Meeting, As needed Authority Town Meeting - November 12, 1992, Revised 3/3/03 Purpose The Audit Committee shall recommend to the Town Manager the firm of independent auditors that is to audit and report on the financial statements issued by the Town. The Audit Committee shall review the audit plan with the independent auditors and, upon completion of the audit, meet with the independent auditors to discuss the results of the audit and the annual financial reports. The terms of the ad hoc Committee shall expire on June 30, 2007, unless extended by the Board of Selectmen. Therefore you would no longer be able to use these spaces for commuter parking. The attempt here is to try to balance the need for employee and commuter paring in this area. The reason behind the change to uniform 2 hour parking is to make the regulations easier to understand, and to allow for people to come into downtown and perform multiple errands. Currently much of the downtown is 1 hour and even 30 minute parking. We have had extensive discussion with the downtown merchants and they are very much in favor of the changes. It will be an adjustment, but one that hopefully will improve the parking and business climate in downtown. I am not sure what the yellow/orange color means, and I am concerned because this is the color assigned to the area where I usually park, Northeast of the Depot and North of Woburn Street on High Street, when I drive to the station and take the' commuter rail to work (as many as four or five days per week). I would appreciate it if you would let me know whether I would still be able to park there during the day because the lots closer to the station are generally full by the time I get to the area. Also, my backup parking area, on Chute St., that I use when the above area is full, would fill up very quickly if the High St. area were no longer available, and then I would have to park even father away; and that would increase the likelihood of missing the train! My other concern is about treating all of the 2-hour parking areas as one big lot. I believe that this would discourage people from combining multiple errands into one trip, and I think that people should be encouraged to do this in order to save energy and reduce pollution. Present were Chairman Camille Anthony, Vice Chairman Richard Schubert, Secretary Stephen Goldy, Selectmen James Bonazoli and Ben Tafoya. Also present were Town Manager Peter Hechenbleikner and the following list of interested parties: Bob Frey, George Katsoufis. Discussion/Action Items Potential Improvements to Route 128/I-93 Interchange - Chairman Camille Anthony noted that the purpose of this meeting was for State transportation staff and their consultant to present information on the different components of layout of potential improvements to the Route 128/1- 93 Interchange. Bob Frey from Mass Highway noted that the best place for information is the 9395info.com website. The purpose of this process is to solve the problems at the intersection while incorporating community concerns. The specific goals are to lessen congestion, improve safety, minimize property takings and maintaining current local access. The study area is from Route 129/Route 128 in the east, Route 129/I-93 in the north, Route 128/Route 38 in the west, and I- 93/Montvale Avenue in the south. The process which could take 8-10 years is the planning study, followed by the environmental study, followed by funding, followed by final design, followed by construction. We are in the planning phase. This Interchange carries 375,000 vehicles per day on average. During the next 20 years, this is projected to increase 21% overall. With regard to the safety issue, there are a lot of accidents along with a lot of traffic but this is one of the higher accident rate sites in the State. They have reviewed 2002 and 2003 accident reports and note that there are clusters of accidents particularly where weaving, acceleration and deceleration take place. With regard to congestion, the northeast loop is a major problem in the a.m. and p.m. A demonstration was shown as to how this congestion affects the entire Interchange. The causes are we are using a very short compressed space that is much shorter than design guidelines will provide in the Interchange, weaving between intersections which are also closer than design guidelines, the eastbound Route 128 lane drop and the geometry of the Interchange is outmoded. In addition to the goals of improving traffic flow, improving safety, avoiding takings and maintaining local access, additional goals are to minimize noise and visual impact, develop a project that is doable and improve overall mobility. There are two strategies being discussed - the highway strategy and the non-highway strategy. The strategy has been to look at the different components of the Interchange, to screen options to determine what the best ones are, and then to combine options for different components in the q.& ' Board of Selectmen Meeting - June 7. 