285 Main Street, DEP 270-564, RGB 2009-28
Present: Mark Johnson, attorney for Max Gabriello
Mr. Johnson requested three revisions in the wording of the Order of Conditions. The Commission
accepted two of the revisions and modified the third revision, with the agreement of Mr. Johnson.
Motion made by Ms. Stewart, seconded by Ms. Scanlon, to issue the Order of Conditions with the
Findings and Conditions as amended this evening. Vote was 5-0-0.
110 Grove Street, DEP 270-553, RGB 2009-8
Present: Brad Van Magness, owner
Mr. Van Magness presented plans to replace the front retaining wall, driveway surface, and
driveway drainage system, and to change the proposed granite porch to a wooden porch. The
Commission asked questions and advised that a structural engineer should prepare the final design
for the wall. Mr. Van Magness agreed.
Motion made by Ms. Stewart, seconded by Ms. Scanlon, to accept the proposed work as a minor
plan revision under the Order of Conditions. Vote was 5-0-0.
22 Roma Lane, Enforcement Order
Mr. Hecht gave a site visit report. Eleven trees have been planted, mostly evergreens. There is still
a gap in the BVW that needs more trees.
Motion made by Ms. Stewart, seconded by Mr. Tucker, to require the planting of four red maple
trees in the open part of the wetland. Vote was 5-0-0.
88-98 Walkers Brook Drive, DEP 270-489, RGB 2006-39 and DEP 270-502, RGB 2007-7
Ms. Fink gave a site visit report. The grass swales and restoration plants look good. The drainage
systems and pavement have been cleaned. Three small gullies on the slopes of the swales need to
be replanted or stabilized with rip-rap. The ZNV bounds must be set, and then the as-built survey
can be done.
7 Oak Ridge Road, DEP 270-5.09, RGB 2007-19
Mr. Hecht gave a site visit report. All work is complete and the site is stable. The clean-outs for
the infiltration chambers are not visible, but may be under the peastone at the play area.
Motion made by Ms. Stewart, seconded by Ms. Scanlon, to issue a Certificate of Compliance with
continuing Conditions. Vote was 5-0-0.

Ms. Fink reported on the staff meetings and site inspections made since the June 16, 2010 meeting.
The two items that the Commission requires for sign-off on occupancy have not yet been addressed.
Mr. Palmer also has lists from other boards and officials and is scheduling the work at this time.
Public Hearin, Notice of Intent, Patrick Bishop, ll Oak Ridge Road, RGB 2010-13
Mr. Bishop was not present.
The Commission reviewed the proposed plans. Mr. Hecht gave a site visit report. Ms. Fink
reviewed written comments. The Commission would like more information about the proposed
patio surface, and about planting in the bare area in the northeastern corner of the lot near the
stream.
Motion made by Ms. Stewart, seconded by Ms. Scanlon, to continue the hearing to July 14, 2010.
Vote was 5-0-0.
Public Hearing, Notice of Intent, Milad Saberi, 58 Mill Street, RGB 2010-14
Present: Mr. and Mrs. Saberi, applicants, Mr. and Mrs. Quirbach, abutters at #50 Mill Street
Mr. Saberi described the proposed work, including landscaping and shed relocation.
The Commission reviewed site visit reports and draft Findings and Conditions for the Order of
Conditions. They discussed the proposed shed location, the number of trees to be planted, the
proposed grading along the boundary with #50 Mill Street, and removal of a brush pile from the
wetlands. They revised some of the Findings and Conditions. They also noted that the Certificate
of Compliance for construction of the house was not recorded by the builder.
Jean Barrone and Andrea Quirbach, abutters, asked questions, which the Commission answered.
Motion made by Ms. Ohlson, seconded by Mr. Tucker, to issue the Order of Conditions with the
Findings and Conditions as amended this evening. Vote was 5-0-0.
Motion made by Ms. Stewart, seconded by Ms. Scanlon, to reissue the Certificate of Compliance
for the previous Order, for recording purposes. Vote was 5-0-0.
Motion made by Ms. Ohlson, seconded by Ms. Scanlon, to close the hearing. Vote was 5-0-0.
Public Meeting, Request for Determination of Applicability, Conrad and Andrea Quirbach,
50 Mill Street, RGB 2010-15
Present: Mr. and Mrs. Quirbach, applicants, Mr. and Mrs. Saberi, abutters at #58 Mill Street
Mrs. Quirbach described the proposed work, including landscaping, patio construction, grading, and
shed relocation.
The Commission reviewed site visit reports and draft Findings and Conditions for the
Determination. They discussed the proposed shed location, the number of trees to be planted, the
proposed grading along the boundary with #58 Mill Street, and the patio materials. They revised -
some of the Findings and Conditions.

