Hechenbleikner DATE: October 24, 2008 RE: Agenda - October 28, 2008 TOWN MANAGER (781) 942-9043 3a) Selectman Steve Goldy will be introducing Sarah Mulroy who is the youth liaison to the Board of Selectmen. She will be seated at the dais next to Paula Schena. The Board may want to take a recess at approximately 9:00 p.m. so that the youth liaison may leave if she chooses to. 4a) Irene Collins, Executive Director of the Reading/North Reading Chamber of Commerce and Priscilla Gottwald, President of the Reading/North Reading Chamber of Commerce will be present to let the Board and Community know what the plans are for the Tree Lighting and to acknowledge the donation from the Reading Municipal Light Department of the LED lights for two of the trees on the Common. The lights themselves will have been delivered directly to the DPW. 4b) Earlier this year, the Board of Selectmen directed Town Counsel to develop a lease extension for the Burbank Ice Arena Authority for 10 years. Upon further investigation, Town Counsel has determined that only one five year extension is available upon the terms and conditions of the original lease. Attached is a copy of the 2004 extension, and a copy of the motion previously approved by the Board of Selectmen this year. Pursuant to the lease, a hearing has been scheduled for the Board to determine whether or not the Reading Ice Arena Authority has met all of the terms of the current lease, and whether the Board of Selectmen should grant the additional extension of the lease. 4c) The Wine Shop of Reading has a sales agreement to sell their business. This will require a transfer of the liquor license. This is scheduled for a hearing on Tuesday night. As of this date, not all of the staff reviews have been completed. We hope to have those completed by the Selectmen's meeting on the 28`x'. If they are not completed then the Board may consider continuing the hearing to the Board's next meeting. 4d) Attached is a list of all the liquor license holders. These are scheduled for renewal at the Selectmen's Meeting on November 25, 2008. Generally, we do not have the licensees come before the Board for renewal. If the Board can review the list and let me know if you want any of these licensees to appear before the Board at the time that the renewals are scheduled to place, then we will let the licensee know that. 4e) The Board has indicated an interest in considering modification of the Aquifer Protection District Regulations, now that the Town is no longer utilizing the well systems routinely for our public drinking water. Any change in the regulations would require Water Resource Commission approval. I have attached a copy of the current Aquifer Protection District regulations from the Zoning Bylaw for the Board to review and to determine what if any kinds of changes to the regulations that they would like to see. We can then review this broadly with the Water Resource Commission and staff to see if such changes may be appropriate. 4f) The Board of Selectmen has indicated an interest in possibly bidding our property and casualty and workers comp insurance program. On Tuesday night we will have the total cost of property and casualty and workers comp as well as our expenditures to date. If we are going to renew these programs for July 1, 2009, I would need to begin the process of hiring a consultant to develop the proposals during the month of November. Assuming that the Selectmen find that the Lessee has complied with the lease, i.e., has the required insurance, etc., the form of the motion should parrot the lease language i.e., "I move have the Selectmen find that the Lessee has complied with the terms and conditions of the lease dated February 23, 1993; that the extension of the lease would be desirable to the public good; and that the term of the lease be extended for an additional (5) year period". I would suggest a public Hearing on October 28 - and then your counsel can prepare the lease extension. The board was concerned with the inabilility to expeditiously enter a ten year extension to the current lease due to the constraints you have mentioned. At this time we we request that the board of selectmen provide a five year extension which we believe would fit into the current lease terms. As you know one of the reasons to have the lease extension was to amortize the expansion. Although the ten year extension would have worked well the five year term extension may allow us some flexibility, Please let me know if the selectmen will do this and if town counsel agrees that it can be done under the existing lease. The problem is that the existing lease only allows for 2 5 year extensions - the last one beginning this year. AQUIFER PROTECTION DISTRICT 4.8.1. Purpose of District: The purpose of this Aquifer Protection District is to: 4.8.1.1. promote the health, safety, and general welfare of the community by ensuring adequate quality and quantity of drinking water for the residents, institutions, and businesses of the Town of Reading; 4.8.1.2. preserve and protect existing and potential sources of drinking water supplies; 4.8.1.3. conserve the natural resources of the Town of Reading; and 4.8.1.4. prevent temporary and permanent contamination of the environment. 