2006 - Page 2 packages. All of the components shown can be done within the existing right of way - there are a couple of minor exceptions which will be shown. There was discussion about metered access and Mass Highway will look at that. Mass Highway went over the plan views of the different components and answered questions. George Katsoufis asked if they could look at the Route 128/Route 28 Intersection, particularly the northwest ramp. The interest is in seeing if better and more direct access can be achieved to the Addison-Wesley property. Mass Highway indicated that one of the optimal solutions would be to allow for future H.O.V. lane design. There was considerable discussion on sound barriers. The area between north of West Street to east of Walnut Street and west of Walnut Street to almost Route 128 is currently being studied for Type 2 sound barrier. If project construction goes forward, then sound barriers would definitely be built as part of the project. Noise studies are being done currently. Mass Highway handed out but did not focus on the "potential transit/TDM components (5/31/06)." Comments will be accepted on these components. Resorts and Comments Selectmen's Liaison Retorts and Comments - Selectman Ben Tafoya noted that he will be attending the MAPC Meeting tomorrow, and he will support the Mayor of Woburn for a seat on the Board. Selectman James Bonazoli noted that the cemeteries are set for Memorial Day. He also noted that the Addison-Wesley Working Group is meeting tomorrow night, and he hopes to get the developer back involved in the meetings. Selectman Stephen Goldy noted that he stopped by the Police Station for their Open House. Vice Chairman Richard Schubert noted that he spent the last 21/2 weeks in Russia - his sister adopted a girl. He thanked his neighbors and friends who helped bail out his basement during the flood while he was away. Town Manaeer's Reuort The Town Manager gave the following report: • FEMA response to storm and flooding. • Bylaw on solicitors is in the hands of the AG - they have 90 days to review it before it becomes effective. • Town has received payment for the initial cost of Summer Avenue from the State - $850,000. We are working on getting supplemental funding through Representative Brad Jones' Office. • We have passed papers on the two lot Habitat for Humanity development on Governors Drive. We will keep you posted on the progress of these two homes. Ipswich River Clean-up - June 3rd (pending water level drops) - flyer attached. The Town Manager noted that the Recreation Committee wants to assign fields for Sunday mornings. The Board of Selectmen approved practices only. If the Board has any concerns about this, they should let him know. Vice Chairman Richard Schubert asked if the abutters will be notified, and the Town Manager noted that they will. Proclamations/Certificates of Appreciation Proclamation - Bov Scouts 90t" Anniversarv - Pat Iapicca, Assistant Scoutmaster for Troop 702, Steve Phillips, Mike Iapicca and other Boy Scouts were present. They presented the Board of Selectmen with a 90th Anniversary neckerchief. A motion by Goldv seconded by Bonazoli to approve the Proclamation for the Bov Scouts Troop 702's 90th Anniversarv was approved by a vote of 4-0-0. Personnel and Appointments Economic Development Committee - Selectman Ben Tafoya recused himself from the meeting. The Board interviewed Meghan Young-Tafoya for one position on the Economic Development Committee. Goldv moved and Bonazoli seconded to place the following name into nomination for one position on the Economic Development Committee with a term expiring June 30. 2007: Meehan Young-Tafova. Mrs. Tafova received four votes and was appointed. Selectman Ben Tafoya rejoined the meeting. Discussion/Action Items Hearing - Water and Sewer Rates - The Secretary read the hearing notice. Public Works Director Ted McIntire and Business Administrator John Sousa were present. The Town Manager noted that the rates are for water use starting now and then billed in September. Ted McIntire noted that the recommendation is based on the budget approved at Town Meeting. The Water, Sewer and Storm Water Management Advisory Committee met last week. They are recommending seasonal rates for water. He also noted that the Water Conservation Program has been successful. He reviewed the sewer rates, reserve funds and seasonal rates for water. The Town Manager noted that the rates are based on MWRA's most recent estimates. The sewer costs of the MWRA should come in lower than projected. The MWRA votes their budget at the end of June. 6 ay Board of Selectmen Meeting - Mav 23, 2006 - Page 3 Selectman Ben Tafoya noted that the consumption is flat but there is an increase in costs. He asked if that is for MWRA bonding. The Assistant Town Manager noted that this is not the full impact for the first year. None of the MWRA or Water Treatment Plant costs are included in these rates. The capital is projected very low but the debt is high. A motion by Goldv seconded by Tafova to close the hearing on the water and sewer rates for FY 2007 was approved by a vote of 4-0-0. A motion by Goldv seconded by Tafova to set the Summer water rate effective with the September 10. 2006 billing at $5.69 per 100 cubic feet with a minimum billing-- of $11.38 was approved by a vote of 4-0-0. A motion by Goldv seconded by Bonazoli to set the Winter water rate effective with the March 10, 2007 billing at $5.45 per 100 cubic feet with a minimum bill of $10.90 was approved by a vote of 4-0-0. A motion by Goldv seconded by Bonazoli to set the sewer rate effective with the September 10, 2006 billing at $6.06 per 100 cubic feet with a minimum billing of $12.12 was approved by a vote of 4-0-0. Hearing - Increasing Permit Fees - The Secretary read the hearing notice. The Town Manager noted that we will be funding the Permits Coordinator's position by increasing fees. The Community Development fees last year were $504,000, and we need to raise approximately $11,000 to fund this position. The Town Manager noted that the Selectmen are responsible for building permit fees. The ZBA and Conservation Commission adopt their own fees. The increase in the