MASS. 2001 MAY 21 A 11= 30 Members present: John Jarema, Acting Chairman Michael Conway Peter Tedesco Susan Miller Members absent: Robert Redfern Clark Petschek Paul Dustin A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the Town Hall, 16 Lowell Street, Reading, Massachusetts, at 7:00 P.M. Also in attendance was Glen Redmond, Commissioner of Buildings. Case # 07-06 A Public Hearing on the petition of the YMCA of Greater Boston who seeks a Special Permit or Amended Special Permit (98-10 and/or 03-24) under Section(s) 4.22/7.3.3 of the Zoning By- laws in order to square off the rear corner of the existing structure on the property located at 36 Arthur B. Lord Drive in Reading, MA. Attorney Chris Latham said this is the second time before the Board to seek this Special Permit (the other Special Permit issued in 2004 has lapsed). The YMCA did not have the financial means to pursue the work requested then but at this time they do have the funds for the addition. It is at the rear of the structure and it will square off the corner that will allow space for the office to be moved to this area freeing up other space for additional uses. There will be no interruption of services at the YMCA during the building of this addition. Mr. Jarema asked if this request was the same as before and Attorney Latham said it is exactly the same and is the same plan approved by the CPDC. Mr. Jarema said the last time this application was before the Board it required a few hearings in order to review all the materials before a decision was reached. Attorney Latham provided the site plan review from CPDC and said it is still valid at this time. The Fire Department has also signed off on this plan. On a motion by Susan Miller, seconded by Michael Conway, the Zoning Board of Appeals moved to grant the Applicants an amendment to the Special Permit issued to the Applicant on ZBA Minutes, April 19, 2007 July 16, 1998 in Case # 98-10, to construct a two-story 2,280 square foot addition to the rear of the existing structure as shown on plans entitled "Site Plan - YMCA Birch Meadow Drive", - dated November 24, 2003 subject to the following conditions: 1. The Petitioner shall submit to the Building Inspector a Certified Plot Plan of the proposed construction and proposed foundation plans, prior to the issuance of a foundation permit for the work. 2. The Petitioner's final construction plans for the new structure shall be submitted to the Building Inspector, along with the as-built foundation plan(s), prior to the issuance of a Building Permit. As-built plans showing the completed construction shall be submitted to the Building Inspector immediately after the work is completed and prior to the issuance of an Occupancy Permit. The motion was approved by a vote of 4-0-0 (Jarema, Miller, Conway, Tedesco). Case # 07-07 A Public Hearing on the petition of Echo Avenue Realty Trust who seeks a Special Permit under Section(s) 6.3.17/6.3 of the Zoning By-laws in order to construct a new single family dwelling on an existing non-conforming lot on the property located at 26 Canterbury Drive in Reading, MA. Leslie McGonagle said she purchased this property in 2005 but it took over five months to remove the tenants. Ms. McGonagle had to demolish the property as soon as possible due to severe rat infestation. She received a Building Permit to demolish the dwelling. The lot is non- conforming due to lot size. Ms. McGonagle would now like to build a two-story single family home that will meet all zoning setbacks and requirements. The Building Inspector said Ms. McGonagle observed all the requirements and all applicable Town departments had signed off on the demolition permit application. Joe Degirolamo, 20 Canterbury Drive, said he had no problem regarding the proposed one story dwelling. He was just concerned the new structure might be a multiple family dwelling but he was assured it was going to be a one-family dwelling. On a motion by Michael Conway, seconded by Peter Tedesco, the Zoning Board of Appeals moved to grant the Applicant a Special Permit under Section 6.3.17 of the Zoning By-laws in order to construct a new single family dwelling on an existing non-conforming lot on the property subject to the following conditions: 2 ZBA Minutes, April 19, 2007 1. Minutes On a motion by Michael Conway, seconded by Peter Tedesco, the Zoning Board of Appeals moved to approve the minutes of February 15, 2007. The motion was approved by a vote of 3-0-1 (Jarema, Conway, Tedesco; Miller abstaining). On a motion by Peter Tedesco, seconded by Susan Miller, the Zoning Board of Appeals moved to approve the minutes of March 15, 2007. The motion was approved by a vote of 3-0-1 (Jarema, Miller, Tedesco; Conway abstaining) On a motion by Michael Conway, seconded by Susan Miller, the Zoning Board of Appeals moved to adjourn the meeting.
