If BYLAW COMMITTEE MINUTES #281 April 2, 2007 H011 OCT 19 A 3b Members present: Phil Pacino, George Theophanis, Jack Russell, Dolores Carroll and Ron O'Keefe, Jr.. Guests present: Town Manager Peter Heckenbleickner, Town Counsel Ellen Callahan Doucette and a petitioner of Article 25, Mary Ellen O'Neill. Article 25: Mary Ellen O'Neill explained that the article was placed on the warrant to prevent the downtown parking situation from worsening with the removal of the 300 foot parking exemption from the Zoning Bylaws. The petitioners feel that small businesses need protection and the additional stress on new businesses will only add to an existing bad situation. The Committee agree that it isn't ideally written and that further study is needed by both the Committee and CPDC in order to bring it back in November. On motion of Jack Russell, seconded by George Theophanis, the Bylaw Committee recommended that Article 25 be referred for further study by a vote of 5-0-0. Article 24: The Committee feels that not only is Section 2.2.13 of the Zoning Bylaws a public safety issue, but that additional language is needed. Recommendation was made to delete the words"presence or"in the last sentence of the amendment so that it reads as follows: "The existence of an access easement shall not satisfy the requirement for actual legal and physical access." On motion of Jack Russell, seconded by Ron O'Keefe, Jr., the Bylaw Committee voted to recommend the subject matter of Article 24, as changed, and to highlight the additional language in the presentation to Town Meeting by a vote of 5-0-0. Article 26: Recommendation of this article would delete Section 5.6.2.2.3 of the General Bylaws, dealing with kennel license applications and renumber subsequent sections. Although it references zoning approval, there is no provision in the Zoning Bylaws. On motion of Jack Russell, seconded by Ron O'Keefe, Jr., the Bylaw Committee voted to recommend the subject matter of Article 26 by a vote of 5-0-0. Article 8: Recommendation of this article would credit money earned in the Senior Tax Work Program directly to the resident's property tax bill, thereby eliminating the need for a Social Security deduction, since it would not be considered income. On motion of Jack Russell, seconded by George Theophanis, the Bylaw Committee voted to recommend the subject matter of Article 8 by a vole of 5-0-0. Article 12: Deleting Section 4.3.4 of the General Bylaws the Town would eliminate the expense of publishing the real estate valuation list every 10 years. Said list is now available on- line. On motion of George Theophanis, seconded by Ron O'Keefe, Jr., the Bylaw Committee voted to recommend the subject matter of Article 12 and renumber subsequent sections by a vote of 5-0-0. Article 15: No report. The subject matter of Article 15 is tabled. Article 16: Approval of this article would minimally increase the death benefit for surviving children of current or retired Town employees. On motion of George Theophanis, seconded by Ron O'Keefe, Jr. the Bylaw Committee voted to recommend the subject matter of Article 16 by a vote of 5-0-0.
