1 c) Under Town Manager's Report, I will give an update of the downtown project.
3) Interviews are scheduled for a number of positions primarily within the Community
Services area.
4b) Following up on the discussion on site walk attended by James Bonazoli, the Town
Engineer, Acting Police Chief, the Safety Officer and myself, we are proposing parking
regulations related to the fire lane access to the Birch Meadow School and parking
restrictions on the opposite side of the street.
4c) We took bids on Friday for the artificial turf field at Collins Field. The bids came in just
slightly below the previous bids, but there is no problem with specifications. It was a
good competitive bid with 10 firms bidding. George Zambouras is preparing a lnerno
summarizing the bids and the current level of funding available.
4d) A conservation restriction has been negotiated by the Conservation Commission and the
State for the property at 26R Summer Avenue and Willow Street. This is the "so called"
Fulgoni property and all issues are now resolved and the conservation restriction is now
ready for the approval of the Board of Selectmen.

Purpose To advise the Board of Selectmen on matters of policy related but
not limited to the "Cities for Climate Protection" Program for use

will: Conduct a local emissions inventory of greenhouse gas
emission. Recommend an emissions reduction target. Identify local
actions that achieve the target. Develop a proposed implementation

COUNCIL ON AGING
Term Three years
Appointing Authoritv Board of Selectmen
Number of Members Ten Members whose terms are so arranged that as
nearly an equal number of terms as possible shall
expire each year. All members shall be inhabitants
of the Town and at least two members shall be over
60 years of age.
Meetings Regular meetings are held on the second Monday of
each calendar month at 6:30 p.m. unless a legal
holiday when the meeting will be held the following
Monday unless otherwise designated.
Authority Reading Charter - Adopted March 24, 1986
Purpose The Council on Aging shall have all the powers and
duties given to Councils on Aging by the
Massachusetts General Laws, by the Reading Home
Rule Charter, by Bylaw or by Town Meeting vote.
Included are the following: To ascertain needs of
residents 60 and over, to conduct and sponsor
programs and disseminate information addressing
those needs, to directly assist individuals and to be
advocates for the elderly of Reading at the
community, State and National levels.

I have served on the Economic Development Committee for one year as an Associate
Member and approximately one year as the Finance Committee Liaison. The Economic

Re: Conservation Restriction, 26R Summer Avenue and Willow Street
The Conservation Commission is pleased to submit the attached Grant of Conservation
Restriction for your consideration.
The site to be placed under restriction is a 2.64-acre portion of a 3.88-acre parcel of land
that has frontage on Willow Street. A single-family house has been permitted and is
under construction within the remaining unrestricted portion of the lot, with access
through a driveway easement over #26 Summer Avenue. The site has been the subject of
a lengthy approval and appeal process under the Zoning Bylaws, and final approvals have
been secured at this time.
The portion of the site to be placed under Conservation Restriction includes the stream
channel of the South Branch of the Aberjona River and all land north of the River except
for a small area on Willow Street where a parking lot has been constructed to meet
Zoning requirements for access and frontage.
The conservation values of the area to be restricted are set forth in Section I on pages 1
and 2 of the Grant. The final page of the Grant is a site plan showing the site boundaries,
the stream, the area to be restricted, and adjacent parcels and roadways. A map is
attached to this memo that shows the site location, the abutting Town-owned parcels in
the Thelin Sanctuary, the wetlands, and other characteristics of the neighborhood.
The Conservation Restriction is required by a condition of the Order of Conditions issued
for construction of the house in 2006. The Restriction is also required by the Natural
Heritage and Endangered Species Program to protect endangered species habitat.
The owner of the property, Kevin Fulgoni, and the Conservation Commission have
accepted the Conservation Restriction and signed the Grant. We request that the
Selectmen will also vote to approve the Restriction, sign the Grant on page 12, have the
signatures notarized, and then return the Grant to the Commission. If you have any

