Construction proiects in progress or to be done this year (between now and June 30, 2010): Construction proiects in progress or to be done this year (between now and June 30, 2010): ♦ Done - School Street Lincoln street Sandra Lane South Street - Main to Hopkins Scotland Road; Landscape Contractor has installed loam and hydro seeded all areas. ♦ Paving in progress - Bear Hill Road, North Street, Pinevale Avenue and Juniper Circle; Binder has been installed Contractor is in progress of raising structures to accept final wearing course. ♦ Micro-chip seal - mid to late spring Hopkins Street (Main.to Wakefield Town Line); and 2 to 3 other streets; o Skim coating of local streets Lewis Street ♦ Memorial Park Basketball and tennis courts sub-base installed and graded. The Pine tree, to be removed, at the tennis court cannot be removed until August as red tail hawks are nesting. (A migratory bird protected under a federal program) This will delay the completion of the tennis courts. Skating ponds have been shaped, sub-drains and stone sub-base have been installed. The liner is expected to be installed in approximately 3 weeks. In process of installing additional site drainage. Will start. removing loam for pathways and installing electrical conduit. ♦ Fishing Pier - Lobs Pound Mill - The contractor for the fishing platform has installed the additional parking spaces and has poured the concrete pad for the bench near the river. He has not been on site for several weeks - probably waiting for the meadow near the river to get dry enough to install the walkway and platform and guardrail. He started just after the March floods, when the meadow was under water ♦ Trail construction - Bare MeadOW Trail Comm. installed the first section of the boardwalk in April and liked the concrete piers. We ordered enough for the rest of the boardwalk and a short section near Haverhill Street that is also wet. The route was staked out last weekend, and there will be additional work days on May 8 and 15 - hopefully ending with completion of the boardwalks. Other trail-hardening was done last fall with application of stone aggregate in soft areas. We, also need to install sign boards, blazes, and directional information, and plant the meadow where it is eroding - to be done in June. Grant period ends June 30, and we hope to meet that deadline. ♦ Memorial Park Basketball and tennis courts demolished. Work underway for new tennis court. One drain line installed from Harrison Street to manhole between the two ponds.so ponds can be reconfigured - old drain line is in the way and will be removed. Topsoil has been stripped from the lawn above the ponds where they are to be expanded. Topsoil is being stripped from the floors of the ponds and stockpiled separately. The north pond has been wet for the last few days, which may be limited progress there. I have not seen the south pond since it was stripped, so do not know whether water is present there also. ♦ Washington Park playground -Since the last update the Friends of Washington Park have had two successful fundraisers - one at Christopher's Restaurant which made $900 and another at Fuddruckers which raised approximately $300. The playground has been ordered and the target installation range is June 15th - 30th. The construction of Washington Park playground will take approximately 3 days and will be located as advised in the WP Master Plan. The brick campaign continues. Thus far we have sold approximately 40 bricks. The goal is to sell 100. We will continue the initial brick campaign until late summer and then establish a patio and walkway using the bricks to lead to the playground. Proceeds of the brick campaign will allow for purchase of picnic tables and benches and other amenities. Killam School playground -The- Killam Playground has been advertised and we are in the midst.of getting playground proposals from capable companies. The PTO has virtually accomplished its goal of raising .$15K (about $1 K short). The Killam PTO will assist in selecting a final playground structure and it will be located based on the Killam master plan. I hope to be able to award a contract in June and have the playground installed around the beginning of August. This installation may be done as a supervised community build so the install date will not be clear until the contract is awarded. ♦ Master Plan for Joshua Eaton Playground Completion Late May. Other survey efforts include wetlands delineation (although I don't believe that is occurring adjacent to 143 South Street). These are part of "early action" items that MassDOT is undertaking before a contract is finalized with our consultant to perform the majority of the environmental impact and highway design work. The first formal step in this process will be a "scoping session," which will be publicized with an official announcement on www.9395info.com (plus via e-mail), but due to procurement procedures and debriefing of the other consultant teams, hone of this will occur until our chosen consultant actually has a signed contract with the State. Members of the Planning Study's Task Force will receive invitations to remain involved throughout the environmental process. All information related to the completed planning study, environmental notification form, and MEPA certificate is still available at www.9395info.com., I will continue. to inform everyone of further significant news or milestones once available. Lynda - If you like, I can place you on the e-mail distribution list for further updates. Nearly three years ago, I remember speaking with your husband about his similar concerns. Simply put, there haven't been any significant developments or progress on this proposed project in the last couple years due to funding and other constraints. If there had been, you would have heard about it from us. Also, if a surveyor needs to access anyone's property directly, the property owner should receive a written letter or notice to that effect (this does not apply to adjacent properties). There is still a VERY LONG time frame for this project (at least seven more years until the start of construction), and still many more opportunities upcoming for public comment, potential design changes or adjustments, right- of-way negotiations with property owners, etc. Please feel free to contact me any time if you have additional questions or concerns. The remaining 