4.82.' Scope of Authoritv: The Aquifer Protection District is an overlay district superimposed on the underlying zoning districts which shall apply to all new construction, reconstruction, or expansion of existing buildings and new or expanded uses which fall, wholly or partially, within such Aquifer Protection District. Uses prohibited in the underlying zoning districts shall not be permitted in the Aquifer Protection District. 4.8.3. Definitions: For the purposes of this section, the following terms are defined below: Aauifer: Geologic formation composed of rook, sand or gravel that contains significant amounts of potentially recoverable water. Aquifer Protection District: The zoning district defined to overlay other zoning districts in the Town of Reading. The aquifer protection district may include specifically designated recharge areas. Impervious Surface: Material or structure on, above, or below the ground that does not allow precipitation or surface water to penetrate directly into the soil. Impervious Reading Zoning By-Laws 40 Revised as of April, 2008 L e surfaces shall include all roofs, driveways, parking areas, roadways and walkways, regardless of the proposed surface material. Minina_ The removal or relocation of geologic materials such as topsoil, sand, gravel, metallic ores, or bedrock. Potential Drinkina Water Sources 2: Areas which could provide significant potable water in the future. Recharae Areas: Areas that collect precipitation or surface water and carry it to aquifers. Recharge areas may include areas designated as Zone II and Zone III. Toxic or Hazardous Material: Any substance or mixture of physical, chemical, or infectious characteristics posing a significant, actual, or potential hazard to water supplies or other hazards to human health if such substance or mixture were discharged to land or water in the.Town of Reading. Toxic or hazardous materials include, without limitation; synthetic organic chemicals, petroleum products, heavy metals, radioactive or infectious wastes, acids and alkalis, and all substances defined as Toxic or Hazardous under Massachusetts General Laws (M.G.L.) Chapter (c.) 21C and 21E and 310 CMR 30.00, and also include such products as solvents and thinners in quantities greater than normal household use. 4.8.4. Establishment and Delineation of Aquifer Protection District: The Aquifer Protection District is delineated and established on a map entitled "Figure 2 Town of Reading, Massachusetts Zone II and Zone III Areas" prepared by Weston & Sampson Engineers, Inc. resulting from a study for the Town of Reading Entitled 100 Acre Wellfield Zone II Study dated July 1996 which shows certain aquifer protection areas consisting of aquifers or recharge areas. Such map is hereby made a part of the Town of Reading Zoning By-Law and is on file in the office of the Town Clerk and the Building Inspector's Office. 4.8.5. Boundarv Disputes: If the location of the District boundary in relation to a particular parcel is disputed, resolution shall be accomplished by the owner(s) filing a Special Permit application with the Special Permit Granting Authority (SPGA), the Reading Zoning Board of Appeals. Any application for a special permit for this purpose shall be accompanied by adequate documentation. The burden of proof shall be upon the owner(s) of the land to show where the boundaries should be located. At the request of the owner(s), the Town may engage a professional' engineer, hydrologist, geologist, or soil scientist to determine more accurately the boundaries of the districts with respect to individual parcels of land and review the documentation presented by the owner(s). The SPGA may charge the owner(s) for the cost of such investigation. 4.8.6. Use Reaulations: In the Aquifer Protection District, the following regulations shall apply: 4.8.6.1. Permitted Uses: The following uses are permitted within the Aquifer Protection District, provided that all necessary permits, orders, or approvals required by local, State or Federal laws are also obtained: 4.8.6.1.1. conservation of soil, water, plants and wildlife; L e7z' Reading Zoning By-Laws 41 Revised as of April, 2008 4.8.6.1.2. outdoor recreation, nature study, boating, fishing, and hunting where otherwise legally permitted; 4.8.6.1.3. foot, bicycle and/or horse paths and bridges; 4.8.6.1.4. normal operation and maintenance of existing water bodies and dams, splash boards, and other water control, supply and conservation devices; 4.8.6.1.5. maintenance, repair, and enlargement of any existing structure, subject to Section 4.8.6.2.; 4.8.6.1.6. residential development, subject to Section 4.8.6.2.; 4.8.6.1.7. farming, gardening, nursery, conservation, forestry, harvesting and grazing, subject to Section 4.8.6.2.; 4.8.6.1.8. construction, maintenance, repair, and enlargement of drinking water supply related facilities such as, but not limited to, wells, pipelines, aqueducts and tunnels; 4.8.6.1.9. impervious cover on property up to 15%; 4.8.6.1.10. impervious cover up to 20% if a system for artificial recharge of precipitation is provided that will not result in the degradation of groundwater quality. Recharge plans shall comply with the DEP Stormwater Guidelines and shall be submitted to the Town Engineer or the applicable Board, Committee or Commission for review and approval. 