Board of Selectmen Meeting
November 9, 1987
Meeting convened 7 : 00 P.M. in Room 102 Parker Middle School .
Present Chairman Russell, Secretary Graham, Selectmen Paul
Landers, Mollie Ziegler and Town Manager Pete Hechenbleikner.
The first item on the agenda was the hearing on the Organization
Plan. Doug Barker was present, and the by-law committee members
attended later in the meeting. On a motion by Ziegler seconded
by Landers the hearing was closed on a vote of 4-0-0.
On motion by Graham seconded by Landers the Organization Plan was
approved on a vote of 4-0-0, with a provision that the circle be
removed from around the Board of Registrars.
Article 6 of the Subsequent Town Meeting was reviewed. On motion
by Ziegler seconded by Landers the proposed Schedule A. of the
Classification was approved by a vote of 4-0-0.
The updated financial review was submitted to the Board of
Selectmen and reviewed.
The meeting was adjourned at 7: 30 P.M.

APPROVAL OF REQUEST FOR TRAFFIC SIGNAL
WHEREAS, the Community Planning and Development
Commission granted site plan approval on June 15, 1987 to Myriad
Properties, Ltd. ( "Myriad" ) with regard to property at 275 Salem
Street (the "Site" ) subject to certain conditions set forth in
the letter of June 29, 1987 of William A. Redford (the "Site Plan
Approval" ) ; and
WHEREAS, Condition 2 of the Site Plan Approval as
amended by vote of August 3 , 1987 requires Myriad working with
the appropriate Town and State agencies to apply for and receive
approval to place a traffic signal for full signalization at the
main entrance to the parking lot on Salem Street opposite Bay
State Road prior to requesting an occupancy permit; and
WHEREAS, Condition 3 of the Site Plan Approval requires
that such traffic signal be in full working order prior to Myriad
requesting an occupancy permit for the retail/office component of
the Site; and
WHEREAS, Myriad has been advised that the State Depart-
ment of Public Works has ceded all authority with regard to said
- traffic signal to the Board of Selectmen of the Town of Reading;
and
WHEREAS, the Board of Selectmen have received conflict-
ing information as to whether a traffic signal at such location
is in the best interest of the Town; and
WHEREAS, the Board of Selectmen have been requested to
approve the installation of a traffic signal as set forth in
Condition 2 of the Site Plan Approval; and
WHEREAS, the Board of Selectmen are of the opinion that
the installation of such traffic signal is not necessary at this
time solely by reason of the occupancy of a portion of the Site
by the State Registry of Motor Vehicles; and
WHEREAS, the Board of Selectmen are presently uncertain
as to the need for such traffic signal in the future in the
absence of any knowledge as to the type of retail/office
component which may be placed in the balance of the space on the
Site; and
WHEREAS, the Board of Selectmen may wish to require the
installation of such a traffic signal in accordance with the Site
Plan Review at some future time at the expense of Myriad; and
WHEREAS, all the requirements of General Laws Chapter
85, Section 2 and any other general or special law relating to
the installation of traffic signals have been complied with
and/or will be complied with prior to the installation of any
traffic signal;

NOW, THEREFORE, the Board of Selectmen approve the
application of Myriad Properties, Ltd. for a traffic signal with
full signalization at the main entrance to the parking lot at 275
Salem Street opposite Bay State Road subject to the following
conditions:
1. Such traffic signal shall not be installed so long
as the Commonwealth of Massachusetts Registry of Motor Vehicles
is the only tenant on the Site at 275 Salem Street, Reading,
Massachusetts. However, notwithstanding the foregoing, until
such time as they may be modified by the Community Planning and
Development Commission, Myriad must still comply with all other
conditions of the Site Plan Approval, as amended.
2 . On each and every occasion when Myriad seeks a
certificate of occupancy for all or any part of the remaining
retail/office component of the Site, prior to the grant of any
such certificate of occupancy the Board of Selectmen shall .
determine whether the traffic anticipated to be generated to and
from the Site by such tenant is such as to require the installa-
tion of said traffic signal; and the Board of Selectmen shall
determine in each such instance whether the issuance of the
certificate of occupancy shall be conditioned upon the installa-
tion of the aforesaid traffic signal at the sole cost and expense
of Myriad. Prior to making each such determination, the Board of
Selectmen shall solicit and receive input from the Community
Planning and Development Commission as to said Commission' s
opinion on the need for such traffic signal based upon said
Commission' s determination of the traffic intended to be
generated by each such tenant.
3 . The Board of Selectmen presently consider that no
additional performance bond or surety is required to insure
compliance with the terms of this approval; however, the Board of
Selectmen specifically retains the right to require the submis-
sion of performance bonds or other sureties, satisfactory to it,
to insure compliance with the terms of this approval of request
for traffic signal.
4 . This approval shall be recorded at the Middlesex
South District Registry of Deeds and shall apply to Myriad, its
heirs, successors and assigns so long as the same are utilizing
the Site pursuant to the Site Plan Approval.