TO THE
TOWN OF READING
I, Kevin Fulgoni, Trustee of the Dennison-Magnus Realty Trust, under declaration of trust
dated July 6, 1984, recorded with Middlesex South District Registry of Deeds in Book 15671 Page
115, and the successors and assigns of the Dennison-Magnus Realty Trust (hereinafter referred to as
the "Grantor"), acting pursuant to Sections 31, 32 and 33 of Chapter 184 of the General Laws of
Massachusetts, grant, with Quitclaim Covenants, to the Town of Reading, acting through its
Conservation Commission, a duly constituted municipal corporation having its usual place of
business at 16 Lowell Street, Reading, Massachusetts, 01867, and its successors and permitted
assigns ((hereinafter referred to as the "Grantee"), by authority of M.G.L.c. 40 §8C, in perpetuity
and exclusively for conservation purposes, the following Conservation Restriction on the 2.64-
ACRE portion of a 3.8857-acre parcel of land located in the Town of Reading, Massachusetts, said
parcel being described as:
The areas shown as "Conservation Restriction Area" (hereinafter referred to as the
"Premises") on portions of the parcel (hereinafter referred to as the "Property") shown as
Parcel 19 of Reading Assessors Map 81, located on Willow Street, and shown on a plan of
land entitled "Sketch Plan Of Land in Reading, Mass. Showing Proposed Conservation
Restriction Area", prepared by Hayes Engineering, Inc. signed and stamped by Peter Ogren,
RPE, dated January 23, 2007, last revised August 29, 2007. Said Premises contain 114,000
square feet according to said plan and are more particularly described as set forth in
Exhibit "A" attached hereto and incorporated herein by reference. Said Premises and
Property are more particularly described as set forth in Exhibit "B", plan entitled "Sketch
Plan of Land in Reading, Mass. Showing Proposed Conservation Restriction Area." attached
hereto and incorporated here in by reference.
For Grantor's title see Middlesex South District Registry of Deeds Book 24718, page 64. Some of
the boundaries of the Premises have been staked with stone or concrete bounds as delineated in the
above-referenced plan. This Grant of Conservation Restriction is required by an Order of
Conditions issued by the Town of Reading Conservation Commission on January 18, 2006 and
recorded at the Middlesex South District Registry of Deeds at Book 47382, Page 266.
1. Purposes
In perpetuity, the purposes of this Conservation Restriction are: to assure that the Premises
will be retained predominantly in their natural, scenic and undeveloped condition; and to prevent any
use of the Premises that would significantly impair or interfere with the conservation values of the
Premises.
The conservation of the Premises will yield a significant public benefit because the Premises
contain unusual, unique, and outstanding qualities, including the following:

A. Portions of the Aberjona River run through, near and/or adjacent to the
Premises;
B. Most of the Premises consists of Bordering Vegetated Wetlands, including
wooded swamp, shrub-scrub swamp, and marsh plant communities along
both banks of the Abedona River;
C. Portions of the Premises consist of a vegetated buffer around the wetland
resource areas;
D. The Premises are located in the Reading Aquifer Protection District in a Zone
II recharge area;
E. The Premises are located in a Zone A2 100-year floodplain as defined on the
FEMA Flood Insurance Rate Maps for the Town of Reading.
F. The Premises are open, natural, and scenic, and contain a wide variety of
plant and animal species threatened by development in Reading;
G. The Premises are located on the opposite side of Willow Street across from
Certified Vernal Pool # 298 and upstream from Certified Vernal Pool # 293,
and the Premises provide wildlife habitat for many of the animal species that
utilize Vernal Pools;
H. The Premises potentially serve as habitat for the Spotted Turtle, Clemmys
guttata;
1. The Premises directly abut two (2) parcels of property designated as Town
Conservation land under the care and control of the Reading Conservation
Commission, and link additional Reading Conservation Lands located along
the Aberjona River corridor;
J. The Grantor is providing public access to the Premises only from Willow
Street as indicated on the Plan.
This Conservation Restriction will provide permanent protection of the Premises for the
Town of Reading.
II. Binding Effect, Prohibited Acts and Uses, Exceptions Thereto, and Permitted Uses
A. Binding Effect
The Grantor covenants that the Premises will at all times be held, used, and conveyed subject
to and not used in violation of the following restrictions that shall run with the Property or if the
Premises are subdivided from the Property as set forth herein, then with the Premises in perpetuity.

