HomeMy WebLinkAbout1995-10-25 Bylaw Committee MinutesBYLAW COMMITTEE MINUTES #234 October 25. 1995 7:40 p.m. Meeting called to order in the Employees' Lounge in Town Hall. Members present: George Theophanis, Ed Murphy, Phil Pacino, Jack Russell and Dolores Carroll. Guests present: CPDC members Nancy Shipes and Brian Erwin, Town Planner Jonathan Edwards and Attorney Brad Latham. Brad Latham spoke on behalf of the business community expressing their concerns with repercussions if Article 17 passes. They feel the restrictions are unreasonable and inconsistent with state and federal regulations. George questioned the necessity of the bylaw and was informed that safety and improper maintenance is a concern with private structures. Commercially, it is less restrictive, dealing primarily with zoning issues and controlling tower height. The Committee felt the article should be more definitive and presented as separate articles. Article 17: Action pending. Article 15 clarifies the language of the sign bylaw by inserting the word "generic" when - referring to goods or services. An amendment was made to insert the word "any" after or and before other. On motion of Jack Russell, seconded by Dolores Carroll, the Committee voted to recommend Article 15, as amended, by a vote of 5-0. Article 16 allows both tenant and property owner to be held responsible for zoning violations. Previously only the tenant was liable. On motion of George Theophanis, seconded by Dolores Carroll, the Committee recommended Article 16 by a vote of 5-0. Article 18 is an alternative, streamlined review process for Planned Unit Developments in the industrial area. On motion of Ed Murphy, seconded by George Theophanis, the Committee recommended Article 18 by a vote of 5-0. Article 20 allows a developer to choose between a Planned Residential Development and the customary subdivision. On motion of Jack Russell, seconded by Dolores Carroll, the Committee voted to recommend this article by a vote of 5-0. Discussion then focused on the closing date of the warrant. CPDC prefers moving it back at least a week as the critical time is between the warrant closing and Town Meeting. Other committees agree; therefore, Phil will ask the Town Manager to have it presented as an instructional motion at the Subsequent Town Meeting. Annual Town Meeting is not affected by this proposed date change.