70 or so downtown businesses are slated to be inventoried by the end of the month (one side of Main, Haven, Woburn and High Streets). Of the 138, there are a total of 92 businesses with sign violations (67% of the businesses). Background - Approximately 16 years ago the zoning by-law was amended to insure that all signs come into compliance by July 1,.2010. There have been efforts by past Town Planners to advise the business community of this regulation including several public meetings held in advance of Town Meeting in 2003. b. Zoning By-Law Reference - Section 6.2.2.3 6.2.2.3. Nonconforming Signs: All nonconforming signs shall be removed or shall be altered so as to conform with the following provisions, whichever occurs sooner: a. When the nature of the business changes and the sign is changed or modified in shape, size, or legend; or b. When the name of the business changes and the sign is changed or modified in shape, size, or legend; or c. July 1, 1994 for any temporary sign or nonconforming temporary or permanent window sign; or d. July 1, 2000 for any internally illuminated sign which does not have an opaque background, or e. July 1, 2000 for any sign which is in excess of the number of'signs allowed per business or per lot; or f. July 1, 2005 for any nonconforming permanent sign which had an original installed cost of $10, 000 or less; or g. July 1, 2010 for any nonconforming permanent sign which had an original installed cost of more than $10,000. A nonconforming sign may not be enlarged or altered in any way which would increase its nonconformity. Should any nonconforming sign be damaged by any means to an extent of more than fifty percent of its replacement cost at the time of damage, it shall not be reconstructed except in conformity with the provisions of this Section. c. Steps to Compliance/Timeline - Message we hope to convey is that we want to work with businesses to help them come into compliance. We are working with businesses on their plans on a case by. case basis. Two staff people are devoted to managing a database of compliance. No forum is planned at this time as we are providing individualized follow up. • 1/29/10 - Initial letter from P. Hechenbleikner to Community Services database of businesses and forwarded to Chamber of Commerce for distribution. • Inventory of Violations - ongoing, to be completed by June 1, 2010 • Violation Letters from Building Inspector citing sign violations - 20 letters have been sent out to date; several more are ready to be sent out. • Abby and. Mike are working with business owners to come into compliance. Window Signs are the biggest culprit, businesses are working towards compliance. • Concerns have been expressed by businesses occupying single tenanted buildings in Business A and need to come into compliance by, removing either a wall or freestanding sign. d EDC proposed, as part of zoning changes for annual town meeting, allowing single tenanted buildings to have a freestanding and wall sign. CPDC did not recommend this change. Planning staff have brought back to the CPDC the idea of revisiting the proposed change to allow freestanding and wall signs in Business A through the design guidelines for that corridor. If CPDC is amenable to taking this up again, we can notify violators . that this may be changed so they will have additional time. Other - businesses have been informed that they can seek zoning relief from the Zoning Board of Appeals. Changes to the Sign By- Law are another option for businesses to consider. Several public forums and public hearings were held over the winter as part of the recommendations by. the Planning Commission to Town Meeting for the changes to the Sign By-Law. d. Zoning Enforcement - In the violation letters we ask business owners to contact our office so that we can work with them to achieve zoning compliance. First letter is sent by certified mail to insure that. parties have received notification. Normally we sent subsequent letters with fines. In this case to be sensitive to the needs of the businesses as long,as they contact us,'and a plan can be worked out for compliance, we will not issue fines. Non-illuminated window signs must: • Be uniformly located • Not cover more than 30% of the glass window frame or window pane • Lettering should not be larger than eight (8) inches • Not exceed six (6) square feet in sign area Illuminated window signs must: • Be placed only in a window, not a door • Be located in a window with, no other signs • Not exceed four (4) square feet in sign area • Be at least ten (10) feet from any other illuminated window signor seven (7) feet when there is a door or architectural break in the fagade between the illuminated signs. • Be illuminated only during business hours. BRANDT and JEAN BRANDT, husband and wife, of 767 Main Street, Reading, MA 01867 (hereinafter "the Grantees"), for themselves and their heirs, successors and assigns. WHEREAS, the septic system for the property located at 767 Main Street, Reading, MA (the "Property") failed a recent Title 5 inspection and was required to be upgraded; and WHEREAS, because the square footage of the Property does not accommodate the installation of a new septic system and as a result, the Property must be connected to the Town's municipal sewerage system; and WHEREAS, direct access to the municipal sewerage system is not readily available to the Property and therefore, Town Meeting. approved Article 24 at its. May 3, 2010 Annual Town Meeting to authorize the grant of an easement for the benefit of the Property, which easement is to be located in and upon the adjacent Fire Station property located at 757 Main Street, Reading, which easement will allow the Brandts to access the municipal sewerage system by connecting to the existing sewer which serves the Fire Station; and WHEREAS, the existing sewer service is of sufficient size to accommodate sewerage flow from both the Fire Station and the Property; and WHEREAS, it is the intent of the parties to enter into this Agreement to memorialize the rights, duties and obligations of each party with respect to the costs associated with the maintenance of the sewer service: NOW, THEREFORE, for consideration of One Dollar ($1.00) and other good and valuable consideration paid, the receipt and sufficiency of which is hereby acknowledged, the'Town and Brandts hereby agree as follows: 1. Subject