B. Prohibited Acts and Uses
Subject to the exceptions set forth in paragraph C below, the Grantor will neither perform nor
allow others to perform the following acts and uses which are prohibited in, on, under, and over the
Premises:
1. Constructing or placing of any temporary or permanent building, structure, facility, or
improvement including but not limited to tennis court, landing strip or pad, greenhouse,
mobile home, swimming pool, skating rink, fences, asphalt concrete or other forms of
impervious pavement, sign, billboard or other advertising display, antenna or dish, utility
pole, tower, conduit, line or other temporary or permanent structure or facility or
improvement-;
2. Mining, excavating, dredging, cutting, destroying, or removing from the Premises or bodies
of water thereon, of soil, loam, peat, gravel, sand, rock or other mineral resource or natural
deposit ;
3. Installing underground storage tanks;
4. Placing, filling, storing or dumping on the Premises of soil, refuse, trash, yard wastes such as
lawn clippings, leaves, branches, etc. (other than those naturally deposited in the area),
vehicle bodies or parts, rubbish, debris, junk, waste or other substance or material
whatsoever;
5. Cutting, removing or otherwise destroying trees, shrubs, grasses or other vegetation;
6. Subdivision or conveyance of a part or portion of the Premises alone, or division or
subdivision of the Premises (as compared to conveyance of the Premises in its entirety which
shall be permitted), and no portion of the Premises may be used towards building or
development requirements on this or any other parcel except that the Premises may be used
towards building or development requirements of the Property which is not a part of the
Premises and which said building or development requirements is/are related to a single
family home and its appurtenances on said Property;
7. Conducting activities detrimental to drainage, flood control, water conservation, water
quality, erosion control, soil conservation, plants, or wildlife habitat;
8. Using the Premises for residential, commercial, or industrial purposes;
9. Except for vehicles authorized and necessary for permitted uses and for emergency vehicles,
using motorized vehicles including off-road vehicles and recreational vehicles;
10. Using herbicides and, pesticides, or using other chemical or mechanical means that may have
an adverse impact upon the plant life or wildlife within the restricted area, except as may be
permitted, in writing, by the Grantee for the control of noxious or invasive species and only if
it will not impair the water quality or adjacent vegetation;
11. Conducting any other use of the Premises or activity which, in the reasonable opinion of the
Grantee, is or may become inconsistent with the intent of this Conservation Restriction, that
is the preservation and protection of the Premises in their natural and scenic condition.

12. Any other use of the Premises or activity thereon which is inconsistent with the purpose of
this Conservation Restriction or which would materially impair its conservation interests.
C. Exceptions to Otherwise Prohibited Acts and Uses
Notwithstanding any of the Prohibited Acts and Uses in subparagraph B above, the following
acts and uses are permitted to the Grantor, but only if such acts or uses do not materially impair the
purpose of this Conservation Restriction or other significant conservation interests and where
applicable if such acts and uses have been expressly permitted by the Grantee in writing as set forth
below:
1. In accordance with generally accepted forest management practices, de minimus selective
pruning or cutting of trees for fire protection, unpaved trail maintenance, or to remove
hazards and disease. Provided, however, that said activities shall be undertaken only with the
consent and approval of the Grantee, which consent and approval shall not be unreasonably
withheld or delayed;
2. Erection of signs by the Grantor or Grantee to identify-the Grantee as holder of the
restriction and to educate the public about the conservation values protected and any
limitations relating to public access. Provided, however, that both the Grantor and the
Grantee agree to said signs. Said agreement shall not be unreasonably withheld or delayed;
3. Walking, strolling, hiking, skiing, horseback riding, or other similarly passive, non-
motorized, and non-mechanized recreational activities in the Conservation Restriction Area
not inconsistent with the intent of this Conservation Restriction, which is the preservation
and protection of the Conservation Restriction Area in its natural, scenic, and undeveloped
condition and the prevention of any use of the Conservation Restriction Area that would
significantly impair or interfere with its conservation values stated in Section I above;
4. Creating and maintaining additional narrow unpaved walkways and paths in the
Conservation Restriction Area by the Grantor or the Grantee, subject to the reasonable
approval of the Grantee. However, no walkway or path shall be located within 50 feet of any
dwelling or any Vernal Pool;
5. Maintaining of existing stone walls in the Conservation Restriction Area, if any ; and
6. All acts and uses not prohibited herein are permissible, but only if such uses and
activities do not materially impair the purposes of this Conservation Restriction or
other significant conservation interests.

