• With the passing of former MA Supreme Judicial Court Justice Francis P. O'Connor, the
Governor requests all flags (the Commonwealth, the US Flag and any pennants or flags
flown with them) be lowered to half staff until sunset on the interment of Justice O'Connor on
Tuesday, August 7, 2007.
• AWP development / National Development. DHCD meeting last Thursday, followed by a site
visit on Friday. DHCD has indicated support for a 40R project at that location. The State needs
to fund the 40R program.
• New web page is up and operating. Comments or suggestions are welcome. Address is the
same as previously - www.ci.readinci.ma.us
• Franklin Street sidewalks are under construction.
• The following road construction projects are on-going: Hampshire Rd., Lawrence Rd. and
Governors Drive
• The State has turned down our request for a left turn northbound arrow on Main at Franklin
Streets.
• We got our final audit of the Barrows School project. All involved did a great job, and Town
Accountant Gail LaPointe was able to get us some additional money out of the project by
challenging some of their initial findings.
• We have gotten State approval for the 17 affordable housing units at Johnson Woods - Phase 1.
• The final 1-93/1-95 Interchange report is now available on their web page.
Governor Patrick signed some of what was in the initial "Municipal Partnership Act" dealing with
pensions (we already are part of PRIT), and allowing communities to join the GIC. We are
already exploring the GIC option through some information sessions. The earliest a community
could get into the GIC (except for those where special legislation may expedite the process) is
FY 2010.
Tennis Court discussion
• The Water Resources Commission voted last month to approve Reading's application to fully
join the MWRA for its water supply. After that, the only requirements are a vote from the MWRA
Advisory Board in September, and the MWRA Board in October.
• The surveyors and survey marks around downtown are from representatives from the State
Highway Department getting ready to do the Downtown Improvement Project construction.
• We have a problem with the elevator at the Library - the major piston gave way and leaked
about 55 gallons of hydraulic fluid. It will take about 6 weeks and $30,000 to repair. The work
order has been processed. We appreciate the assistance of patrons during this outage - it is
tough on patrons and staff.

I'll be there on Thursday afternoon, and expect that we will have made substantial progress on the application.
We can review it at that time.
It is great that we now have a green light from DHCD on the issue of eligible location, and we are now
continuing preparation of the 40R application. My understanding of the general timeline through the end of
August is as follows:
August 9 - working meeting to review draft application, bylaw; receive feedback from Town Planner and
others
August 13 - meeting with the CPDC in the evening; discussion of draft 40R materials and anticipated
local and state 40R review process
August 16 - 40R application including bylaw, maps etc placed on file with the Town Clerk
August 16 and 23 - public hearing notice to appear in the local paper announcing availability of 40R
application for public inspection (typically at the Town Clerk, Planning Board and Board of Selectmen
office, and sometimes at the public library)
August 28 - Board of Selectmen public hearing to consider whether to submit 40R application to initiate
state review process
End of August - if directed by Selectmen at 8/28 hearing, submittal of 40R application to begin 90-day
state review process
I hope this is helpful so we can continue to coordinate as the process moves forward. Let me know if any of the
above dates are other than I've set out, but in any case it is a good outline.

Chief,
Sorry for the delay in responding to your inquiry re: George Z's comments.
To my knowledge, there is no public safety exception which would allow the town to enter a sight triangle, which is
private property, to clear it. There is however a long line of cases re: defects in the way, which cases hold that
any obstruction in the ROW can be removed by the town in order to keep the street safe for travel.
What this means is that overhanging tree branches, shrubs, etc. can be trimmed back if they block signs or traffic
lights, force people to walk in the street, etc. or create any other public safety hazard. I don't however interpret
these cases to allow the town to enter private property, but if it extends onto the way, they can trim back so much
as to make the way clear.

Thank you for the information on the board, that is helpful. George thought there was some type of Public
Safety exception that would grant the town, or the PD the authority to clear a sight triangle under the authority of
Public Safety. Have you heard of anything like that?

Chief,
Based upon our conversation last week about the site triangle issue, is my memory correct that
George Z thought, but wasn't sure, that the Board of Selectmen possessed some broad power to
make orders to promote public safety issues without the benefit of a bylaw? Because if that was
the substance of his statements, it is not correct. The Massachusetts Home Rule Amendment
grants broad powers to local boards over local matters, but. only. by the adoption of a bylaw which
is not inconsistent with either the constitution of other general laws. In other words, the
Selectmen can only regulate site triangle issues, if the town passes a bylaw.. There is no broad
based authority for the board to simply render decisions about public safety issues.
Let me know if I've captured the statement accurately.

Dear Mr. Hechenbleikner and Board Members:
I am writing to voice my strongest support to the proposed parking restrictions on California Road and Indiana
Avenue. The current situation of uncontrolled parking creates several significant public safety hazards.
1. The reduced visibility greatly increases the possibility of a motor vehicle vs. pedestrian collision when cars
are attempting to navigate through cars parked on both sides of these streets. This risk is further increased
by the large numbers of children waking in and crossing these streets during the hours of the proposed
restrictions.
2. The reduced width of the travel lane created by this uncontrolled parking would make it difficult, if not
impossible for a police cruiser, ambulance or fire apparatus to pass in a timely manor when there is an
emergency in this neighborhood. (I will also point out that Indiana Avenue does not have any fire
hydrants.)
Although my wife and I would be inconvenienced by this restriction (as we would not be able to park in front of our
own house during these hours) we feel that the choice of imposing the restriction on the East side of Indiana
Avenue would impact the fewest residents of this neighborhood. (We are, in fact, the only even numbered
address on Indiana Avenue.)
I would also respectfully request that the board carefully consider the wording of any such restriction to that not
only unattended parking be prohibited, but also Live Parking, stopping and standing also be included, as these
would have an equally negative effect on safety.
