ZONING BOARD OF APPEALS

A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the
Town Hall, 16 Lowell Street, Reading, Massachusetts, at 7:00 P.M. Also in attendance was Glen
Redmond, Commissioner of Buildings.

A Public Hearing on the petition of Nuala Crehan who seeks a Special Permit under Section
6.3.114 of the Zoning By-laws in order to add an addition to a non-conforming structure that is
located on a non-conforming lot on the property located at 163 Green Street in Reading, MA.
Nuala Crehan presented her proposal to the Board for an addition to her non-conforming
structure. The Board questioned the height in one area because it was not shown on the drawing.
The Chairman thought the proposal was an improvement to the neighborhood and does not seem
out of place. The Building Inspector said the addition just continues the existing setbacks.
On a motion by Jeffrey Perkins, seconded by John Jarema, the Zoning Board of Appeals moved
to grant the Applicant a Special Permit under Section 6.3.11.1 of the Zoning By-laws in order to
add an addition to a non-conforming structure as laid out on the referenced plot plan.
This Special Permit is conditioned upon the following:
1. The Petitioner shall submit to the Building Inspector a Certified Plot Plan of the
proposed construction and proposed foundation plans, prior to the issuance of a
foundation permit for the work.
2. The Petitioner's final construction plans for the new structure shall be submitted
to the Building Inspector, along with the as-built foundation plan(s), prior to the
issuance of a Building Permit.

3. As-built plans showing the completed construction shall be submitted to the
Building Inspector immediately after the work is completed and prior to the
issuance of an Occupancy Permit.
The motion was approved by a vote of 5-0-0 (Petschek, Perkins, Jarema, Caouette, Tedesco).
Other Business
Minor Modification for Carnation Circle
Rich4rd Nazzarro, trustee for Carnation Circle, attended the meeting. Also attending was
Virginia Adams, closest abutter. The Board reviewed the material presented, as well as the letter
submitted by Ms. Adams.
Mr. Nazzarro explained the lack of a plot plan for this mailbox due to the involvement of more
than one original builder. The Town also did not have any site plans. Mr. Tedesco thought a site
plan was required. Mr. Nazzarro also explained why the association did not want the door to the
shed changed as Ms. Adams requested.
Mr. Jarema thought the Board needed to consider if this was a substantial change. He said any
dimensional changes have required a site plan in the past. The Building Inspector said the 50'
dimension concerned him because he does not know why it is documented.

Ms. Adams said the issue goes back to when the development was first proposed and there were
references to the 50' setback on her deed that would be available at the Registry of Deeds. She
did not think the shed was part of the original plans. The Town Planner at that time did not allow
end decks to have roofs because that would exceed the required 50' buffer.
The Chairman said the Board has to understand what the original dimensional controls were and
an uncertified hand drawing is not sufficient. He thought they could not proceed without more
information as to this quoted 50' setback (if this is what is required). And if a site plan is not
available, then the Applicant must obtain one.
The Applicant will tell the Building Inspector once he has more information to present to the
Board and then another hearing will be scheduled.

On a motion by John Jarema, seconded by Jeffrey Perkins, the Zoning Board of Appeals moved
to adjourn the meeting.
The motion was approved by a vote of 5-0-0 (Petschek, Perkins, Jarema, Caouette, Tedesco).
