Members present: Ed Murphy, George Theophanis, Jack Russell and Dolores Carroll. Guests present: CPDC Chairman Mike Flammia and Town Planner Jonathan Edwards to review proposed amendments to the Zoning Bylaws. Minutes #244 were read and accepted by a vote of 3-0, with one abstention. Jonathan informed the Committee that Articles 14, 15, 16 and 17 were recommended to Town Meeting by CPDC, at a public hearing on October 8, 1997, by a vote of 4-0. Article 14 amends the Zoning Bylaws to ensure that contaminated fill is not deposited in Reading. George suggested placing it under Section 5.4 (Excavations & Wells) of the General Bylaws, which prompted discussion, but no change. Recommendations were made to eliminate the title of the amendment as it falls within "Principal Uses", to insert "detrimental" before "solid" in section a, line six and in section b, line 2, add a "comma" after "dust", parenthesis around numbers 1-6 and replace "semicolons" with "periods" in numbers 1-5. Add the word "excessive" at the end of the first line of number three. On motion of Jack Russell, seconded by Dolores Carroll, it was voted to recommend Article 14, with changes indicated, by a vote of 4-0. Article 15 amends the Zoning Bylaws to regulate the safety and location of swimming pools, which must contain a sturdy, secured fence erected along the perimeter of the pool area. Recommendations were made to delete the "dash" in line one, insert a "comma" after "pool" and include the words "under State Building Code" after "permit". Replace "rearmost" with "frontmost" in line two of a. In paragraph c delete "fence or". In paragraph d, line one, delete the "dash", add the words "at least" after "of" in line two, delete the words "and any appurtenant deck or patio" in line three and replace the words "at the top" at the end of the paragraph with "a height of at least 54 inches above grade". On motion of George Theophanis, seconded by Jack Russell, it was voted to recommend Article 15, with the recommended changes, by a vote of 4-0. Article 16 amends Section 5.2.1 of the Zoning Bylaws to regulate the allowed shapes of building lots and prevent flag pole lots.
