A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the
Town Hall, 16 Lowell Street, Reading, Massachusetts, at 7:00 P.M.

A Public Hearing on the petition of Reading Cooperative Bank who seeks a Variance/Special
Permit/Finding as to the use of the structure prior to fire damage under Sections 4.2.2 / 6.3.16 /
6.3.10.2 / 6.3.11.2 (b) of the Zoning By-laws in order to reconstruct a multi-family structure
destroyed by fire on the property located at 16 Sanborn Street in Reading, MA.
Attorney Chris Latham represented the Applicants. On March 14, 2005 the residential structure
was substantially damaged by fire and on April 4, 2006 the owner had the damaged structure
demolished leaving only the foundation. Attorney Latham presented evidence that the structure
had been used as three-family dwelling prior to the fire. Town records classify the property as a
two-family dwelling but documents were submitted to the Board as evidence that the structure
had been used as three-family.
The Board thought the evidence was insufficient for them to determine that the property had
been used as a three-family and therefore they would agree with the Town records that indicated
this property was a two-family dwelling. Section 6.3.10.1 applies to this dwelling and it would
allow an existing non-conforming one or two family dwelling to be enlarged or extended for use
for the same purpose with a Special Permit from the Board.
On a motion by Paul Dustin, seconded by Michael Conway, the Zoning Board of Appeals moved
to grant the Applicant a Special Permit under Section 6.3.10.1 of the Zoning By-laws in order to
reconstruct a two-family, non-conforming dwelling on the existing foundation.

The motion was approved by a vote of 5-0-0 (Redfern, Jarema, Dustin, Conway, Petschekc).
On a motion by Paul Dustin, seconded by John Jarema, the Zoning Board of Appeals moved to
allow the Applicant to withdraw their request for a Special Permit under Sections 6.3.11.1,
6.3.11.2b, and a Variance under Section 4.2.2 without prejudice.
The motion was approved by a vote of 5-0-0 (Redfern, Jarema, Dustin, Conway, Petschek).
The Special Permit was conditioned upon the following:
1. The Petitioner shall submit to the Building Inspector a Certified Plot Plan of the
proposed construction and proposed foundation plans, prior to the issuance of a
foundation permit for the work.
2. The Petitioner's final construction plans for the new structure shall be submitted to
the Building Inspector, along with the as-built foundation plan(s), prior to the
issuance of a Building Permit.
As-built plans showing the completed construction shall be submitted to the Building
Inspector immediately after the work is completed and prior to the
issuance of an Occupancy Permit.
On a motion by Michael Conway, seconded by John Jarema, the Zoning Board of Appeals
moved to adjourn the meeting.
The motion was approved by a vote of 6-0-0 (Redfern, Jarema, Dustin, Conway, Tedesco,
Petschek).
