A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the
Town Hall, 16 Lowell Street, Reading, Massachusetts, at 7:00 P.M.

A Public Hearing on the petition of Two Walkers Brook Crossing LLC who seeks a Variance
under Sections 6.2.2/4.9.5.6.3G/Table 6/2/3 of the Zoning By-laws in order to install a real estate
wall sign greater than 16 square feet on the property located at 40 Walkers Brook Drive in
Reading, MA.
Taryn Warren of Dickenson Development requested that the rental sign currently in place at 40
Walkers Brook Drive be allowed to remain and a Variance be granted for an additional period of
90 days from the expiration of the existing Variance. Ms. Warren presented her criteria in order
to be granted this Variance.
Ms. Warren also requested that the Board be able to grant any future continuances without
having to reapply if the property has not been rented within the next 90 days.
Mr. Jarema thought the next time Ms. Warren came before the Board she should bring any
pertinent data as to exactly how much interest this sign has been generating.
Mr. Redfern did not think there was any law that would support this Variance being able to be
continued without any formal application. Mr. Petschek agreed with Mr. Redfern but said he
would be amenable to a request for a longer time period for the Variance.
Ms. Warren asked to modify her request from a period of 90 days to a period of 180 days and the
Board agreed this would be acceptable.

On a motion by Robert Redfern, seconded by Damase Caouette, the Zoning Board of Appeals
moved to grant the Applicant a Variance under section 6.2.3.21 of the Zoning By-laws in order to
maintain a temporary real estate banner sign of no more than 100 square feet in area as depicted
in Exhibit b, on the property located at 40 Walkers Brook Road. This Variance shall commence
on February 19, 2010 and terminate on the earlier of (i) August 18, 2010 or, (ii) the occupation
of the property by a tenant.
The motion was approved by a vote of 5-0-0 (Petschek, Redfern, Jarema, Miles, Caouette).

Peter Sanborn Place
Attorney Tim Kelly presented the proposal to the Board for a small expansion that requires a
modification for the Comprehensive Permit they have already received. This renovation and
expansion of square footage is because of the HUD grant they received that requires extra space
at their location. They have already received building permits for the interior renovations. They
are requesting that the expansion be considered a minor modification to the Comprehensive
Permit.
Their engineer reviewed the plans that had been submitted and answered questions for the Board.
The Building Inspector did not have any questions. He thought the project was acceptable but
thought this proposal should come before the Board for their opinion as to whether this is a
minor or major modification.
The members of the Board agreed this was an insubstantial modification and Attorney Kelly
answered questions from the Board.
The Applicant has already received Conservation approval and met with the Town Design
Review Team.
The Chairman said this is appropriate and appears to be a minor modification.
On a motion by John Jarema, seconded by John Miles, the Zoning Board of Appeals made a
determination that the proposed changes to the Comprehensive Permit, Case # 1981-5, and as
defined by the architectural plans submitted by The Architectural Team of Chelsea, MA and
dated November 2, 2009 and revised December 18, 2009 to add a 413 square foot one-story
addition to the present structure for the purpose of increased dining and kitchen facilities are
"insubstantial.
The motion was approved by a vote of 5-0-0 (Petschek, Redfern, Jarema, Miles, Caouette).
Section 6.3 - Discussion of Draft Changes

The Board discussed the proposed changes to Section 6.3 by Town Counsel. The Board reviewed
each section and the Chairman will forward the Board's opinions, questions and concerns to the
Town.

On a motion by Robert Redfern, seconded by Damase Caouette, the Zoning Board of Appeals
moved to accept the minutes of January 7, 2010.
The motion was approved by a vote of 4-0-0.

On a motion by John Miles, seconded by Robert Redfern, the Zoning Board of Appeals moved to
adjourn the meeting.
The motion was approved by a vote of 5-0-0 (Petschek, Redfern, Jarema, Miles, Caouette).
