I. e A Town of Reading ZONING BOARD OF APPEALS Minutes of June 21, 2007 Members present: Members absent: Robert Redfern, Chairman Susan Miller John Jarema Michael Conway Paul Dustin Clark Petschek Peter Tedesco a -r, A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the Town Hall, 16 Lowell Street, Reading, Massachusetts, at 7:00 P.M. Also in attendance was Glen Redmond, Commissioner of Buildings. Case # 07-09 Continuation of a Public Hearing on the petition of Thomas & Donna Fay who seek a Special Permit under Section(s) 4.3.2.10.2 of the Zoning By-laws in order to continue the use of a detached carriage house in the rear of the lot that has been used in the past as a dwelling unit on the property located at 32 Grove Street in Reading, MA. The Applicant satisfies the requirements of the bylaw and wants to formalize the status of the carriage house. The Chairman read a letter submitted by the Applicant's attorney, Chris Coleman, requesting that the case be withdrawn without prejudice at the Applicant's request. On a motion by John Jarema, seconded by Peter Tedesco, the Zoning Board of Appeals moved to accept the withdrawal of the application without prejudice. The motion was approved by a vote of 5-0-0 (Redfern, Jarema, Dustin, Conway, Tedesco). Case # 07-10 A Public Hearing on the petition of David P. Johnson who seeks a Special Permit under Section(s) 6.3.17/6.3.12 of the Zoning By-laws in order to demolish an existing single family dwelling and to construct a new single family dwelling on a non-conforming lot on the property located at 36 Howard Street in Reading, MA. 1 ZBA Minutes, June 21, 2007 David Johnson distributed a copy of the ZBA Application that had been signed by the owner. He has a Purchase & Sale Agreement but wanted to make sure that the owner signed the application as required. He also submitted an amended request to add a sunroom on the back of the house that was requested by a potential buyer of the new house. He outlined what he was proposing for the new house and how it would maintain the current farthest setback of 11'6" and that it would be an improvement over the present structure's setbacks. The sunroom addition would not exceed the 25% lot coverage. The present structure is not occupied. The Chairman said in his opinion the present structure is in deplorable condition and the proposed dwelling would be a great improvement over what is there. The original house was built in 1900 and the lot is grandfathered. The setbacks for the proposed dwelling are less non-conforming than the original setbacks. The architectural plans would be an improvement and would fit in nicely with the neighborhood. Mr. Jarema asked about the setbacks on the garage and the Building Inspector said if the garage is entirely behind the house it could be built 5' from both lot lines. At the request of the Building Inspector, the Applicant added the dimensions and location of the newly proposed sunroom to the plan filed with the application and indicated that the sunroom was a one-story addition. On a motion by Paul Dustin, seconded by John Jarema, the Zoning Board of Appeals moved to grant to David Johnson, the proposed owner, and Theodore Eyrick, Eyrick Investment Trust, the present owner of the property, a Special Permit under Section 6.3.17 of the Zoning By-laws in order to remove the current dwelling and to replace it with a new structure as shown on the submitted plot plan. The Special Permit is conditioned upon the following: 1. The Petitioner shall submit to the Building Inspector a Certified Plot Plan of the proposed construction and proposed foundation plans, prior to the issuance of a foundation permit for the work. 2. The Petitioner's final construction plans for the new structure shall be submitted to the Building Inspector, along with the as-built foundation plan(s), prior to the issuance of a Building Permit. 3. As-built plans showing the completed construction shall be submitted to the Building Inspector immediately after the work is completed and prior to the issuance of an Occupancy Permit. The motion was approved by a vote of 5-0-0 (Redfern, Miller, Jarema, Dustin, Conway). 2 ZBA Minutes, June 21, 2007 Other Business Mr. Jarema asked the Building Inspector if he would please submit a written report of his opinion for each case before the Board if he was not going to be able to attend a meeting. The Building Inspector said he could do this. Minutes On a motion by John Jarema, seconded by Paul Dustin, the minutes of April 5, 2007 were approved. The motion was approved by a vote of 6-0-1 (Redfern, Miller, Jarema, Dustin, Conway,. Petschek). On a motion by Susan Miller, seconded by Michael Conway, the minutes of April 5, 2007 were approved with changes. The motion was approved by a vote of 6-0-1 (Redfern, Miller, Dustin, Conway, Petschek, Tedesco). On a motion by John Jarema, seconded by Paul Dustin, the Zoning Board of Appeals moved to adjourn the meeting.
