MASS, tQt19 NOV 21 A & A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the Town Hall, 16 Lowell Street, Reading, Massachusetts, at 7:00 P.M. Also in attendance was Glen Redmond, Commissioner of Buildings. Case # 09-15 A Public Hearing on the petition of Roberta Botticelli and Rick Nazzaro who seek a Variance and an appeal from a decision of the Building Inspector under Sections 4.8 and 7.4.2 of the Zoning By- laws in order to construct a residential two-family dwelling or a commercial building in a Business A District within an Aquifer Protection District on the property located at 130 Franklin Street in Reading, MA. The proposal exceeds the allowable lot coverage of 15%. Building plans, elevations and floor plans have not been submitted. Jack Sullivan represented Roberta Botticelli and Rick Nazzaro who were also present. Mr. Sullivan wanted to note that only part of the lot was in the Aquifer Protection District. Some of the abutters submitted letters of dissent to the Board and the letters were added to the case file. Ms. Botticelli said she can not submit building plans because she does not know what is going to be put on the property. There were only four Zoning Board members present, so the Applicants requested that the hearing be continued to October 1, 2009. On a motion by Damase Caouette, seconded by Robert Redfern, the Zoning Board of Appeals moved to continue the hearing, at the Applicant's request, to October 1, 2009. The motion was approved by a vote of 4-0-0. (Redfern, Miles, Petschek, Caouette) Minutes: On a motion by Clark Petschek, seconded by Robert Redfern, the Zoning Board of Appeals moved to accept the minutes of July 16, 2009 as submitted. The motion was approved by a vote of 3-0-0 (Petschek, Caouette, Redfern). On a motion by Robert Redfern, seconded by Damase Caouette, the Zoning Board of Appeals moved to accept the minutes of July 30, 2009 as submitted. The motion was approved by a vote of 3-0-0 (Petschek, Caouette, Redfern). On a motion by Damase Caouette, seconded by Robert Redfern, the Zoning Board of Appeals moved to accept the minutes of August 6, 2009 as submitted. The motion was approved by a vote of 3-0-0 (Petschek, Caouette, Redfern). Other Business: Carnation Circle Richard Nazzaro said they now propose a 112 square foot shed that would be 84' from the nearest abutter. The shed would be installed by the Reeds Ferry Shed Company. There will be no water or electrical and its use would be just storage. The Building Inspector said Mr. Nazzaro had found an original site plan that did show where the mail station was located and this confirms that the new shed would be 84' from the nearest abutters. Virginia Adams, the nearest abutter, said the new proposal was acceptable. On a motion by Damase Caouette, seconded by Robert Redfern, the Zoning Board of Appeals determined that the construction by the Applicant of a 14' x 8' storage shed adjacent to the petitioner's existing mail station as depicted on the Plan of Land dated September 10, 1987 provided at this meeting, would not constitute a material modification of the Special permit granted to the applicant in 1987. The motion was approved by a vote of 4-0-0. (Redfern, Miles, Petschek, Caouette) Adjournment On a motion by Robert Redfern, seconded by John Miles, the Zoning Board of Appeals moved to adjourn the meeting.
