Members present were: Chairman Russell Graham, Vice Chairman Mollie Ziegler, Secretary Dan Ensminger, Selectmen John Russell, Eugene Nigro, Town Manager Peter I. Conboy, Jr. Approval of Minutes On motion by Ziegler, seconded by Ensminger, the minutes of 7-18- 89 were approved as amended by a vote of 5-0-0. On motion by Ziegler, seconded by Russell, the minutes of 8-21-89 were approved as amended by a vote of 5-0-0. On motion by Ziegler, seconded by Russell, the minutes of 9-11-89 were approved as amended by a vote of 5-0-0. On motion by Ziegler, seconded by Nigro, the minutes of 9-26-89 were approved as amended by a vote of 5-0-0. On motion by Russell, seconded by Nigro, the minutes of 10-10-89 were approved as amended by a vote of 3-0-2, with Ziegler and Ensminger abstaining. On motion by Russell, seconded by Nigro, the minutes of 10-17-89 were approved as amended by a vote of 3-0-2, with Ziegler and Ensminger abstaining. Liaison Reports John Russell indicated that he and Chairman Graham would attend a meeting with the Public Works Director and the Town Manager regarding TASC cleanup. Selectman Nigro indicated that he had attended a meeting with representatives of the Reading arts groups regarding Pearl Street School. Selectman Ziegler indicated that she had attended a Housing Partnership Committee meeting--no chairman will be appointed un- til the Committee is more completely filled out. Chairman Graham indicated that he had a Solid Waste Committee meeting Wednesday. Conboy, Jr. Approval of Minutes On motion by Ziegler, seconded by Ensminger, the minutes of 7-18- 89 were approved as amended by a vote of 5-0-0. On motion by Ziegler, seconded by Russell, the minutes of 8-21-89 were approved as amended by a vote of 5-0-0. On motion by Ziegler, seconded by Russell, the minutes of 9-11-89 were approved as amended by a vote of 5-0-0. On motion by Ziegler, seconded by Nigro, the minutes of 9-26-89 were approved as amended by a vote of 5-0-0. On motion by Russell, seconded by Nigro, the minutes of 10-10-89 were approved as amended by a vote of 3-0-2, with Ziegler and Ensminger abstaining. On motion by Russell, seconded by Nigro, the minutes of 10-17-89 were approved as amended by a vote of 3-0-2, with Ziegler and Ensminger abstaining. Selectmen's Minutes - 10/24/89 - Page 2 Hearings The Town Manager indicated that a hearing on Fire Department fees would take place on the November 7, 1989. Personnel and Appointments The Town Manager outlined the process for appointment of the vacant seat on the Board of Assessors . The Board asked that election results from the last election for the Board of Asses- sors be supplied to them. Licenses Mark Gallant was present to present the request for a Common Victualler's License for Star Enterprises at 87 Walkers Brook Drive. He indicated that the intention to convert the service bays to a convenience store, at a cost of approximately $150,000. There will be no seating, but fast food will be provided. There will be no exterior changes. The cooler area will be used for employees only. They have the approval of the Community Planning and Development Commission and Conservation Commission, and have filed for Board of Health approval and a building permit. There was a motion by Nigro, seconded by Russell, granting a Common Victualler License for Star Enterprises operating a business at 87 Walkers Brook Drive to prepare and/or sell fast food items similar to and including hot dogs, sandwiches, nacho chips, soft drinks, coffee and tea.. An amendment to the motion by Ziegler, seconded by Nigro, limited the hours for the Common Victuallers License from 6:00 a.m. to midnight. The amendment to the motion was approved by a vote of 3-2-0, and therefore, that was approved as the main motion. The Town Manager indicated that One Day Liquor Licenses have been issued for Masonic Building Association for 10/28/89, 11/18/89, and 11/27/89. Discussion/Action Items Chairman Bernice Herrick and Vice Chairman Pat Driscoll from the Depot Task Force appeared. Ms. Herrick read a memo of 10/19/89 outlining the recommendations of the Task Force. She indicated that the sticker program had sold $7,630 worth of stickers from 2/2/89 to current. There had also been $17, 580 in violations collected. Ms. Herrick also read a letter from the Commissioner of the Massachusetts DEP outlining the procedure for wetlands ap- provals, and read a letter from the Reading Chamber of Commerce requesting thirty days deferral of action. Pat Driscoll read a memo that was distributed to the Board of Selectmen. On motion by Russell, seconded by Nigro, the Board voted to reconsider their action of 7-18-89, instructing the Town Manager to sign an agreement with the MBIA, by vote of 5-0-0. On motion by Russell, seconded by Nigro, the Board voted to in- struct the Town Manager not to sign an agreement with the MBTA in the form currently outlined by a vote of 5-0-0. The Board agreed to the release of the following executive ses- sions which will hereafter appear in the regular minute books of Selectmen's Minutes - 10/24/89 - Page 3 the Board of Selectmen: 1/24/89 , 2/7/89 , 2/13/89 , 2/21/89 , 2/28/89, 3/7/89, 4/4/89, 4/10/89, 5/23/89, and 9/11/89. The Board reviewed the Warrant for the Subsequent Town Meeting, and took the following actions: - Article 7, motion by Ensminger, seconded by Ziegler that the Board recommend approval, 5-0-0 - Article 8, motion by Russell, seconded by Nigro that the Board recommend approval, 5-0-0 - Article 13, motion by Ensminger, seconded by Nigro that the Board recommend approval, 5-0-0 - Article 31, motion by Ziegler, seconded by Ensminger, that the Board recommend approval, 5-0-0 - Article 34, motion by Ziegler, seconded by Russell, that the Board recommend approval, 5-0-0 - Article 35, motion by Russell, seconded by Ziegler that the Board recommend approval, 5-0-0 The Chairman of the Board of Selectmen indicated that he intended to talk with the Chairman of the Bylaw Committee as to why they were making a recommendation on Article 36, and why the Board of Selectmen, the Town Manager, or the Finance Director had not been invited to speak on the Article. The remaining articles will be reviewed by the Board of Selectmen at their meeting on November 7, prior to recommendations being made. On motion by Ziegler, seconded by Nigro, the Board voted 5-0-0 to approve the use of the seal by the Reading 350th Committee, as outlined in Susan Wheltle's letter. It was also mentioned that the Chamber of Commerce appears to be using the seal without Board of Selectmen approval. Jonathan Edwards reviewed various West Side traffic issues. The Board of Selectmen requested a review of legal options vis-a-vis West Street--what can we do to alleviate the impact of Inwood, what are the programs and options? This will be presented later in the year. Gretchen Latowsky expressed her appreciation to the Board of Selectmen for dealing with this issue.