to the terms and conditions hereof, the Town grants to Craig M. Brandt and Jean Brandt, husband and wife, as tenants by the entirety their successors and or assigns of 767 Main Street, Reading, Massachusetts (hereinafter "Grantees") a perpetual right and easement for sewer purposes on land located at 757 Main Street, Reading, Massachusetts (the "Basement Area") and shown as Sewer Easement Area 2,483 sq. ft. on a plan of land entitled "EASEMENT PLAN 767 MAIN STREET READING, MASSACHUSETTS", Prepared by LeBlanc Survey Associates, Inc. 161 Holten Street, Danvers, MA 01923 (978) 774-6012, dated February 25, 2010, Scale: 1 "=20', which plan is to be recorded herewith, together with the perpetual right and easement to enter upon said Easement Area, for any and all purposes connected with the proper maintenance, use, operation, improvement, repair and reconstruction of the sewer line. 101978143 I f 12 2. The Grantor expressly reserves the right to pass and repass over the sewer easement area for access to its property. 3. Whenever it becomes necessary, for whatever reason, for the Grantees, their agents, servants or employees, to dig up, excavate or otherwise disturb the premises, doing no unnecessary damage to the premises; provided, however, that the Grantees shall, at their own cost and expense, restore said premises as nearly and as reasonably as possible and within a reasonable period of time, to their original condition. 4. The Grantees shall exercise their rights hereunder so as to minimize interference with the use and occupancy of the Property by the Town of Reading Fire Department. Similarly, the Grantor agrees that it shall not substantially interfere with the Grantees' rights hereunder. 5. The Grantees shall indemnify, defend, and hold harmless the Grantor, its duly elected and appointed officers and employees, from and against any and all actions, causes of action, suits, debts, claims, damages, complaints, expenses, demands, and liabilities whatsoever, including reasonable attorneys' fees, defense costs, and the like, arising out of or resulting from, or in any way directly related to the Grantees' activities in the Easement Area,. including but not limited to the construction, and installation of the sewer line and related disruption caused thereby and failure to maintain the Easement Areas and the facilities installed therein in good order and condition except if the same was caused by the negligence, fault or misconduct of the Grantor, its officers servants or employees or third parties over whom the Grantee does not exercise control. 6. The Sewer Easement created by this conveyance shall exist for the sole benefit of the property located at 767 Main Street, Reading, Massachusetts. . T The Sewer Easement Area shall be maintained and the sewer pipe located within said Easement Area shall be kept in good repair with the responsibility and cost of maintenance to be apportioned between the Grantor and the Grantees as follows: the Grantee shall be responsible for all costs associated with the maintenance of the Sewer Easement Area and the sewer pipe located within said Easement Area from the manhole connection to 767 Main Street, Reading, MA, meaning and intending to describe that portion of the pipe that solely services 767 Main Street, Reading, Massachusetts. The Grantor and Grantee shall be responsible for all costs associated with the maintenance of the Sewer Easement Area and maintenance, repair or replacement of the sewer pipe and appurtenances located within said easement area from the manhole connection to Salem Street. The cost of said maintenance shall be apportioned between the two owners based upon each owner's percentage of flow to/from their respective property. Said percentage of flow shall be calculated based on the average water usage to their respective properties from the three 13 3 ~ years prior to.the performance of the maintenance, repair or replacement of the sewer pipe and appurtenances. 9. The. Grantor and the Grantees for themselves and their successors and assigns, hereby agree to maintain said easement in common with each other and agree to indemnify each other and save each other harmless from and against any loss, damage or liability arising out of their exercise of said right and easement', For Grantor's title, see deed recorded with the Middlesex South Registry of Deeds at Book 3273, Page 47. This may have been caused. by a faulty battery, downloading glitch or operator error. The study will be redone prior to the end of school. The data that was collected shows that the majority of traffic on Temple Street occurs during drop-off and pick-up times for the Parker Middle School. Also, with most drivers travelling at or around 19 MPH, speed does not seem to be as in-Lich a problem as perceived. However, definitive conclusions regarding speed and volume must be reserved until the study is redone. The current excellent rate of $60.19/ ton would be held for fy11, and.then adjusted annually by a CPI differential from one year to the next for the life of the contract. Our contract consultant has also been involved in the review process, and recommends the extension, as our rate is the lowest in the entire area and recently bid rates are running higher. I am waiting for a formal proposal, and once received, I would recommend review by Town counsel, prior to final acceptance. I believe both Wakefield and Stoneham are in the same timeframe, and may potentially execute their agreements within the next week. Collection/ Recycling: As you are aware, JRM, our current vendor, has submitted a 5 year extension request for our consideration, and based on our review (along with our contract consultant), looks very good for the Town. However, prior to formal consideration, I felt it was in the best interest of the Town to go out and solicit other quotes. Along those lines, I have met with both Hiltz Disposal, and Waste Management, and am now waiting for formal contract quotes based on the exact specifications quoted by JRM for a new 5 year contract starting 7/1/1.1. I also specifically requested input, for discussion, on any/ all potential options including automated collection, one day collection, single stream recycling, etc. I set June 1 as a timeline to receive proposals. 5/24/2010 Page 2 of 2 Once received, I will set up a meeting with all appropriate participants to review.
