ZONING BOARD OF APPEALS
Minutes of April 20, 2006

A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the
Town Hall, 16 Lowell Street, Reading, Massachusetts at 7:00 P.M. Also in attendance was Glen
Redmond, Commissioner of Buildings.
Case # 06-07
A Public Hearing on the petition of JCM Realty Trust, Craig J. Celli Trustee, who seeks a
Special Permit under Section 6.3.17 of the Zoning By-laws in order to demolish an existing, non-
conforming single family dwelling on a non-conforming lot and to construct a new dwelling that
will conform to current setback requirements on the property located at 26 Harvest Road in
Reading, MA.
Craig Celli said he is attempting to buy the property located at 26 Harvest Road from the owner,
Kenneth Campbell, who was present at the meeting. The lot is nonconforming but the proposed
new dwelling will meet all current zoning setback requirements. It will be a moderate size
colonial home that will fit in well with the neighborhood. The new dwelling will face Track
Road instead of Harvest Road. The lot size is similar to other lots in the area.
The Board wanted to know where the existing driveway was and the Applicant said it is on
Harvest Road but the new driveway would be on Track Road. The Board reminded the. Applicant
he needed to get a curb cut permit from Engineering for the new curb cut.
John Jarema asked the Applicant if he had petitioned to change the address and the Applicant
said he had not done that. There was some concern that he would need to get additional
approvals because the current address and frontage is on Harvest Road but the Board concluded
that this issue was something that the Applicant should discuss with the Building Inspector and
Engineering.

Matthew Leahy, 40 Torre Street, said he wanted to make sure that the granite curb would still be
- maintained. Robert Redfern said the curb cut would be constructed according to Town standards.
On a motion by Michael Conway, seconded by John Jarema, the Zoning Board of Appeals
moved to grant the Applicant a Special Permit under Section 6.3.17 of the Zoning By-laws in
order to demolish an existing, non-conforming single family dwelling on a non-conforming lot
and to construct a new dwelling that will conform to current setback requirements on the
property located at 26 Harvest Road as shown on the submitted Certified Plot Plan with the
following conditions attached:
1. A Certified Plot Plan showing the proposed work is submitted to the Building
Inspector prior to the issuance of a Building Permit;
2. A Certified Plot Plan of the "as-constructed" foundation for the new addition be
submitted to the Building Inspector prior to proceeding with final construction and,
3. A Certified "as-built" plan of the new single family dwelling is submitted to the
Building Inspector prior to issuance of an Occupancy Permit.
The motion was approved by a vote of 3-0-0 (Redfern, Jarema, Conway).
Case # 06-08
A Public Hearing on the petition of Jeff and Hope Ann McGoldrick who seek a Special Permit
under Sections 6.3.11.1 & 6.3.17 of the Zoning By-laws in order to remove a portion of a non-
conforming structure and to construct an addition within the required setbacks. The lot is also a
non-conforming lot on the property located at 32 Pine Ridge Road in Reading, MA.
Nancy Twoomey spoke on behalf of the Applicants. On the lot there is a one-car attached garage
that does not have a foundation below. The Applicants want to add a second story over the
garage. They will remove the garage and construct a new one with a second floor. If there was a
proper foundation they could build the second story over the garage by right. They are also
building a new front porch but it meets all current zoning requirements and they do not need
relief from the Board for the porch. There is an attached breezeway that appears to have always
been part of the property and it was there when the Applicants bought the house.
Robert Redfern said he did not see any further encroachment and in fact thought there was a
minor improvement. The neighbor on the addition side, Nancy Lindgren, 26 Pine Ridge Road,
submitted a letter to the Board saying she approved of the addition.
On a motion by John Jarema, seconded by Michael Conway, the Zoning Board of Appeals
moved to grant the Applicants a Special Permit under Sections 6.3.11.1 and 6.3.17 of the Zoning
By-laws in order to remove an existing attached garage and breezeway and construct a new two

story addition on the dwelling at 32 Pine Ridge Road, Reading, as shown on the Certified Plot
Plan, with the following conditions attached:
1. A Certified Plot Plan showing the proposed work is submitted to the Building
Inspector prior to the issuance of a Building Permit;
2. A Certified Plot Plan of the "as-constructed" foundation for the new addition be
submitted to the Building Inspector prior to proceeding with final construction; and,
3. A Certified "as-built" plan of the new addition is submitted to the Building Inspector
prior to issuance of an Occupancy Permit.
The motion was approved by a vote of 3-0-0 (Redfern, Jarema, Conway).
Other Business:
Archstone-Reading Regulatory and Monitoring Agreements
The Board members first wanted to discuss some questions they had about the size of the trees
that had been planted at Archstone-Reading. The Town Planner was not present at this meeting
so he could not answer the Board's questions. The Archstone-Reading representatives said the
tree issue was not related to what they were before the Board for at this meeting.
Michael Conway said he thought at this time the Board did not have to take any action. John
Jarema said technically the Board must review and approve the Regulatory and Monitoring
Agreements and the Town Planner had told him that Town Counsel had already signed the
Agreements.
The Board agreed that the Town Planner would write an addendum to add these Agreements to
be signed by Town officials. John Jarema will send an email to the Town Planner requesting
what they would like him to prepare.
On a motion by John Jarema, seconded by Michael Conway, the Zoning Board of Appeals voted
to accept the Regulatory and Monitoring Agreements already reviewed and approved by Town
Counsel.
The motion was approved by a vote of 3-0-0 (Redfern, Jarema, Conway).