Motion made by Ms. Ohlson, seconded by Ms. Stewart, to issue a negative Determination with the
Findings and Conditions as amended this evening. Vote was 5-0-0.
Old/New Business
Benjamin Lane, DEP 270-466, RGB 2005-49
Present: Mr. and Mrs. Marc Moll, owners of Lot 3
Mr. and Mrs. Moll reported that their fence is located within the Zone of Natural Vegetation, next
to two bounds that the Commission had ordered to be moved to the 25-foot setback line in a
previous meeting.
Ms. Fink noted that the site plan presented by the Molls for approval of the fence was the original
subdivision plan, showing a 48-foot wide house on the lot with the fence extending northward to
-end outside the ZNV. The actual house is 60 feet wide, and thus the fence has ended up in the
ZNV. The developer had also set the ZNV bounds too close to the wetlands, adding to the
confusion. The Commission discussed possible options to resolve the situation.
The Molls requested a waiver of the setback provision under Section 3.D of the Reading Wetlands
Protection Regulations, and proposed that the ZNV bounds be moved to the 25-foot setback line
immediately east and west of the fence.
Motion by Ms. Ohlson, seconded by Ms. Stewart, to grant the waiver for the fence as requested,
subject to relocation of the ZNV bounds as proposed. Vote was 5-0-0.

Ms. Fink reported that the boulders had been moved out of the Track Road right-of-way. The
specifications for the water quality treatment unit and the final as-built.plan have not yet been
submitted.
1364 Main Street, DEP 270-387, RGB 2003-4
Mr. Hecht gave a site visit report. The basins have been graded and topsoil has been applied.
Planting should be completed soon.
Environmental Notification Form, Mass. Water Resources Authority
The Commission reviewed a draft letter to MEPA commenting on the proposed construction of
water mains to create a redundant loop for MVIRA water service.
Motion made by Ms. Stewart, seconded by Mr. Tucker, to send the letter as drafted. Vote was 5-0-
0.
306 Haverhill Street, St. Athanasius Church
The Commission reviewed the Enforcement Order sent after the June 16, 2010 meeting.
Motion made by Ms. Stewart, seconded by Ms. Ohlson, to ratify the Enforcement Order. Vote was
5-0-0.
Sunset Rock Lane, DEP 270-295, RGB 1997-6
Mr. Hecht gave a site visit report. Street trees have been planted and there is no further work
needed for the subdivision. Ms. Fink stated that Partial Certificates of Compliance have been
issued for all of the lots except Lot 4, which remains under enforcement to correct violations.

Motion made by Ms. Stewart, seconded by Ms. Scanlon, to release in full the $5,000 security being
held for completion of the subdivision to Presidential Development Corporation, Inc. Vote was 5-
0-0.
Bare Meadow - Recreational Trails Grant
The Commission reviewed the status of the project.
Motion made by Ms. Scanlon, seconded by Ms. Stewart, to request reimbursement from DCR in the
amount of the grant.
338 Ash Street, Violation Notice
Ms. Fink gave a site visit report. The owner has been mowing the wetlands replication area, and
has agreed to cease mowing and allow it to return to a natural condition.
334 Ash Street, Minor Project Permit for fence
Ms. Fink gave a site visit report. The owners have installed the fences as permitted. However, they
have also installed an above-ground pool without obtaining a Building Permit or Minor Project
Permit. A letter will be sent to request that they obtain the necessary permits

Motion made by Mr. Tucker, seconded by Ms. Scanlon, to approve the minutes of May 12, 2010 as
drafted. Vote was 5-0-0.
Motion made by Ms. Scanlon, seconded by Mr. Tucker, to approve the minutes of May 19, 2010 as
drafted. Vote was 5-0-0.
Motion made by Ms. Ohlson, seconded by Ms. Stewart, to approve the minutes of June 2, 2010 as
drafted. Vote was 5-0-0.
Motion made by Ms. Stewart, seconded by Ms. Ohlson, to approve the minutes of June 16, 2010 as

Kylie Drive, DEP 270-462, RGB 2005-41
Ms. Fink gave a site visit report for Lot 6. The site is stable and work is complete.
Motion made by Ms. Scanlon, seconded by Mr. Tucker, to issue a Partial Certificate of Compliance
for all work on Lot 6 of the subdivision, with continuing conditions. Vote was 5-0-0.
16 Track Road
Ms. Fink gave a site visit report. The site is stable and work.is complete.
Motion made by Ms. Stewart, seconded by Ms. Scanlon, to issue a Certificate of Compliance for
the project, with continuing conditions. Vote was 5-0-0.
Motion made by Mr. Tucker, seconded by Ms. Scanlon, to release in full the $5000 bond for the
work. Vote was 5-0-0.
