Hechenbleikner DATE: March 26, 2010 RE: Agenda- March 30, 2010 3a) Follow Up on Mt. Vernon Street Parking - When the Board approved the parking restrictions at the intersection of Mt. Vernon Street and High Street, the Board asked us to come back in the spring to review any issues or concerns with regard to the parking restrictions creating snow plow issues, or additional parking concerns in the neighborhood. We'll have a report for you on Tuesday. 3b) Review Bollards - The Board asked that we come back in the spring and review damage to bollards during the winter due to snow plowing. By the time this goes to you I hope to have a report from the Town Engineer on bollards. My understanding is that we have lost two to three bollards over the winter time, none to snowplow damage. 3c) Dogs in Parks - This is a follow up on previous discussion that the Board had with regard to allowing dogs to run at large during certain times in parks, perhaps on an experimental basis. "We are committed to doing everything we can to help our residents, businesses and communities recover from the devastating impacts of this month's storm," said Governor Patrick. "I am hopeful that our request to the President for a disaster declaration will be granted and will help bring us one step closer to securing the assistance people need to rebuild." There is no 'monetary threshold' associated with the 'Individual Assistance Program', but a demonstration is required of the breadth of the impact and number of individuals involved. FEMA preliminary damage assessment teams that have visited 60 communities in the last week documented that hundreds of homes suffered major, uninsured damage to living spaces; that over a thousand homes suffered minor damage but still incurred a significant loss; many nursing homes and special needs facilities were evacuated; and habitability of many homes remains in question. The Governor is specifically requesting the following "Individual Assistance" programs be immediately expedited: Individuals and Households Programs (IHP), Disaster Unemployment Assistance, Crisis Counseling, Legal Assistance, Tax Relief, and Small Business Administration Disaster Loans. This assistance is requested to meet the recovery needs of communities still struggling with the impacts of flooding. By the beginning of next week, flood waters will have receded sufficiently to allow local, state and . federal officials will be able to transition from the present response mode to a recovery mode. At that time, officials expect that public infrastructure damage will become more visible and evident, and preliminary assessments can be made of the scope of damage to public roads, dams, bridges as well as the public safety'costs incurred by first responders. Zambouras, Town Engineer Date: March 24, 2010 Re: Downtown Damage As of this date we have incurred the following damage to street lights and bollards within the downtown project area: Bollards Two (2) bollards have been struck by motor vehicles, each at the Salem Street and Main Street intersection. A map indicating the locations and photos of each are attached. Location 1: One bollard was struck by an unknown vehicle. at, the SW comer around February 2`d. The bollard is located in the lawn area adjacent to the handicap ramp. The bollard broke below grade and the area. was re-loamed and seeded' by DPW crews. No concrete replacement was necessary. No vehicle information is available. Location 2: One bollard was struck by a truck at the NE comer of the intersection on February 19th. We have recently received the information from the police department and are in the process of drafting a bill for the cost of the bollard, demolition and removal the bollard remains and sidewalk repair for submission to the insurance company. Repair work will commence this spring when weather is conducive for concrete work. Decorative Street Lights Four (4) street lights have been damaged; all damage is limited to the luminaire. Please refer to the attached sketches for locations. We have placed an order for new fixtures; expected delivery date is 8 - 10 weeks. Replacement costs for fixtures are $974 for the complete fixture (less pole) and $433 for the globe only. Location 1: Southbound Main Street at intersection of Washington Street (adjacent to Dunkin Donuts driveway). The .fixture's globe is broken at the base. Date of damage, possible causes unknown, no information.available. Location 2: Northbound Main Street at intersection of Chapin Avenue. The fixtures globe was broken at the base and removed for safety. The damage was noticed following a snow storm this winter and it is assumed that the damage may have been the result of sidewalk snow. plowing or snow ® Page 1 30 14 removal. As with the damage identified below.we have no proof to file a claim against the contractor's insurance company. Location 3: Two (2) fixtures are damaged on Lowell Street in front of Town Nall. One is adjacent to the entrance to Lowell Street the other is at the beginning of the perpendicular parking spaces. At each location the globe was broken at the base. The globe adjacent to the entrance to Lowell Street was removed for safety. The damage was noticed following the last snow storm. It is assumed that the damage occurred is a result of the equipment plowing sidewalks during the storm. It basically requires them to report to us in a manner we dictate. That could be on paper or electronically. Also, regarding Peter Simms comments, I agree it shouldn't be overly onerous to meet the requirements. I think reporting to us and having us dictate the manner we will be able to keep it simple. Other agencies do this regularly. I see a note here speaking about requiring reporting on everything bought, I am ok with that, who knows what might be valuable next week, why limit ourselves. Here is some feedback. Currently we require a drivers license