mowing the zone of natural vegetation. Ms. Fink called Lyn Whyte at the RHA and then inspected the work. The Commission will send a letter saying if this happens again the RHA will be fined. Memorial Park Ms. Fink gave a site visit report. The topsoil is all stockpiled, the two ponds have been reshaped, and they are installing the under-drain pipes. They did not have any filter over the low-set pipes that connect the ponds, and she asked them to provide filters. 2 C Street Ms.. Fink gave a site visit report. The grass is very goodaround the house, but still sparse on the slope. There is a lot of sediment and debris in the swales at the end of the street. The Commission will send a letter-to the owner. Mattera Cabin Ms. Fink reported that the septic system was examined by Engineering and Health, appears to be in good shape. A few pipes need minor repairs. Vote was 4-0-0. Minor Projects: 65 Lilah (deck) Motion made by Ms. Stewart to approve the permit for plantings, shed and deck. Mr. Sullivan seconded. Vote was 3-1-0. A site visit will be scheduled. 89 Grove (deck) Motion made by Ms. Stewart to approve a minor project. Mr. Sullivan seconded. Vote was 4-0-0. 104 Forest (shed) Motion made by Ms. Stewart to approve a minor project. Mr. Sullivan seconded. Vote was 4-0-0. 62 Oak (deck) Motion made by Mr. Sullivan to approve a minor project. Ms. Stewart seconded. Vote was 4-0-0. Mass. Bay Commuter Rail The MBCR submitted the Yearly Operational Plan. Ms. Fink will check the DA to see whether it is still valid. Minutes Motion made by Ms. Stewart to approve the minutes for April 14, 2010 as drafted. Mr. Sullivan seconded. Vote was 4-0-0. Motion made by Ms. Stewart to approve the minutes for April 28, 2010 as drafted. Mr. Sullivan seconded. Vote was 4-0-0. 26 Bond Street The Commission reviewed a plan revision to add a deck to the house. Motion made by Mr. Hecht to accept the plan as a minor plan change. Ms. Stewart seconded. Vote was 4-0-0. Reading Memorial High School Mr. Hecht reported that the Riverfront restoration area has been planted and looks good so far. The Commission will monitor it over the summer.