building permits is $1.00 per $1000. The comments from the builders are that Reading's fees are low. Vice Chairman Richard Schubert noted that the goal is to enhance services. The Town Manager indicated that we will also purchase software. He noted that with the demolition delay, the West Street Historic District, etc., the whole process is getting more complex. Selectman James Bonazoli indicated that he thought we would just buy the software and staff would handle it. The Town Manager noted that we don't have the staff capability. Senior staff is spending a lot of time at the counter when they could be working on the Master Plan implementation, etc. Selectman Stephen Goldy noted that a lot of the applicants who came before the Conservation Commission were frustrated over the process. This is a very important position. They would prefer to have the signs located anywhere Downtown except on the Common. The signs will be for Reading based non-profit organizations. There will be no commercial advertising or logos. The size will be 2.50' x 3.50', and the size of the letters will be a 2" minimum and will be professionally designed. The signs will be inserts. The time restriction will be no signs two weeks before the Election, otherwise the duration will be two weeks. The Town will be able to use the sign to advertise water restrictions, Compost Center hours but the primary purpose is for non-profits. There will be one sign on Main Street and one on Lowell. A permit will be required. Vice Chairman Richard Schubert noted that we will probably need to define non-profits. The Town Manager noted that this is not for making a statement - it is for advertising events. Selectman James Bonazoli asked about sponsorship. The Town Manager noted that there are other ways for sponsors to advertise. The Board of Selectmen had indicated previously that there be no logos but it is okay for the sponsors. Selectman Stephen Goldy and Vice Chairman Richard Schubert noted that they agree with no sponsored by and no logos. Selectman James Bonazoli indicated that he feels if a company is sponsoring, then we should help them. Selectman Ben Tafoya noted that there are other ways to advertise; i.e., cable TV, newspapers, at events, etc. It is not appropriate to use the Common for showing sponsorship or logos - it is not a billboard. The Town Manager noted that this has only been a problem with one company. The Town Manager noted that he intends to install the signs on the Common. When the Downtown project is done, then he will look at other locations. a9 Board of Selectmen Meeting - May 23.2006 - Page 7 Policy on the Land Bank Committee - The Town Manager noted that the Land Bank Committee was established by the Town in 1966 but there was no charge to the committee. He is suggesting a five member committee including people who have experience with land records, experience with legal proceedings involving land transactions, knowledge of the community, experience with information technology and its uses in records management, and knowledge of and experience with local government in Massachusetts. The charge of the committee will be to catalog and maintain information for all Town owned land and easements, research on property that the Town may want to purchase, and he will add perambulation of the Town boundaries to the charge. Selectman Stephen Goldy suggested keeping this as a three member committee instead of five. Report - Nurse Advocacy Task Force - Elder Services Administrator Dawn Folopoulos, Task Force Members Paula Kopel, Ann Marie Bourque and Housing Authority Executive Director Lyn Whyte were present. Ann Marie Bourque noted that the Task Force did a survey. There were 202 responses 71% were over 75 years of age and 58% lived alone. The survey showed that the coordination of health services and understanding doctors explanations and medications is needed, and 81% would take advantage of the Nurse Advocate. She also noted that the Task Force was split on funding between free or sliding fee. The Task Force is asking for an extension of time to work out the issue of funding. Selectman James Bonazoli noted that Winchester and Andover have a Nurse Advocate. He also noted that the Task Force will meet with the Hospital Trust Fund Commissioners. The Town Manager asked if other agencies provide this service, and Selectman Bonazoli noted that they do not at the level of tracking and ongoing support that is needed. Paula Kopel noted that Reading Response provides funding for lifeline and health aides. Selectman Stephen Goldy asked if the Winchester and Andover Nurse Advocates were Town staff. Selectman James Bonazoli noted that Winchester is staffed and Andover is contracted. The Town Manager noted that community acceptance of Town staff is strong. Selectman Bonazoli noted that there is also a group who fear the Town. Paula Kopel agreed with Selectman Bonazoli, and noted that there are ways to work around that. Selectman Ben Tafoya noted this would be an expenditure of tax payer money, and there would have to be a good reason why we are not using Town staff. Selectman James Bonazoli noted that this should be open to all seniors and not limited to income. The Town Manager noted that there needs to be a definition of needy. Respectfully submitted, Secretary 7 IN June 6, 2006 Dear Town of Reading, W/S Development did not pursue the article to rezone Addison-Wesley property at the recent town meeting. Instead, we are working with the town's Working Group to make modification to the original plan. In March 2006, Town officials formed a "Working Group" to include