The Grantor shall notify the Grantee in writing before the date the Grantor intends to
undertake any of the activities described in paragraphs II.C.1., II.C.2, II.C.4, and II.C.6 of this
section. Such written notice shall not be required for those activities-described in paragraph II.C.3
and II.C.5 of this section. The notice shall describe the nature, scope, design, location, timetable,
and any other material aspect of the proposed activity in sufficient detail to permit the Grantee to
make an informed judgment as to the activity's consistency with the purposes of this Conservation
Restriction. The Grantee shall grant or withhold the Grantee's approval in writing within thirty (30)
days of receipt of the Grantor's written request therefor. The Grantee, upon 48-hour notice and
between 9:00 a.m. and 8:00 p.m. Monday through Saturday, may perform an inspection before
granting or withholding approval.
The exercise of any right reserved or permitted by the Grantor under this paragraph C shall
be in compliance with the then-current Zoning by-law of the Town of Reading, the Wetlands
Protection Act (General Laws Chapter 131, Section 40), and all other applicable federal, state and
local law. The' inclusion of any reserved or permitted right in this paragraph C requiring a permit
from a public agency does not imply that the Grantee or the Commonwealth takes any position on
whether such permit should be issued.
III. Legal Remedies of the Grantee
A. Legal and Injunctive Relief
The rights hereby granted shall include the right in the Grantee to enforce this Conservation
Restriction by appropriate legal proceedings and to obtain injunctive and other equitable relief
against any violations, including, without limitation, relief requiring restoration of the Premises to its
condition prior to the occurrence of the violation (it being agreed that the Grantee may have no
adequate remedy at law). The rights hereby granted shall be in addition to, and not in limitation of,
any other rights and remedies available to the Grantee for the enforcement of this Conservation
Restriction. In the event of a dispute over the boundaries of the Premises, the Grantor will be
responsible for a survey and permanent monumentation of the boundaries delineating the restricted
and unrestricted areas.
B. Costs of Enforcement
The Grantor and thereafter the successors and assigns of the Grantor covenants and agrees
to reimburse the Grantee for the reasonable costs and expenses (including without limitation counsel
fees) incurred in enforcing this Conservation Restriction or in remedying or abating any violation
thereof, provided that the Grantor has been found to be in violation by a court of competent
jurisdiction or agrees that the violation has occurred.

C. Grantee disclaimer of Liability
By the Grantee's acceptance of this Conservation Restriction, the Grantee does not
undertake any liability or obligation relating to the condition of the Property, including the Premises
not caused by Grantee or its agents.
D. Non-Waiver
Any election by the Grantee as to the manner and timing of the Grantee's right to enforce this
Conservation Restriction or otherwise exercise the Grantee's rights hereunder shall not be deemed or
construed to be a waiver of such rights.
E. Acts beyond Grantor's Control
Nothing contained in the Conservation Restriction shall be construed to entitle Grantee to
bring any action against Grantor for any injury to or change in the Premises resulting from causes
beyond Grantor's control, including, but not limited to, fire, flood, and earth movement, or from any
prudent action taken by Grantor under emergency conditions to prevent, abate or mitigate significant
injury to the Premises for such causes. As soon as possible thereafter, the Grantor shall notify the
Grantee of any action which has been taken
IV. Access:
The Grantor grants to the Grantee and the Grantee's representatives the right to enter the
Premises from the Summer Avenue portion of the property, not more than one (1) time per year,
with prior written or telephonic notice to the Grantor only, at reasonable times and in 'a reasonable
manner for the purposes of inspecting the same to determine compliance herewith. Reasonable time
shall be Monday through Saturday between the hours of 9:00 a.m. and 8:00 p.m. Notwithstanding
the above, the limitation of one (1) time per year shall not apply to an emergency or the investigation
of a violation of the terms and conditions of this Restriction or enforcing the restrictions herein,
remedying any violation thereof, acting upon the request for an estoppel certificate and inspecting
the Property before granting or withholding approval of the acts and uses as more fully described in
Section H.C.
Grantor further grants to Grantee and to the general public the right to enter and/or leave the
Premises from Willow Street and/or from the adjacent Conservation Land, to pass and repass on the
Premises for purposes of walking and other passive outdoor recreational activities not involving the
use of motorized vehicles. Such other passive outdoor recreational activities shall not include the
following:
(1) Picnics;
(2) Playing of games such as football, volleyball, badminton and baseball;
(3) Sunbathing;

