The Board of Selectmen has the compost Center #'s for this year. There has been email correspondence with a resident suggesting ways that the curbside collection program can be included as an enterprise in future years. The Reading Human Relations Advisory Committee wanted the Board of Selectmen and the community to be aware of this important anniversary. The preamble of that declaration reads: "Now, Therefore THE GENERAL ASSEMBLY proclaims THIS UNIVERSAL DECLARATION OF HUMAN RIGHTS as a common standard of achievement for all peoples and all nations, to the end that every individual and every organ of society, keeping this Declaration constantly in mind, shall strive by teaching and education to promote respect for these rights and freedoms and by progressive measures, national and international, to secure their universal and effective recognition and observance, both among the peoples of Member States themselves and among the peoples of territories under their jurisdiction. December 13 - Polar Express 0 Christmas Tree Disposal This January the Town is providing two options for disposal of Christmas trees. On Saturday, January 10, 2009 residents may take their trees to the Compost Area on Strout Avenue from 8:00 a.m. to 2:30 p.m. (leaves and branches will also be accepted at this time). In addition the contractor will collect Christmas trees curbside on your regular rubbish collection day the week of January 12 - 16, 2009. All decorations, including tinsel, must be removed from the trees. Trees in plastic bags or not completely cleaned of this material will not be picked up or accepted at the Compost Area. Please note, to use the Compost Center, you will need a 2009 Community Access Sticker. On Wednesday November 26, 2008 I received two emails from you; the first (email-1), requested a meeting to resolve the matter and the second (email-2), offered an extended warranty and a schedule for completion of only some of the outtanding items. The extended warranty identified in email-2 offered a series of renewable bonds that places the Town of Reading at risk for removing and replacing the areas of the bituminous concrete finish surface that are contaminated with hydraulic fluid. This extended warranty is unacceptable. Email-1 requests a meeting to resolve the issues regarding the contaminated finish surface. To date, there has been several discussions between you and-me, and at least six meetings between the Town of Reading representatives, your firm, subcontractors and specialists to discuss a solution to the bituminous concrete finish surface that was contaminated by hydraulic fluid: As a result of these discussions and meetings, neither David White, and Son, Inc., or any of the involved subcontractors or specialists can prove with certainty that all of the contaminated areas within the bituminous concrete finish surface have been removed and replaced. As a result of this C:\Documents and Settings\gzambouras\My Documents\Town Projects\Tennis Courts HS\D-White_Defau1t120808.doc ( - uncertainty, the Town of Reading has required that all of the bituminous concrete finish course of the tennis courts be removed and replaced in order to comply with Part 3-Execution, Section 3.02 Bituminous Concrete Pavements and Curb-General, subsection J of the Contract Documents. Unless the suggested meeting will provide the Town of Reading with a schedule for the removal and replacement of all of the contaminated pavement areas, and for the completion of all outstanding contractual work, the additional meeting will not provide beneficial resolution, to the contamination issue or incomplete work items. As the time for completion of the contract expired on June 27; 2008, and the email correspondence furnished by David White and Son, Inc., on November 26, 2008 does not provide a schedule for all remaining work nor does it identify a schedule for the removal and replacement of the entire . bituminous concrete finish surface, which is necessary to remove all of the contaminated pavement areas in compliance with Part 3-Execution, Section 3.02 Bituminous Concrete Pavements and Curb-General, subsection J of the Contract Documents, the Town of Reading is considering declaring David White and Son, Inc. in default of the Town of Reading's Bancroft Avenue Tennis Court Renovation Contract No. 08-11. In accordance with the terms of the Performance Bond No. 2077451 issued by North American Specialty Insurance Company, the Town of Reading requests a meeting with David White and Son, Inc., and North American Specialty Insurance Company to occur no later than fifteen days of your receipt of this notice of default to discuss methods for performing the corrective and remaining work under the Bancroft Avenue Tennis Court Renovation Contract No. 08-11. Your failure to meet this deadline will result in the Town of Reading declaring David White and Son, Inc. in default, and seeking completion of the outstanding work under the performance bond. i P.E. Kinasburv' Sent: Tuesday, December 02, 2008 4:14 PM Subject: Trench Safety Regulations - Now Effective March 1, 2009 FYI We have received questions from some of our clients in regards to the January 1, 2009 effective date of the new trench safety regulations. Per the article below from MMA, it appears that the Department of Public Safety intends to push that date back to March 1, 2009. ®PS seeks to delay trench regulations Monday, December 01 2008 -10 After meeting with the MMA on Nov. 17, state public safety officials agreed to take steps to delay the enforcement of regulations governing trench safety until March 1. In the meantime, the MMA and state agencies responsible for enforcement of the regulations will also convene a working group aimed at helping approximately 250 communities develop a process for issuing trench permits. To date, roughly 100 cities and towns have implemented such a process in conformance with the new rules. The working group will also address concerns expressed by local officials about so-called "Jackie's Law" and the accompanying new excavation and trench safety regulations (520 CMR 14.00). The Department of Public Safety had previously agreed to delay enforcement of the regulations until Jan. 1 in order to give municipalities and excavators an opportunity to become familiar with the rules and take steps to implement the requirements. Jackie's Law (Chapter 82A) was passed following the death of 4-year-old Jaclyn Moore, who was buried when an unattended trench collapsed in a private backyard. The law applies to all subsurface excavations greater than 3 feet in depth with less than 15 