Pleasant and Eaton Street gas main replacement
MEMORANDUM OF UNDERSTANDING
BETWEEN THE
TOWN OF READING AND JANET FERNANDEZ-DALELIO
FOR THE SALE OF PROPERTY AT
6 SUMNER CHENEY PLACE, READING, MA
Memorandum of Understanding entered into this day of February, 2010
between the TOWN OF READING, (the "Municipality") by and.through its Board of
Selectmen as the Chief Executive Officer of the Municipality, as that term is defined in
760 CMR 56.02 and JANET FERNANDEZ-DALELIO (the "Owner") of 6 Sumner
Cheney Place, Reading, Massachusetts 01867 (the "Property") for the purpose of
facilitating the sale of the Property which was conveyed subject to the terms of a
comprehensive permit issued on July 14, 2001, as amended November 21, 2002, which is
recorded with the Middlesex South Registry of Deeds in Book 37379, Page 126 and in
accordance with the terms of the Deed Rider annexed to and made part of the Deed to the
Owner dated March 22, 2005 and recorded with said Deeds in Book 44850, Page 398;
WHEREAS, The Property referred to herein is the Property described in the Deed Rider;
WHEREAS, neither party has been able to locate an eligible purchaser for the Property
and the Town has elected not to exercise its right of first refusal to purchase the Property,
all as described in the Deed Rider; and
WHEREAS, the Property has been approved for sale as a market rate unit at a price
established by an appraisal obtained by the Owner and approved by CHAPA (Citizens
Housing and Planning Association).
NOW THEREFOR, the parties agree as follows:
That the initial. listing price for the sale of the Property shall be $349,900.00.
2. That the initial listing period shall be six (6) months from January 1 to June 30,
2010.
That the Town may authorize the sale of the Property for a sale price below the
approved sale price of $337,250.00.
4. At the time of closing, the Owner shall receive the CHAPA established value for
the Property of $234,200.00 less any outstanding mortgage balance.
5. At the time of closing, the Town shall be responsible for payment of the 4% real
estate broker's fee.
6. At the time of closing the Town shall be responsible for the payment of all
recording costs to be borne by the Seller.

7. At the time of closing, CHAPA shall receive a resale fee as the monitoring agent,
for coordinating the resale process. The resale fee for 6 Sumner Cheney is 1/2 of
1. percent of the maximum resale price of $234,200 or $1170. .
8. At the time of closing, the net sale proceeds of the sale, defined and calculated
herein as the sales price for the Property, legs the 4% broker's fee and recording
costs, less the CHAPA resale fee, and less the amounts payable to the Owner
under paragraph 4 hereof, shall be paid to the Town.
Executed as a sealed instrument this day of February, 2010.

Dear Mr. Hechenbleikner,
I am looking forward to attending the hearing on the proposed schools zones on Birch Meadow Drive on
Tuesday evening. As a member of the W.A.S.H. (Wellness, Allergies, Safety and Health) Committee at the Birch
Meadow Elementary School, I am wondering if there will be a discussion period that will allow members of the