Reading town officials, W/S Development, neighbors to the property and others to work together to make modifications to the plan for Park Square at Reading. As a result of comments by neighbors, officials and others, W/S Development has proposed the following changes. None of these changes are finalized. • Increase the minimum building setback in the residential zone by 100%, from 50 to 100 feet. • Move the driveway at the main entrance toward the highway away from South Street homes. • Reduce retail square footage by 20%, from 400,000 to 320,000 square feet. • Prohibit stores from being larger than 63,000 gross square feet to prohibit "big box" stores. • Add an additional 70,000 square for a health & wellness center, which would house medical offices and a fitness center. • Add mixed-uses options if the Town would like; a small park for families including a play area, community room for use by local organizations and groups, outdoor performance areas and pedestrian pathway that allows neighbors to walk to the property. Some of the members of the Working Group have asked us to consider a residential component on the northwest side of the property closest to South Street but that is still undecided. We expect the details of Park Square at Reading will continue to change. We want you to know that we are committed to working with you and your neighbors to screen our development from your homes. Hoyt Dear Mrs. Hoyt: C COMMUNITY DEVELOPMENT The CFDC has received and reviewed your above referenced letter. At the May 22, 2006 CPDC public meeting, we discussed the letter in detail. We appreciate your input and concern over the issue of constructing buildings that do not fit with the character of Reading. We hope that you will continue to provide comments on future issues that the CPDC undertakes. In response to the specific issues raised in your letter, we share in the same sense urgency to prevent these types of 40B housing projects, which do not meet the Town's standards. However, we do not believe that amending Zoning Bylaw dimensional constraints would regulate these developments in the future. Massachusetts General Law Chapter 40B allows for low or moderate income housing developments to bvl)ass local zoning requirements if low or moderate income housing does not, equal or exceed ten per cent of the housing units reported in the latest federal decennial census of the town. The Zoning Board of Appeals did not have jurisdiction to impose Town requirements on the Archstone development because Reading does not have ten per cent affordable housing, as required. The CPDC agrees that Zoning Bylaw amendments are needed to protect the Town from "40B developers". The recently adopted Reading Master Plan includes a chapter dedicated to Housing. In that chapter, a number of goals and objectives are identified, including Goal #2 which is targeted specifically to increase affordable housing. The CPDC has been working to define Zoning Bylaw amendments that include affordability components as a means to meet the state mandate. Last fall we were successful in the adoption of a mixed-use bylaw that included an affordable component. Currently we are investigating other bylaw changes to increase the affordable housing stock including the use of categorized Accessory Apartments and cluster zoning. Additionally, the CPDC is considering the adoption of more formal Design Standards to use as aesthetic guidelines incorporated into the Site Plan review standards. As you know, the position of the RHC has long been that signs other than historical or identification types are not an appropriate element of the Town Common landscape. True preservation of the Common would see an open expanse of green space, through which the important focal points of our town center would be visible and sightlines would be unobstructed. There would be no encroachment of the Common by automobile traffic, stop lights, sidewalks, or shrubbery. As the only Town body charged with protecting local historical landmarks such as the Common, it is the RHC's duty to work toward this preservationist ideal. Having said that, please understand that the RHC also recognizes the periodic need for constructive change. The RHC has been willing to compromise the integrity of the Common in order to maximize the benefits to the Town in the form of a re-developed town center, and more logical traffic flow. However, the RHC does not support placing permanent signs on the Common and suggests that the unappealing sandwich boards presently allowed, be replaced with new, more appealing temporary signage. In addition to the strict preservationist argument, the RHC also feels that there are business reasons not to put permanent signs on the Common. First, there is a question as to the effectiveness of the signs in advertising their events. The very permanence of the signs themselves may cause them to become "invisible" over time, as opposed to the eye-catching, if untidy, nature of the temporary sandwich boards. Second, alternative placement of the signs has not been fully explored. There may be more effective advertising sites in town. This is an idea that might be best considered within the process of designing the new public spaces created by the downtown redevelopment plan. Input from the organizations which use the Common to advertise their events would be invaluable. The RHC will be pleased to participate in the process of seeking alternatives during the downtown improvement project. Third, it is not clear that the demand for use of the Common for advertising is due to any inherent quality of