7:30 p.m. Meeting called to order by Chairman Phil Pacino in the Conference Room of
Town Hall.
Guests present: Town Manager Peter Heckenbleickner, Moderator Alan Foulds,
representing the Rules Committee, Chairman Cris Riley and Dick Howard representing
CPCS and John Crosby representing the Downtown Steering Committee.
Members present: Phil Pacino, George Theophanis and Dolores Carroll.
Article 17: Alan Foulds explained that the Rule 9 Bylaw amendment replaces "Robert's
Rules of Order" with "Town Meeting Time", substituting a generic, confusing and often
difficult book to locate and understand, with an easier read for Town Meeting Members.
The Committee agreed with George's suggestion to delete the word only in the last line of
Rule 19 so that it reads, "..except that to lay on the table shall require a majority vote."
On motion of George Theophanis, seconded by Dolores Carroll, the Bylaw Committee
voted to recommend the subject matter of Article 17, as amended, by a vote of 3-0-0.
Article 19: Peter reviewed the Aquifer Protection District amendment to the Zoning
Bylaws which forbids underground storage of toxic and hazardous materials, with the
exception of propane tanks. George suggested replacing "allowed" with installed, so that
the addition to 4.8.6.2.4.14. reads: ":.......normal household use installed and used....."
On motion of Dolores Carroll, seconded by George Theophanis, the Bylaw Committee
voted to recommend Article 19, as amended, by a vote of 3-0-0.
Article 20: Dick Howard. explained that the addition of the "Mixed Use Overlay District"
to the Zoning Bylaws mixes commercial, residential and open space. This combination
offers residents the convenience of waking to public transportation and local businesses.
A percentage of low-income units are included in this district.
George Theophanis moved to recommend Article 20, as presented in the motion to be
reviewed, which was seconded by Dolores Carroll, and recommended by the Bylaw
Committee by a vote of 3-0-0.
Article 21: This amendment to the Zoning Map of the Town of Reading allows certain
named properties to be placed into the Business B Zoning District.
On motion of Dolores Carroll, seconded by George Theophanis, the Bylaw Committee
voted to recommend Article 21 by a vote of 3-0-0.
Article 22: Action pending as the petitioner was unavailable.
Article 7: Peter explained that acceptance of provisions under G. L. c. 44, § 53F1/2,
establishes the Storm Water Utility as an Enterprise Fund, increasing the water bill of a
single family home to $60.00 per year; more for a multi family. He emphasized the fact
that this would be a fee and not a tax.
On motion of George Theophanis, seconded by Dolores Carroll, the Bylaw Committee
voted not to recommend the subject matter of this article by a vote of 3-0-0.
Article 16: This amendment to Article 2.2.1 of the Town of Reading Bylaws would, under
Rule 4, expand the reviewing process of the Bylaw Committee, and under Rule 8
Non-Town Meeting Member would replace "inhabitant", identifying those permitted to
address Town Meeting.
George recommended using the lower case and removing the hyphen in "Non-Town" so
that it becomes, "nontown....".
On motion of Dolores Carroll, seconded by George Theophanis, the Bylaw Committee
voted to recommend Article 16, as amended, by a vote of 3-0-0.
Article 18: Peter proposed amending Section 2.1.6. of the General Bylaws by substituting
"providing" for "mailing" Town Meeting Warrants with George adding the following
after the word "providing": "in such a manner as electronic mailing or pickup of
On motion of George Theophanis, seconded by Dolores Carroll, the Bylaw Committee
voted to recommend Article 18, as amended, by a vote of 3-0-0.
Minutes #273 read and on motion of Dolores Carroll, seconded by George Theophanis,
accepted by a vote of 3-0-0.
Meeting adjourned at 9:15 p.m.
