BOARD OF SELECTMEN MEETING

4a) Move that the Board of Selectmen close the hearing for Bagel World's
request to operate beginning at 5:30 a.m.
Move that the Board of Selectmen finds that it is in the interest of the
public health, safety, and welfare to permit retail operations of Bagel
World to operate between the hours of 5:30 a.m. and 6:00 a.m. contrary
to the provisions of section 5.10 of the Reading General Bylaw; and
The Board of Selectmen does hereby grant approval pursuant to Section
5.10 of the General Bylaws to Bagel World, 323 Main Street, to allow
them to begin retail operations at 5:30 a.m. This approval shall expire
on December 31, 2007.
4b) Move that the Board of Selectmen close the hearing for West Street
Mobil request to operate beginning at 5:00 a.m.
Move that the Board of Selectmen finds that it is in the interest of the
public health, safety, and welfare to permit retail operations of West
Street Mobil to operate between the hours of 5:00 a.m. and 6:00 a.m.
contrary to the provisions of section 5.10 of the Reading General Bylaw;
and
The Board of Selectmen does hereby grant approval pursuant to Section
5.10 of the General Bylaws to West Street Mobil, 2/4 West Street, to
allow them to begin retail operations at 5:00 a.m. This approval shall
expire on December 31, 2007.
4c) Move that the Board of Selectmen close the hearing on no parldng on
both sides of Washington Street 50 feet south of Woburn Street and 50
feet north of Prescott Street.
Move that the Board of Selectmen amend the Town of Reading Traffic
Rules and Regulations by adding to Article 5, Section 5.3:
"PARKING PROHIBITED ON CERTAIN STREETS NO PARKING ANY TIME -
50 FEET FROM INTERSECTION"

Romano's Macaroni Grill from Michael Ross to Sao Ngoc Huynh.
5a) Move that the Board of Selectmen approve the minutes of November 14,
2006 as amended.

March 28, 1995, for the Town of Reading, are hereby amended by adding to
Article 5, Section 5.3 the following regulation (s).

The Massachusetts Technology Collaborative ( "MTC ") is writing to inform you that it has increased the
amount of the grant awarded to Reading under the Waste to Energy ( "WTE ") Grant Program. MTC
awarded a grant in March 2001 to help offset increases in waste disposal costs attributable to
environmental upgrades undertaken at the waste to energy plant located in Saugus. This communication
shall serve as a final notice and reconciliation of grant funding awarded by MTC through the WTE
Grant Program.
The increase in the grant award represents your pro rata share of unallocated funds remaining at the
conclusion of the WTE Grant Program. Attached you will fmd a WTE Grant Requisition and
Acknowledgement Form (the "Requisition Form ") for the payment of grant funds you are currently
eligible to receive. Please note that this is the final payment from the WTE grant.
Please complete the following steps:
1. Review the wire transfer information for the account previously designated the municipality by
to receive the grant funds. If any information is missing or inaccurate, please provide the correct
information in the designated portion of the Requisition Form. If you elect to designate a new
account to receive the grant funds, please provide the account information and attach a separate
letter requesting that the account of record be changed.
2. A duly authorized municipal official must provide the requested contact information, sign and
date the completed Requisition Form, and return it to the address listed below.

Dear Gentlepersons of the Board,
The Trustees upon instructions from the forty residents of
Briarwood Estates Condominiums are writing this letter to express our
support for amended the traffic rules so that no parking is allowed on
the West Side of Washington Street from Woburn Street to the Briarwood
Estate Condos. The Trustees feel that Washington Street from Woburn
Street to the condo complex is too narrow to allow parking on both
sides of the Washington Street. Several residents have experienced
problems when traveling on Washington Street when cars are parked on
both sides of the street.
The Trustees and the residents are further very concerned that
emergency vehicles will be unable to get down Washington Street and
into our Condo complex if parking is to be allowed on both sides of
Washington Street. Residents, both young and old, have expressed
concern about the personal consequences that any delay in the delivery
of emergency services could have.
There are also concerns about the possible inability of snow
removal vehicles to access Washington Street in order to plow and sand
both Washington Street itself and our Condo Complex.
The Trustees have polled the forty residents who live at
Briarwood. The forty residents, which include the 3 Trustees, have
unanimously expressed support for this proposal to allow parking only
on one side of Washington Street.
The Trustees thank the Board, the Town Manager and the Police
Department for their attention to this matter.

Aa direct abutters the property at 43 Salem Street, we are writing to express our concerns regarding the
project. We were notified of a public hearing scheduled for this evening, but unfortunately, vva are unable to

We are not opposed to this project, We feel that, in some ways, the project is beneficial to the neighborhood. We
were aware that a developer had purchased the property. Through visits to the Building Department, and
discussions with staff there, we were assured that the project met all local regulations, and that it could be built
by-right. What was not apparent on any of the permit drawings was the amount of fill to be imported to the site, or
the retaining walls necessary to contain the fill on the property.
The Board may recall that the original dwelling on the property was in the northwest corner of the site, near the
intersection of John and Salem Streets. This allowed for the majority6f the larger southern portion of the site to
be lawn. This lawn area was at a lower elevation than that of the surrounding properties. In many springs, and
most notably last May, water ponded in this area until such time as the groundwater levels subsided. Surface
runoff from the site, and from portions of the surrounding properties discharged to this low area.
Unoeretandab|y, the new dwelling has been built closer to the middle of the lot, and the garage/basement floor is
several feet above the elevation of this ponding area. Fill brought in beneath the dwellingand rear driveway
consisted mainly of blasted ledge and crushed stone. If placed at the appropriate elevations and quantities, this
material should provide storage volume to compensate for that lost during the filling operation (and to recharge
runoff from the larger roof area and paved surfaces). We are unaware, however, of any such specifications for
this project.
HU was also imported to be placed around the new foundation to create "front" and side yard areas. The
driveways which are the subject constructed unthese filled areas. grading
correctly directs surface runoff away from the new foundation. |n doing so, however, some surface runoff |o
directed onto adjacent properties with no apparent mitigation.
The stone retaining walls constructed to hold the fill on the property appear to be within a foot or two of the
property lines. If these walls were unavoidable, we could understand their presence. Unfortunately, in the case
of the wall closest to our property, we do not feel that it is absolutely necessary. An alternate grading
scheme/foundation plan could have eliminated the need for this wall entirely, and eliminated or minimized the
filling of the low area.
In visiting the Building Department to review the permit documents, we tried to satisfy ourselves that this project
would not negatively impact us and our neighbors. We also relied on the professional staff and Town Boards to
help in this regard. We are disappointed that we, and possibly the Town, were not provided with sufficient
information for such an assessment in this case, and that we were not provided the opportunity to discuss these
potential issues at the appropriate time in the process. .
We are willing to discuss these issues with the Town and the developer if necessary. Thank you for your

I am the current resident at the property that sits opposite the project at 2 -6 John Street.
It is of my opinion that the additional driveway that has been constructed on John Street
has no detrimental effect on traffic flow in and out the intersection between John Street
and Salem Street. I also feel that having the two driveways will make the property more
visually appealing and add to the appearance of the neighborhood.
Therefore, it is my wish that the Reading Board of Selectman grants the waiver of
driveway regulations and allows 2 driveway openings on John Street in addition to the
Salem Street driveway.