(4) Bicycling;
(5) The consumption of alcoholic beverages.
However, and notwithstanding the foregoing, in the event of an emergency or should the
Grantor undertake to perform maintenance or other activities which could pose harm or the
possibility of harm to the Public, then the Grantor shall have the right at any time, and from time to
time, to temporarily bar access during time periods when emergency or potentially harmful activities
are being conducted and except in the case of an emergency advance notice is provided to the
Grantee and access is barred only for the time necessary to prevent the possibility of harm to the
Public. The provisions of Massachusetts General Laws Chapter 21, Section 17C, as same maybe
from time to time amended, shall be applicable to any use of the Premises by the public.
V. Costs, Liabilities, Taxes
The Grantor shall pay, before delinquent, all'taxes, assessments, fees, and charges levied on
or assessed against the Property by a competent authority, and, except for such charges as may be
imposed by the Town of Reading, shall furnish the Grantee with satisfactory evidence of payment
upon request.
VI. Assignability
A. Running of the Burden with the Premises
The burdens of this Conservation Restriction shall run with the Property in perpetuity, and
shall be enforceable against the Grantor and the successors and assigns of the Grantor while holding
any interest in the Property.
B. Execution of Instruments
The Grantee is authorized to record or file any notices or instruments appropriate to assuring
the perpetual enforceability of this Conservation Restriction; the Grantor on behalf of the Grantor
and the Grantor's successors and assigns appoints the Grantee as the Grantor's attorney-in-fact to
execute, acknowledge and deliver any such instruments on the Grantor's behalf. Without limiting the
foregoing, the Grantor and the Grantor's successors and assigns agree to execute any such
instruments upon request.
C. Running of the Benefit
The benefits of this Conservation Restriction shall be in gross and shall not be assignable by
the Grantee, except in the following instances:
(i) as a condition of any assignment, the Grantee shall require that the purpose of this Conservation
Restriction continue to be carried out; and

(ii) the person or entity to whom the Grantee intends to assign the Conservation Restriction, at the
time of assignment, shall qualify under Section 170(h) of the Internal Revenue Code of 1986, as
amended or any successor statute, and applicable regulations thereunder, and under Section 32 of
Chapter 184 of the Massachusetts General Laws, as amended or any successor statute, as an eligible
donee to receive this Conservation Restriction directly; and
(iii) any assignment shall be in compliance with the provisions required by Article XCVII (97) of the
Amendments to the Constitution of the Commonwealth of Massachusetts..
VII. Subseauent Transfers
The Grantor shall incorporate by reference the terms of this Conservation Restriction in any
deed or other legal instrument by which the Grantor divests any interest in all or a portion of the
Property. The Grantor shall notify the Grantee in writing if the Grantor conveys the Property or any
part thereof or interest therein (including a lease). Failure to comply herewith shall not impair this
Conservation Restriction in any manner.
VIII. Estoppel Certificates
Upon request by the Grantor, the Grantee shall within twenty (20) days execute and deliver
to the Grantor any document, including an estoppel certificate, which certifies the Grantor's
compliance with any obligation of the Grantor contained in this Conservation Restriction.
IX. Effective Date
This Conservation Restriction shall be effective when the Grantor and the Grantee have
executed the Conservation Restriction deed; the administrative approvals, including by the Natural
Heritage and Endangered Species Program, and those required by Section 32 of Chapter 184 of the
General Laws have been obtained; and the Conservation Restriction deed has been recorded, or if
registered land, it has been registered in the Middlesex County Registry of Deeds.
X. Notices
Any notice, demand, request, consent, approval, or communication that either the Grantor or
the Grantee desires or is required to give to the other shall be in writing and either served personally
or sent by first-class mail, postage pre-paid, addressed as follows:

XI. Recordation
The Grantor shall record this instrument in timely fashion in the County Registry of Deeds.
XII General Provisions
A. Controlling Law
The interpretation and performance of this Conservation Restriction shall be governed by the
laws of the Commonwealth of Massachusetts.
B. Liberal Construction
Any general rule of construction to the contrary notwithstanding, this Conservation
Restriction shall be liberally construed in favor of the grant to effectuate the purpose of this
Conservation Restriction and the policy and purpose of Massachusetts General Laws Chapter 184,
Sections 31-33. If any provision in this instrument is found to be ambiguous, an interpretation
consistent with the purpose of this Conservation Restriction that would render the provision valid
shall be favored over any interpretation that would render it invalid.
C. Captions
The captions in this instrument have been inserted solely for convenience of reference and
are not a part of this instrument and shall have no effect upon construction or interpretation.
D. Entire Aizreement
This instrument sets forth the entire agreement between the Grantor and the Grantee with
respect to the Conservation Restriction and supersedes all prior discussions, negotiations,
understandings, or agreements relating to the Conservation Restriction, all of which are merged
herein.
E. Severabilitv
If any provision of this Conservation Restriction or the application thereof to any person or
circumstance shall to any extent be held invalid, the remainder of the provisions of this Conservation
Restriction shall not be affected thereby.

