A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the
Town Hall, 16 Lowell Street, Reading, Massachusetts, at 7:00 P.M. Also in attendance was Glen
Redmond, Commissioner of Buildings.
Case # 08-09
A continuation of a Public Hearing on the petition of Barlow Signs for George Danis who seeks
a Variance under Section(s) 6.2.3.2.4 (Table 6.2.3) of the Zoning By-laws in order to construct a
free-standing sign of 219.25 square feet rather than the allowable sign of 75 square feet on the
property located at 1 General Way in Reading, MA. The property is located in an Industrial
District.
The Applicant submitted a request to continue the hearing to June 26, 2008 so that a full Board
could be present.
On a motion by Paul Dustin, seconded by Susan Miller, the Zoning Board of Appeals moved to
continue the hearing to June 26, 2008.
The motion was approved by a vote of 4-0-0 (Redfern, Miller, Dustin, Tedesco).
Case # 08-02
A continuation of a Public Hearing on the petition of Sandra M. Carter who seeks a Special
Permit under Section(s) 6.3.17 of the Zoning By-laws in order to demolish an existing single
family dwelling and to construct a new single family dwelling on a non-conforming lot on the
property located at 361 Franklin Street in Reading, MA.
The Applicant's agent, James Andella, submitted a request to continue the hearing to June 26,
2008 so that a full Board could be present.

On a motion by Susan Miller, seconded by Peter Tedesco, the Zoning Board of Appeals moved
- to continue the hearing to June 26, 2008.
The motion was approved by a vote of 4-0-0 (Redfern, Miller, Dustin, Tedesco).
Case # 08-15
A Public Hearing on the petition of Holly Papantonakis who seeks a Special Permit under
Section 6.3.11 of the Zoning By-laws in order to construct an open deck of 7' x 22' and 8' x 30'
as per plans on the property located at 19 Brook Street in Reading, MA. The proposed side yard
setback of 6.8' does encroach into the 15' required setback.
The Applicant, Holly Papantonakis, said she wanted to put a deck on the back of her house so
she can see her daughter while she is playing in the back yard.
The Building Inspector said the house is a non-conforming structure on the right side and the
non-conformity would only be increased by a few inches. There will not be any further
encroachment in the back rear setback.
The Chairman wanted to know if the shed shown on the certified plot plan encroaches into the
adjoining lot and the Applicant said it did. But she said she had not heard anything from the
owners of this abutting property about the shed. She said the shed was on the property when she
purchased the house.
The Chairman said the Applicant was not creating any new non-conformity and he thought the
deck fit well in the area and would not be seen from the street.
On a motion by Paul Dustin, seconded by Peter Tedesco, the Zoning Board of Appeals moved to
grant the Applicant a Special Permit under Section 6.3.11 of the Zoning By-laws in order to
construct an open deck as shown on the referenced plot plan.
The Special Permit is conditioned upon the following conditions:
1. The Petitioner shall submit to the Building Inspector a Certified Plot Plan of the
proposed construction and proposed foundation plans, prior to the issuance of a
foundation permit for the work.
2. The Petitioner's final construction plans for the new structure shall be submitted
to the Building Inspector, along with the as-built foundation plan(s), prior to the
issuance of a Building Permit.
3. As-built plans showing the completed construction shall be submitted to the
Building Inspector immediately after the work is completed and prior to the
`issuance of an Occupancy Permit.

4. The 6.8' minimum setback of the proposed open deck, as shown on the referenced
plot plan, shall not be reduced.
The motion was approved by a vote of 4-0-0 (Redfern, Miller, Dustin, Tedesco).

On a motion by Susan Miller, seconded by Paul Dustin, the Zoning Board of Appeals moved to
approve the minutes of May 22, 2008.
The motion was approved by a vote of 4-0-0 (Redfern, Miller, Dustin, Tedesco).
Other Business
The Chairman thought the Board should wait until the next meeting when there is a full Board to
vote on the release of the Archstone Bond. He also thought that John Jarema should be present
for the vote as he was the contact between the Board and Archstone during the project. The
Board agreed and this business will be continued to June 26, 2008.
On a motion by Paul Dustin, seconded by Peter Tedesco, the Zoning Board of Appeals moved to
adjourn the meeting.
The motion was approved by a vote of 4-0-0 (Redfern, Miller, Dustin, Tedesco).
