HomeMy WebLinkAbout1994-11-02 Bylaw Committee Minutes• BYLAW COMMITTEE MEETING MINUTES #225 November 2, 1994 7:40PM Meeting called to order in Merger Room in Town Hall. Members present: Phil Pacino, George Theophanis and End Murphy. Others present: Peter Hechenbleikner, Town Manager; Deirdre Hanley, Library Director., and George Hines:}, Selectman. Article 20. Ms. Hanley and Peter appeared before the committee in order to have the committee review its decision not to recommend this article (5°-0 vote). They argued: -this is a fairly common situation with teachers in many towns: interested in t.l-ie library board. --other towns permit such conflicts to go on without seeking resolution. -the. _state ethics laws are currently being reviewed. --teachers involved in the present cast would volunteer to resign from the board if absolutly required. Ed Mur..t3hy moved to reconsider (3--0 for reconsideration). Ed Murphy moved to recommend Article 29 as proposed. George Th•reophani s moved to Table until next meeting when at least one more member would be present. (Tabled 3-0) Articles IS 20g Although the commi.tte had -voted to recommend these Articles (each dy 5-0), additional questions were asked of Pater and George Hines. The Board of Selectmen have voted against the Articles. Also, there has been much public opposition. Article 7: George Theophani_s recommended that only one public place be made available in each precinct and all voters be notified of its location. Peter- agreed. George Hines left the meeting at this time and Peter left shortly thereafter. Johathan Edwards, Town Planner, joined the meeting at about: 8:30PM. Arti cl es 13, 14 and 15: George Theophanis moved to recommend, seconded by Ed. Recommend 3-0. Article 16: Reviewed this article with Jonathan but the original decision to Recommend (-Will stay. Ar=ticle' 26: \ Ed Murphy moved to recommend, seconded by George. (Recommend by vote of 3-0. Article 10 Although the committee had voted to recommend (5•••0), the proposal was again reviewed with Jonathan. The actual affect of the article became unclear especially the overall concern as to the legal interpretation of Section 7 and the probability of evolving changes through future court decisions. George moved to reconsider, seconded by Ed. George moved to Table, seconded by Ed f unt i l next: meeting when more members should be present). Tabled -0. Article 22: If article 18 +ails,, then this article would be appropriate as an enabling tact. If article 18 passes, Article 18 probably tabled.
