HomeMy WebLinkAbout2009-03-31 Board of Selectmen Minutes - Executive Session Board of Selectmen Meeting Executive Session March 31, 2009 The Executive Session convened at 7:02 p.m. in the Town Hall Conference Room, 16 Lowell Street, Reading, Massachusetts. Present were Chairman Stephen Goldy, Vice Chairman Ben Tafoya, Secretary James Bonazoli, Selectmen Camille Anthony and Richard Schubert, Town Manager Peter Hechenbleikner, Assistant Town Manager/Finance Director Bob LeLacheur, Town Counsel Gary Brackett, Public Works Director Ted McIntire, Water Distribution Supervisor Peter Tassi, Consultani George Naslas and Office Manager Paula Schena. LitilZation AGFA Town Counsel Gary Brackett noted that the Town went into the mediation asking for $134,000. AGFA started at $46,000 and then went up to $100,000. The final settlement amount is $125,000 with the stipulation of dismissal with prejudice. The amount will be paid in four installments with the first 25%being paid within 30 days of the filing of Stipulation of Dismissal with Prejudice. The remaining payments will be in 90 day intervals. The Town accepts the remediation program identified in Phase III and Phase IV. The Town accepts submission of Class C Remedial Action Outcome, and the Town terminates the public involvement plan on conditions. Consultant George Naslas noted that AGFA had a release of volatile compounds and all of the DEP documents go back to AGFA. They have cleaned up their site and will monitor the plume over time. Selectman Camille Anthony asked if the contamination is low because we are not pumping water, and Mr. Naslas indicated that is correct. The.Town Manager noted that the Town cannot go back against them but the Department of Environmental Protection can. Mr. Naslas noted that we will reference the Civil Action Number and tracking number on the Release Scope. Selectman Richard Schubert asked if private property owners have access to this information, and if they have been notified of the contamination. The Town Manager indicated that this is all a public record. Mr. Naslas noted that the neighbors who are close to it are aware and were notified. A motion by Bonazoli seconded by Tafoya to approve the settlement in the amount of $125,000 between the Town of ReadinLy and AGFA related to the contamination of the revay well and the recovery expenses related thereto was approved on a roll call vote with all five members voting in the affirmative. Board of Selectmen Meeting—Executive Session—March 31, 2009—Page 2 Industri-Plex Superfund Site The Town Manager noted that the Board needs to approve the subordination agreement for the sewer line that runs though the Industri-flex site. A motion by Anthony seconded by Tafoya to approve the subordination agreement regardiniz the Industri-Plex Superfund site in Woburn and authorize the execution of the agreement was approved on a roll call vote with all five members voting in the affirmative. On motion by Bonazoll seconded by Tafoya to adjourn the Executive Session Meeting of March 31, 2009 at 7:38 p.m. was approved on a roll call vote with all five members voting in the affirmative.