4.8.6.2. Prohibited Uses: The following uses are prohibited: 4.8.6.2.1. landfills and open dumps as defined in 310 CMR 19.006; 4.8.6.2.2. automobile graveyards and junkyards, as defined in M.G.L. c. 140B, §1; 4.8.6.2.3. landfills receiving only wastewater and/or septage residuals including those approved by the Department of Environmental Protection pursuant to M.G.L. c. 21, §26 through 53; M.G.L. c. 111, §17; M.G.L c. 83, §6 and 7, and regulations promulgated thereunder; 4.8.6.2.4. facilities that generate, treat, store, or dispose of hazardous waste that are subject to M.G.L. c. 21C and 310 CMR 30.00, except for the following: 4.8.6.2.4.1. very small quantity generators as defined under 310 CMR 30.000; 4.8.6.2.4.2. household hazardous waste centers and events under 310 CMR 30.390; 4.8.6.2.4.3. waste oil retention facilities required by M.G.L. c. 21, §52A; 4.8.6.2.4.4. water remediation treatment works approved by DEP for the treatment of contaminated ground or surface waters; Reading Zoning By-Laws 42 Revised as of April, 2008 L. 4?13 4.8.6.2.4.5. petroleum, fuel oils, and heating oil bulk stations and terminals including, but not limited to, those listed under Standard Industrial Classification (SIC) Codes 5171 and 5983; 4.8.6.2.4.6. storage of liquid hazardous materials, as defined in M.G.L. c. 21 E, and . liquid petroleum products, unless such storage is (a) above ground level; and (b) on an impervious surface; and . (c) either (i) in container(s) or above ground container(s) within a building; or; (ii) outdoors in covered container(s) or above ground tank(s) in an area that has a containment system designed to. hold either 10% of the total possible storage capacity of all containers, or 110% of the largest container's storage capacity, whichever is greater; 4.8.6.2.4.7. storage of sludge and septage, unless such storage is in compliance with 310 CMR 32.30 and 310 CMR 32.31; 4.8.6.2.44.8. storage of deicing chemicals unless such storage, including loading areas, is within a structure designed to prevent the generation and escape of contaminated runoff or leachate; 4.8.6.2.4.9. storage of animal manure unless covered or contained in accordance with the specifications of the Natural Resource Conservation Service; 4.8.6.2.4.10. earth removal, consisting of the removal of soil, loam, sand, gravel, or any other earth material (including mining activities) to within 4 feet of historical high groundwater as determined from monitoring wells and historical water table fluctuation data compiled by the United States Geological Survey, except for excavations for building foundations, roads, or utility works; 4.8.6.2.4.11. discharge to the ground of non-sanitary waste water including industrial and commercial process waste water, except: (a) the replacement or repair of an existing treatment works that will not result in a design capacity greater than the design capacity of the existing treatment works; (b) treatment works approved Protection designed for the surface water and operating 5.05(13); by the Department of Environmental treatment of contaminated ground or n compliance with 314 CMR 5.05(3) or (c) publicly owned treatment works. 4.8.6.2.4.12. stockpiling and disposal of snow and ice containing deicing chemicals if brought in from outside the district; 4.8.6.2.4.13. storage of commercial fertilizers, as defined in MGL Chapter 128,§64, unless such storage is within a structure designated to prevent the generation and escape of contaminated runoff or leachate; 4.8.6.2.4.14. underground storage tanks related to the activities in Section 4.8.6.1. Reading Zoning By-Laws 43 Revised as of April, 2008 4N t 4.8.7. Violation Notice: Written notice of any violations of this Section shall be given by the Building Inspector to the property owner as soon as possible after detection of a violation or a continuing violation. Such notice shall specify the requirement or restriction violated and the nature of the violation, and may also identify the actions necessary to remove or remedy the violations and preventative measures required for avoiding future violations and a schedule of compliance. A copy of such notice shall be submitted to the Building Inspector, the Board of Health, Conservation Commission, Town Engineer/Department of Public Works, and Water Department. The cost of containment, clean-up, or other action of compliance shall be borne by the owner of the premises. 4.9. `PLANNED UNIT DEVELOPMENT 4.9.1. Statement of Purpose and Authority: The urpose of this Section is to encourage the construction of Planned Unit Develo ents (PUDs) in designated Districts within the Town. Planned Unit Develop nts shall: a. Permit a mix Aand uses, densities and building types in one development. b. Facilitate high quali , integrated planning of large-scale developments beneficial to the Town and constructe in a manner which is highly responsive to specific sites and their surroundings. c. Require more rigorous de lopment standards than those found in other zoning districts. 