HomeMy WebLinkAbout1999-03-16 Bylaw Committee MinutesBYLAW COMMITTEE MINUTES #254 - March 16, 1999 7:45 p.m. Meeting called to order in the Berger Room, Town Hall. Members present: George Theophanis, Jack Russell, Phil Pacino and Dolores Carroll. Guests present: Town Clerk Cheryl Johnson and a petitioner of Article 19, Marty Schmidt. Article 18: The meeting began with the Committee reviewing Article 18 with the Town Clerk. This article was proposed to move the start date of the Annual Town Meeting up two weeks to avoid conflicting with school vacations, religious holidays, as well as allowing the Finance Committee additional time to work on the budget. Since the Town Clerk is comfortable with the present schedule and the proponent of the article is unknown, Jack Russell moved to support the subject matter of Article 18, seconded by Dolores Carroll and voted 2-2 by the Committee. Article 19: Marty Schmidt, representing the petitioners of Article 19, came before the Committee to review the proposed Zoning Bylaw change under which agricultural uses less than 5 acres would be permitted, but would require a special permit. Under the current bylaw there is no protection for abutters if a property owner decides to expand for agricultural use (Eric's Greenhouse). Although the article does not affect current abutters, it will prevent the same situation from occurring in the future. George suggested restructuring as some provisions are redundant, and deleting section "d". The Committee is awaiting input from Z.B.A. and C.P.D.C. prior to making a recommendation. On motion of Jack Russell, seconded by Dolores Carroll, it was voted to retain Philip Pacino as Chairman and Dolores Carroll as Clerk, by a vote of 4-0. On motion of George Theophanis, seconded by Phil Pacino, Minutes #253 were read and accepted by a vote of 3-0-1.
