A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the
Town Hall, 16 Lowell Street, Reading, Massachusetts, at 7:00 P.M.
Case # 08-20
Continuation of a Public Hearing on the petition of Randall Kneeland & Susan Kneeland who
seek a Variance/Special Permit under Section(s) 5.1.2 & 6.3.11.1 of the Zoning By-laws in order
to construct an addition to the right hand side of an existing non-conforming dwelling on the
property located at 68 Longwood Road in Reading, MA. The proposed addition encroaches in
the front yard setback of 20'.
The Vice Chairman read a letter that was submitted by the Applicants requesting that the hearing
be continued to October 16, 2008.
On a motion by Mr. Redfern, seconded by Mr. Perkins, the Zoning Board of Appeals moved to
continue the hearing to October 16, 2008.
The motion was approved by a vote of 4-0-0 (Petschek, Miles, Redfern, Perkins).
Case # 08-21
A Public Hearing on the petition of Andrew & Kim Murphy who seek a Special Permit under
Section(s) 6.3.17of the Zoning By-laws in order to demolish an existing single family dwelling
and shed on a non-conforming lot and seek permission to construct a new conforming single
family dwelling with an attached two car garage on the property located at 53 Dividence Road
in Reading, MA. This property is located in an S-20 Zoning District and Aquifer Protection
Overlay District.

Attorney Nancy Scott represented the Applicants. The executor of the estate, Mr. Curley, also
attended. The property is in the Aquifer Protection Overlay District. Attorney Scott presented
information from 1937 showing the Newman family lived in this property at that time and she
thinks this indicates that the house is a legal non-conforming dwelling. The Applicants want to
tear down the existing dwelling and build a single family dwelling with five bedrooms. The
impervious, coverage of the lot with the proposed structure will be 19.9%. The plan for the
proposed recharge system was sent to the Town Engineer but he had not yet responded. The
proposed structure will be conforming with respect to required setbacks.
The Board was surprised that the Town Engineer had not responded to the Applicants about their
proposed recharge system. Mr. Redfern said usually the Board wants the approval before the
Board makes a decision but in this case the Applicant had submitted the required information to
the Town Engineer well in advance and it was unusual that he had not responded.
Elliot Pope of 47 Emerson Street said the plan looked nice and he approved. David Lindberg of
Dividence Road submitted a letter stating his approval.
On a motion by Robert Redfern, seconded by John Miles, the Zoning Board of Appeals moved to
grant the Applicants a Special Permit under Section 6.3.17 of the Zoning By-laws to demolish an
existing non-conforming, single family dwelling and shed and construct a single family, two
story structure on the non-conforming lot located at 53 Dividence. Road in Reading, MA as
depicted on the Plot Plan and the Architectural Plans submitted (Sheets Al through A12),
prepared for Andrew & Kim Murphy by Robert M. Connell, 22 North Street, Wilmington, MA
dated August 4; 2008.
This Special Permit is subject to the following conditions:
1. The Petitioner shall obtain approval from the Town Engineer for the proposed on-
site leaching system, sized for impervious coverage equal to 5% of the lot area, as
designed by David M. George, P.E., 4 Alice Drive, Wayland, MA 01752.
2. The Petitioner shall submit to the Building Inspector a Certified Plot Plan of the
proposed construction and proposed foundation plans, prior to the issuance of a
foundation permit for the work.
3. The Petitioner's final construction plans for the new structure shall be submitted
to the Building Inspector, along with the as-built foundation plan(s), prior to the
issuance of a Building Permit.
4. As-built plans showing the completed construction shall be submitted to the
Building Inspector immediately after the work is completed and prior to the
issuance of an Occupancy Permit.
The motion was approved by a vote of 4-0-0 (Petschek, Miles, Redfern, Perkins).

On a motion by Jeffrey Perkins, seconded by Robert Redfern, the Zoning Board of Appeals
moved to adjourn the meeting.