4.9.2. Overlav Districts: Planned Unit Development Districts sha take the fiorm of overlay districts covering all or part of Industrial Districts, the Busin s A District and designated portions of Residential Districts on the Reading Zoning nap. For any land within a PUD District, a Developer may choose to conform either to zoning regulations which govern the underlying district or to the PUD overlay regulate sand procedures set forth by this Section, whose specific provisions shall supersede II other provisions in the Zoning By-Laws with respect to the underlying district in ading,. without limitation, use, intensity, dimensions, parking and site plan review; h ever, the provisions of any other overlay district shall continue to apply. He also encouraged voters to. take a good look at Question #1 on the ballot. Selectman Camille Anthony noted that she attended the RMLD Audit Report Meeting and the audit went well. She also attended the Economic Development Committee Meeting, attended the groundbreaking for the alleyway, and walked the Downtown area with the Town Manager looking at tree wells. Selectman James Bonazoli commended the Economic Development Committee for moving forward with the alleyway project. He noted that they are looking for funds for the project. He also noted that the resident from 29 Colburn Road came in at the last Selectmen's meeting and had an issue with flooding in front of her house, and there needs to be follow up. Personnel and Appointments Badge Pinning - Police Officers - Police Chief Jim Cormier presented Police Officers Ryan Porter, Michael Bouvier and Christopher Jones to the Board. Each Officer had his badge pinned on by a family member. Cultural Council - The Board interviewed Margaret Caouette for one position on the Cultural Council. Bonazoli moved and Anthonv seconded to place the following name into nomination for one position on the Cultural Council with a term expiring June 30. 2011: Margaret Caouette. Ms. Caouette received four votes and was appointed. Discussion/Action Items Close Warrant for November Election - A motion by Anthonv seconded by Schubert to close the Warrant for the November Election to take place on November 4. 2008 at the Reading Memorial High School, Hawkes Field House, was approved by a vote of 4-0-0. Highlights - Celebrations Trust - Kurt Habel was present from the Celebrations Trust Committee. He noted that there are two trusts - one for Town celebrations and one for historic preservation. He also noted that they gave money for the historic pavers that are going in Downtown, and they funded the lighting festival. He indicated a need to advertise the trust funds. The Town Manager asked about the schedule for the application period and suggested that the Committee take applications year round. Review Status of Pav and Classification Program - Consultant Rachel Brown reviewed the objectives of the Pay and Classification Study. She noted that the job descriptions were reviewed and updated with no major changes. She also noted that the objective is to make sure employees are paid fairly and competitively. Ms. Brown noted that a focus group was established, and the overall consensus was that Reading is a good place to work. The employees value their benefits but there are limited earnings opportunities when the top step is achieved. She also noted that the employees indicated that the work environment is a challenge regarding building maintenance, congestion and privacy. 5`a.3 Board of Selectmen Meetiniz - October 7, 2008 - Paize 4 She noted that the classification process uses a point factor. The hierarchy of positions is sound but there are some positions that need to be reclassified. The Town Manager noted that he will be meeting with Department Heads regarding the issue of the top end of the scale, and will come back to the Board on how to address this situation. Review DPW Garage Issues Including ScreeninLy - The Town Manager noted that the buildings are locked but the area is not fenced. The roof repair and heater are in the capital plan this Fall. DPW Director Ted McIntire noted that a DPW Study on equipment will be done in 2010. He also noted that the facility should have an entrance gate with a card system. Selectman Camille Anthony asked if we should look at regionalization, and the Town Manager noted that staff is looking at the results of the study that was done, and will be coming back to the Board with an action plan. Review Updates - Pavement Manavement Plan - Town Engineer George Zambouras noted that the previous proposal of $850,000 used the unit prices from three years ago. The current plan is based on our bids this year. He also noted that the PCI Index starts at 74.50 in 2007 and then drops to 65 in 2013. A $2 million bond is a little better but not much. The $1 million plan with a ramp up to $1.2 million in four years starts with a PCI Index at 74.50 in 2007 and then ends up at 72.25 in 2013. The Town Manager indicated that the Town Engineer will give this report at Town Meeting. Liquor License Infraction - The Wine Shop - The Secretary read the hearing notice. Police Chief James Cormier, Lt. Detective Richard Robbins and Sgt. Mark Segalla were present. Chief Cormier noted that this was a sting operation throughout the area. Lt. Detective Robbins noted that on September 19, 2008, the Detective Division conducted a sting in all 20 liquor establishments. They used two 20 year old operatives, did one hour of training, took their photo and gave each a portable breath test and did background checks. The Wine Shop sold a 12 pack of Budweiser beer without asking for an ID. The Town Manager asked if notice was given to the community regarding the sting operation,, and it was noted that it was in the newspaper. Sgt. Mark Segalla noted that at 5:10 p.m., he and Officer Richard Abate gave the operative a $100 bill and she came out with a 12 pack of Budweiser and change. Sgt. Segalla went back at 6:40 p.m. and spoke with the clerk. Selectman Richard Schubert asked if the officers took steps to see the operative go into The Wine Shop, and Sgt. Segalla noted that they had direct sight of the operative into and out of the store. Board of Selectmen Meeting - October 7. 