and WE REQUIRE that all sellers must be 21 years old. I find this stops the high school kids or their friends from coming in. We don't want to.buy anyone's mother's jewelry. # 10 under standards, keeping a description could be.a nightmare. Most people come in with old broken stuff, one earring, assorted charms, assorted chains etc. To try and list this all individually could be extremely time consuming. What we currently do is bag everything by weight. Let's say you come in with 50 grams of gold and 30 grams of silver. We would split it, put in two separate bags and hold it for 21 days. If people are selling large stones we sometimes take them out and then make an offer. These would be listed separately. If it is small stuff we estimate it in the mounting. I also think submitting everything to the police (#12) is going to be time consuming for us and more so for the police dept. At least we in the trade know (or should know) what we are buying. Unless they are looking for stolen goods, unless they. are distinctive, who would know the difference?? Having the names of the seller should be sufficient if stolen property is suspected. Items 10 thru 15 would be the items of concern to me and should also be for the police dept. We do not want to make this a paper mess for the dealers or the police dept. If the selectmen would like me to meet with them I am available. Peter Simms G.G. 648 Main Street Reading, MA 01867 www.simmsjewelers.net 3/11/2010 26 DRAFT Board of Selectmen POLICY Section 3.11 _ Issuance of Licenses for Dealers in the Purchase, Sale or Barter of Junk, Old and Precious Metals and Secondhand Articles Chapter; 140 Section 54 of the Laws of the Commonwealth provide for the regulation of dealers in the purchase, sale, or barter of junk, old and precious metals, and secondhand articles. Under Section 4.5.2 of the Town.of Reading General Bylaws the Board of Selectmen as Licensing Authority is charged with the responsibility of issuing these licenses, determining whether a person is suitable for carrying out this business, and determining conditions for such licenses. The following rules and regulations are hereby adopted to guide the Board of Selectmen in reviewing and ruling upon applications for Dealers in the Purchase, Sale or Barter of Junk, Old and Precious Metals and Secondhand Articles. Application 1. Each application will be dealt with on a case by case basis. 2. Each application for a license or a renewal of a license shall be made in writing to the Board of Selectmen on a form provided for this purpose by the town. . 3. Each license for the keeping of a shop for the purchase, sale or barter of junk, old and precious metals including gold and silver, andlor secondhand articles shall be issued on a location specific basis. 4. The applicant shall provide to the Board of Selectmen a lease or written approval of the property owner (if other than the applicant) for the use of the premises for the license period 5. The licensed premises must conform to the Town of Reading Zoning By-Laws. 6. Licenses will be issued for a period of up to one (1) year unless sooner revoked by the Board of Selectmen, and shall expire on December 31 of each year. 7. The fee for each such license shall be $50 per year., 8. The license shall be clearly and prominently displayed in a suitable and conspicuous place on the premises. 9. Prior to the issuance of a license, the Board may require a review by the Building/Zoning Inspection Division, and the Chief of Police to assist them in determining that the applicant is a proper person to engage in the business to be licensed. Standards 10. Every dealer in precious metals shall keep a book or other record in which shall be written at the time of each purchase, a description thereof, the name, age and residence of the person from whom the purchase was made, and the day and hour when such purchase was made. 11. Every dealer in precious metals shall take and maintain photocopies of picture identification for any person who sells or barters an item. 12. Every dealer in precious. metals shall submit to the Reading Police Department within one (1) week of such purchase or acquisition a list of all purchases and acquisitions in a manrier promulgated by the police department. 13. The Chief of Police or his designee shall at all times have the authority to inspect or examine all books or other records kept by the dealer or keeper of the shop for the Purchase, Sale or Barter of Junk, Old and Precious Metals and Secondhand Articles and shall have the right to inspect and examine all articles and merchandise therein. No dealer in junk, old and precious metals, or secondhand articles or any employee thereof shall directly or indirectly purchase or receive by way of barter or exchange any junk, old and precious metals or secondhand articles from a person under the age of eighteen (18) years. 15. No item purchased or received by. dealer in precious metals licensed under this bylaw shall be removed from the town, sold, or otherwise disposed of for at least fourteen (14) days from its date of purchase or acquisition unless permission has been obtained from the Chief of Police or his designee who may request to inspect or photograph the item. 16. All weighing or measuring devices used by a licensee in the conduct of 'the licensed business shall be tested and sealed by the Town of Reading Sealer of Weights and Measures prior to being placed into service. All weighing and measuring devices shall thereafter be inspected and tested on an annual basis. Enforcement' 17. Any license issued hereunder may be suspended or revolted, after a notice and hearing, for cause or violation of the bylaw and/or this policy 18. The failure to comply with the license requirement of G.L. c.140, §54 and Section 4.5:2 of the Reading General Bylaws shall be punishable pursuant to state statute governing such violations.