The purpose of this letter is to demonstrate compliance with Federal Communication
Commission ("FCC") standards in regard to the electromagnetic emissions from the antennas
located on the water tower at site BS03XC202 at the following address:
50 Auburn Street, Reading, MA 01867.
The FCC, in regulating electromagnetic radiation, applies a modified version of the standards
developed by the American National Standards Institute ("ANSI") and the Institute of Electrical
and Electronics Engineers ("IEEE") to include the National Council on Radiation Protection and
Measurements ("NCRP") standard for Specific Absorption Rate ("SAR"), for Personal
Communication Service ("PCS") bands. These standards, when converted to the more familiar
power density specification, set a maximum power density level for public areas at 1.00 mW/cm2
(milliwatts per square centimeter) for general population exposure and 5.00 mW/cm2 for
occupational exposure. This level is set 50 times lower than levels the standards committees felt
could potentially be harmful for constant exposure.
Our antennas are designed to concentrate the majority of their signal power out of the front of the
antenna in a very thin beam. Signal strength coming from the back of an antenna and from
positions well below an antenna is typically hundreds of times lower than the signal in the main
beam at the front of the antenna. Through software modeling techniques, we can calculate the
power density from a Sprint Nextel installation at a variety of locations around the proposed site.
Once a site goes on-air, routine evaluations are conducted to ensure on-going compliance with
FCC regulations. We have developed several proprietary software programs to determine power
density levels and to compute Maximum Permissible Exposure ("MPE") limits. When a site is
altered in such a way that would impact exposure levels, a new analysis is performed.
The following contains information on the current FCC standards, the type of modeling Sprint
Nextel uses to ensure compliance to the standards, and the results of the study for this particular
site.
Current FCC-adopted Exposure Limits
The FCC guidelines are given in terms of mW/cm2 and the maximum limits are termed MPE for
both occupational and general cases. Because these guidelines are based upon the same SAR
limits as those in the IEEE/ANSI and NCRP guidelines, they also include the factors of 10 and
50 for occupational and general public scenarios.
The graph in Figure 1-1 shows the current FCC MPE guidelines. The two arrows indicate the
cellular (-850 MHz) and PCS 1900 MHz) frequencies. The exposure limits for PCS, expressed
in terms of "power density", are 1.0 and 5.OOmW/cm2 for general public and occupational cases,
respectively.

Spherical Modeling
The concept of the spherical model is to assume that the Equivalent Isotropically Radiated Power
("EIRP") of the actual antenna is being applied to a point source (true isotropic radiator). This is
valid in the center of the main beam of the antenna but it presents a worst-case scenario. The
power density is then calculated by dividing the EIRP by the surface area of the sphere (47cr2),

between the antenna and a six (6) foot area above the roof or ground where a person might stand.
Additionally, we must multiply the E1RP by a power reflection coefficient to account for the fact
that reflections from the roof or ground could add constructively with the incident wave at the

Cylindrical Modeling
The concept of the cylindrical model is to take the power actually delivered to the antenna and
assume it is equally distributed over the surface of a cylinder of the same length as the antenna.
If the antenna is a directional antenna then we reduce the surface area of the cylinder by BW/360
(BW is the 3-dB beam-width in degrees). This is a good near-field model. Additionally, if the
antenna is mounted above the level, the average power density in a 6-foot tall area immediately
above the rooftop level (or where a person might be standing or located), is reduced according to
how far above/below the person is in relation to where the antenna is mounted.

Analysis
Using Spherical and Cylindrical Modeling, Sprint Nextel performs an analysis on each site to
ensure that it complies with FCC's rules and regulations. Sprint Nextel proprietary software is
used to model radio frequency ("RF") exposure conditions on rooftops and in any other areas
that our antennas are used.

The results of the analysis show in Figure 1-3 that to incur 100% of the MPE levels, an
individual would have to be directly within 4.6098 feet of the front of the antenna in its main
beam. Figure 1-3 shows how rapidly the power density levels fall off (in percent of FCC
maximum) as the distance increases.