2008 - Page 5 Dionne Vierra, owner of The Wine Shop, noted that he has been in Reading for seven years without an incident. He sends employees to training and is aware of the consequences. This was a huge error in judgment. Rosemary Lewis noted that she was the clerk who sold the beer to the minor, and she accepts responsibility for her actions. She apologized for her actions and noted that the staff policy is to ask for ID from anyone who looks under 30 years of age. I agree that Warren Avenue is a wonderful neighborhood. I know and have known a number of people who live on the street. We have tried to be responsive to neighborhood issues and will continue to do so. We were petitioned to repave the street, and we were able to do a skim coating to improve the wear ability of it. We are doing a master plan for Washington Park, and plan on investing money to build a new playground next year. We want to do what we can to keep it a great neighborhood. We have done some investigation including traffic and speed counts on Warren Avenue. We are prepared to do additional enforcement next spring based on the baseball schedule at Washington Park. Attached is a copy of the traffic count and speed study done recently, and as you can see there were very few vehicles doing 30 mph, let alone 40 to 50. These charts are a little hard to read but the 95th percentile of vehicles was traveling at 25 mph. That said, this was not at a peak time of use of the baseball field, and even 25 mph "feels" fast if you are standing close by. We plan on doing extensive enforcement next spring, and that may include the temporary speed board placement - we may take you up on the offer to allow us to plug it in to your house or another on the street. The installation of the permanent speed zone signs like on Franklin Street is excessively expensive - over $20,000 last time we checked. We reserve those for school zones. Placement of speed bumps on the street is not an option - by the Town or by the neighbors. It creates liability and is illegal. In addition, the Town as a matter of policy does not place "slow children" signs in Reading, and we do not replace them. They are ineffective and give a false sense of security. We will continue to work with our neighborhoods to make them as good as we can, and rely on our residents to work with us on this. Sincerely Peter I. I'd like to get the town to do something about speeding cars on Warren Avenue. It happens on Saturdays, Sundays and weeknight evenings when parents (usually parents) are dropping their kids off for baseball practice or games at Washington Park. I am a car fanatic, and go to races (sometimes participating) regularly. I know the difference between a car traveling at 15-20 mph and one traveling at 40-50 mph on our little street. The sad reality is that these cars are more often than not exceeding 40 mph. I can't prove it as I don't have a radar gun set up on my driveway, but I can tell. I have spoken with drivers, yelled at drivers, called the police (not yet this year). The police will come, but as they didn't see the cars speeding, there is not much they can do, so I haven't bothered to call them anymore. The police are busy and have better things to do. 2 \a--~`,. Please see for yourselves. Find out the baseball schedule at Washington Park, and sit in a nondescript car at the end of Warren Ave in the cul-del-sac, about 15 minutes before an event starts, and observe how fast these people are driving. Warren Ave is part of a small, friendly, active neighborhood. There are children playing, dogs being walked, active people outside, and the high speed of this traffic is going to result in injury at some point. If the town can't do anything about it, the residents are prepared to take matters into our own hands. We are about ready to place our own temporary speed bumps on the street on the weekends to combat this high speed traffic. We are aware of the possible legal consequences of placing our own unauthorized speed bumps, so as a last ditch effort, I now contact the selectmen to see if there is anything the town can do to help us. Please consider our problem and help us do SOMETHING about it. I am willing to fund the electricity and allow a signpost to be placed on my property, if we could add one of those 'speed alert' signs that shows cars just how fast they are going, similar to the ones on Franklin St. near the elementary school. Please look at the Slow Children sign on our street. It is unreadable and pitiful.