the Common, but perhaps because that is simply where we have become accustomed to seeing signs. As the RHC discussed in the meeting with Peter, the Commission could reluctantly accept one new advertising sign-on the Common if it is agreed that the sign will be there temborarily until a more appropriate site is identified. Peter hag agreed to revisit this issue of moving the sign if placed on the Common in the near future, but cannot commit to ultimately having it moved- The installation of one new sign should be undertaken as an experiment to determine the effectiveness of its advertising potential, and the amount of visual and physical intrusion it effects on the Common. This compromise is based on the premise that a second sign for advertising events not be considered for the Common. Further, the RHC strongly recommends that the RMHS school achievements sign that currently stands on the Common be moved to a more appropriate location, perhaps on Main St. nearer the high school. Finally, the RHC asks that greater adherence to the guidelines governing the use of the Common, as adopted by the Selectmen in 1991, be utilized in the future to guard against the constant encroachment pressures to the Common. Inc., will be replacing the Water Main on Auburn Street, from Bancroft Ave. to Beacon Street.. This is part of the Town wide water distribution system improvement program. Construction is scheduled to begin on Monday, June 26, 2006. Auburn Street will be closed to thru traffic during construction hours. Only local residents and emergency vehicles will have access to Auburn Street, depending on the location of the excavation, this access will be from Beacon Street, Parkview Road, Chestnut Road, or Bancroft Ave. Due to the narrow width of Auburn Street, vehicular traffic through the construction site will not be possible. This excavation will limit access to. driveways and on street parking in the construction area. Prior to construction, residents will be notified when the area in front of their house will be affected so that vehicles can be moved and not blocked in by construction. The excavation will be filled in and the street made passable at the end of each day. All residences will be notified prior to any planned water service shut downs with water service being restored as soon as possible. If the AW site were really to become a lifestyle center, the composition should be similar to what exists in the center of many towns. The specific item that could be overlooked includes an office segment consisting of doctors, attorneys, engineering firms, accountants, and other service providers. I still think that retail is not the best option for that space and hope that doesn't become a reality. I realize that it would be nice to have additional revenue from that site and believe that can be realized without creating a mall. I'd still like to see commercial utilization in that space. As you can see by the attached article, the. Massachusetts Supreme Court handed down a ruling regarding 40B developments. In short, this ruling states that 40B development approvals cannot be overturned simply due to the fact that 40B developments may lower housing values for abutting neighbors. The Supreme Judicial Court, in a decision issued Friday, rejected arguments by opponents of a planned Andover apartment building who said its construction would negatively affect their property values. The decision removed a key barrier for developers of affordable housing projects, particularly in the suburbs, where such development often faces strong opposition. Boston real estate attorney Richard Vetstein said the court's ruling was significant ' ' because it's been a long time since the SJC has issued an opinion as comprehensive as this" on an affordable housing project. He said it ' ' levels the playing field for developers." Under the state's 40B law, a developer may override most local zoning provisions in a city or town if the municipality does not meet the state's 10 percent minimum requirement for affordable housing stock and a certain percentage of the units in the proposed development are priced to meet the definition of ' ' affordable" in that community. In the Andover case, a developer in 2002 proposed a four-story building in which 25 percent of the units would be classified as affordable. The court ruled that the Legislature intended for 40B ' 'to provide relief from exclusionary zoning practices which prevented the construction of badly needed low- and moderate-income housing." We would be proud to have the portions of Main Street (Route 28) in Reading included in this designation. Bob Sansone has worked on this designation with a great deal of enthusiasm, and has included former Celtics great Bill Russell in this discussion. While we would have preferred the designation of Route 28 as Bill Russell Way, he apparently is too modest a man to want this designation, but has endorsed the designation of Tolerance Way. Tolerance among different people in the Commonwealth would be a great legacy to honor Mr. Russell. I am unable to be at the hearing today on this matter; but wanted to weigh in on the matter. The Friends of Reading Recreation (FORR) was established.to seek private sector donations to enhance the recreational and leisure opportunities in the Town of Reading. We have been working with John Feudo in the Rec Dept. He has been very instrumental in getting us started. An example of the kind of events we support was our 1 st Annual Kids Fun Run this past Saturday. We had over 150 kids run the race just before Town Day in Memorial Park.
