Also in attendance was Glen Redmond, Commissioner of Buildings. Case # 08-10 A continuation of a Public Hearing on the petition of Robert Scarano, Trustee of MK Realty Trust who seeks a Variance under Section(s) 5.1.2 of the Zoning By-laws in order to construct a single family dwelling on a lot without the required 120' frontage on the property located at End of Fairchild Drive in Reading, MA. The property is located in an 5-20 District. On a motion by John Jarema, seconded by Paul Dustin, the Zoning Board of Appeals moved to grant the Applicant's request that his application be withdrawn without prejudice. The motion was approved by a vote of 5-0-0 (Dustin, Jarema, Redfern, Miller, Petschek). Case # 08-07 A continuation of a Public Hearing on the petition of Richard R. Merrill, Trustee, who seeks a Variance under Section(s) 4.8.3/4.8.6.1.9/4.8.6.1.10 of the Zoning By-laws in order to allow an extension of prior variance and an approximate two percent (2%) increase in impervious surface from the previous variance granted (Case # 05-15) on the property located at 175 Franklin Street in Reading, MA. On a motion by Paul Dustin, seconded by John Jarema, the Zoning Board of Appeals moved to continue the hearing to July 10, 2008 at the request of the Applicant. The motion was approved by a vote of 5-0-0 (Miller, Dustin, Jarema, Redfern, Petschek). ZBA Meeting, May 15, 2008 Case # 08-13 A Public Hearing on the petition of William Thomson who seeks a Special Permit under Section(s) 6.3. 10 & 6.3.10.2a of the Zoning By-laws in order to expand or alter an existing non- conforming use (commercial parking lot) on the property located at 36 Woburn Street in Reading, MA. This parking lot is located in a residential district (5-15). Sections 6.3. 10 and 6.3.10.2 (a) allow the alteration, expansion or extension of an existing non- conforming use for use for the same purpose with a Special permit from the Board, provided that the Board determines that the alteration, expansion or extension is not substantially more detrimental than the current use. The Applicant's presentation of the changes to the property, along with the Petitioner's plans submitted, demonstrated to the Board that the Applicant's paving of 1,219 square feet was not substantially more detrimental than the property's current use. On a motion by Peter Tedesco, seconded by John Jarema, the Zoning Board of Appeals moved to grant the Applicant a Special Permit under Sections 6.3. 10 and 6.3.10.2 (a) of the Zoning By- laws in order to expand the paved parking area at 36 Woburn Street by 1,219 square feet as depicted on the plans. This Special Permit is conditioned upon the following: 1. The Town of Reading Community Planning and Development Commission (CPDC) grants Site Plan approval of the Existing Conditions Plan referenced above; 2. The total number of parking spaces on the property does not exceed 30, and 3. The total newly paved area, as depicted in the plans, does not exceed 1,219 square feet. The motion was approved by a vote of 5-0-0 (Tedesco, Jarema, Redfern, Miller, Petschek). Case # 08-14 A Public Hearing on the petition of Virginia M. Pierce who seeks a Variance under Section(s) 5.1.2. (rear yard setback) of the Zoning By-laws in order to construct a 10' x 12' one-story sun porch to the rear yard of the existing dwelling on the property located at 10 Coolidge Road in Reading, MA. The proposed sun porch is located 13' from the rear yard property line. The required rear yard setback is 20'. On a motion by John Jarema, seconded by Paul Dustin, the Zoning Board of Appeals moved to grant the Applicant's request that her petition be withdrawn without prejudice. The motion was approved by a vote of 5-0-0 (Dustin, Jarema, Redfern, Miller, Petschek). 2 ZBA Meeting, May 15, 2008 On a motion by Clark Petschek, seconded by John Jarema, the Zoning Board of Appeals moved to adjourn the meeting.
