HomeMy WebLinkAbout2010-04-01 Zoning Board of Appeals MinutesT~m CLFkx- Town of Reading ZONING BOARD OF APPEALS Minutes of April 1, 2010 Members Present: Clark Petschek, Chairman Robert Redfern Damase Caouette Peter Tedesco Members Absent: John Jarema John Miles Jeffrey Perkins i.i 2010 JUIR I A 1 A meeting of the Zoning Board of Appeals was held in the Selectmen's Meeting Room of the Town Hall, 16 Lowell Street, Reading, Massachusetts, at 7:00 P.M. Also in attendance was Glen Redmond, Commissioner of Buildings. Other Business: 18D Carnation Circle - Determination if Major/Minor Modification Kate Jessup of Red Apple Builders presented her proposal to the Board for 18D Carnation Circle and the partially enclosed porch. They are only adding a partial roof to the present structure and are not increasing the footprint. The Building Inspector does not have any concern with this particular project but there are 90 units and he thinks there will be many more to follow appearing before the Board. He also said there are many units that have done this in the development without appearing before the Board, some with permits and some without. Mr. Redmond would like the Board to decide if they will allow this in the other units also so that he can issue permits by right. The members gave their opinion as to whether they felt that this type of modification was a minor or major modification. They did feel that any future cases should be brought before the Zoning Board. An existing roof with a deck under it can have screens or glass and not be a major modification. All other modifications, such as a second level, must come before the Board. There was some question as to whom would own these "rooms" since these are considered common areas and are owned by the Condo Board. Richard Nazzaro said the enclosed decks are maintained by the unit owners even though they don't own them. He said all owners have to sign alteration agreements if they are altering the common areas in any way. After more discussion, the Board concluded that all enclosure projects, whether or not the proposed enclosure entailed adding screening or windows to an existing deck, must come before the Zoning Board. ZBA Meeting, April 1, 2010 On a motion by Robert Redfern, seconded by Damase Caouette, the Zoning Board of Appeals - determined that the construction by the Petitioner of a roof over an existing deck and enclosed with removable screens, as depicted on plans and architectural renderings provided, will constitute a minor modification of the Special Permit granted by the Board to Greenhouse Acres Condominiums in 1987. The vote was 4-0-0 (Petschek, Redfern, Caouette, Tedesco). 45 Beacon Street - Determination if Major/Minor Modification Angelo Salamone presented his revised 40B proposal to the Board and indicated that his proposed modifications would result in the removal of fewer trees. He reviewed larger plans that he brought with him to explain to the Board in greater detail than on the plans that were submitted to the Board. The Board had a number of questions regarding Mr. Salamone's proposals and thought that there were too many generalities. The Board concluded that it could not make any determination with respect to Mr. Salamone's proposals until a definitive plan was presented to the Board. If Mr. Salamone wanted to have a working session as to possibilities for this site he should meet with the Building Inspector. The Board determined that insufficient information had been presented to make a ruling on whether the proposals constituted a major or minor modification. They would like a formal proposal with public input as well as input from other depart ments in the Town in order to make any type of determination. Minutes On a motion by Mr. Caouette, seconded by Mr. Redfern, the Zoning Board of Appeals moved to accept the minutes as amended for January 21, 2010. The vote was 3-0-0. (Tedesco abstained) Adjournment On a motion by Mr. Tedesco, seconded by Mr. Caouette, the Zoning Board of Appeals moved to adjourn the meeting.