feet between trench walls. The regulations require municipalities to establish a permitting authority responsible for the issuance of required permits for all trenches and the enforcement of the state regulations, including a requirement that the public works department or local police detail backfill, barricade, or cover any unattended or unsafe trench. Excavators must obtain such a permit prior to creating any trench. The new rules also spell out standards for securing an unattended trench. If an excavator fails to comply with the regulations, the municipality may revoke its 12/8/2008 Page 2 of 2 permit and shut down the site, and the Department of Public Safety may impose a fine. An "unattended trench" is defined as "a trench where neither the permit holder, excavator, or any of the people who work in or at the trench are present." Jenkins Chairman NOTICE TO ALL LOCAL LICENSING AUTHORITIES AND ALL LICENSEES UNDER M.G.L. c. 138, § 12 COMPLIANCE ISSUES DURING THIS HOLIDAY SEASON The Alcoholic Beverages Control Commission ("the Commission") has recently observed, while monitoring the manner in which certain holders of § 12 licenses conduct business under their license, that many § 12 licensees persist in engaging in activities that violate the Liquor Control Act and Commission Regulations. For example, some licensees continue to offer an "open bar" to customers for a fixed price or offering discounted prices for drinks during a limited time period during the calendar week. Both of these activities violate Commission regulations and will result in a license being modified, suspended, revoked or cancelled. To advance the Commission's consistent out-reach to assist you in your efforts to control the licensed premises and the operation of the business, to prevent violation of any of the provisions of the Liquor Control Act and Commission regulations, to help conduct the licensed business in a proper and orderly manner, and to avoid compliance issues, the Commission would remind you that the Commission has prohibited certain practices by licensees under G.L. C. 138, 12 and 14. These prohibited practices are specified in 204 C.M.R. 4.00, et seq., (commonly referred to as the "Happy Hour regulation") and are available on the Commission's website, www.mass.gov/abcc. As a reminder, this "Happy Hour" regulation prohibits any licensee or employee or agent of a licensee from engaging in or permitting any of 8 activities. No licensee or employee or agent of a licensee may: 1, offer or deliver any free drinks to any person or group of persons; 2, deliver more than two drinks to one person at one time; 1 sell, offer to sell or deliver to any person or group of persons any drinks at a price less than the price regularly charged for such drinks during the same calendar week, except at private functions not open to the public; 4, sell, offer to sell or deliver to any person an unlimited number of drinks during any set period of time for a fixed price, except at private functions not open to the public; 5. sell, offer to sell or deliver drinks to any person or group of persons on any one day at prices less than those charged the general public on that day, except at private functions not open to the public; 6, sell, offer to sell or deliver malt beverages or mixed drinks by the pitcher except to two or more persons at any one time; 010 7. increase the volume of alcoholic beverages contained in a drink without increasing proportionately the price regularly charged for such drink during the same calendar week; 8. encourage or permit, on the licensed premises, any game or contest which involves drinking or the awarding of drinks as prizes. Because of this regulation, licensees may not be legally offering an "open bar" to customers for a fixed price or offering discounted prices for drinks during a limited time period. Any licensee who engages in this practice will be investigated and prosecuted before the Commission by its investigators. Further, no licensee shall advertise or promote in any way, whether within or without the licensed premises, any of the practices prohibited under 204 CMR 4.03. Any licensee who advertises these illegal practices will be also investigated and prosecuted. In May 2004, the Commission issued a series of 4 decisions that specified what a § 12 license holder must do to persuade the Commission that an event was a "private function" within the meaning of 204 C.M.R. § § 4.00, et seq. In these 4 decisions the Commission stated that "evidence must be presented to persuade and prove that the licensee: (1) identified an individual or group as the host of any Private Function held in the licensed premises; (2) restricted admission to the Private Function to particular persons or a group based on specific, bona fide invitations issued by the individual or group identified as the host of the Private Function; (3) did not charge, directly or indirectly, any individual invited to attend the Private Function by the identified host a fixed price for an unlimited number of drinks during any set period of time at anytime and did not receive directly or indirectly any payment from any individual invited by the identified host to attend the Private Function; (4) did charge for and accept payment from only the individual or group identified as the host of the Private Function; (5) did not advertise the availability of the Private Function to the general public (but may have at the request of the host of the Private Function, invited to attend the Private Function only the particular persons or groups selected by the host of the Private Function to be invited to attend and to whom admission is restricted;) and, (6) did create written records of the particular persons or groups to whom admission to the Private Function was granted that included within the records the name, address and contact number(s) for the individual or group identified as the host of the Private Function and were available for inspection by the licensing authorities and their agents. The Commission reads its regulation to include these elements of proof for an activity to be considered a Private Function." In re: Bedford Dininz. CAUTION: License holders should take caution that permitting a third party to sell tickets or other methods of admission to the licensed premises, where the price of admission includes any alcoholic beverages (even when the number of alcoholic beverages is limited to 9 comply with the "Happy Hour regulation"), results in the license holder transferring the privilege of its license, or transferring a direct or indirect beneficial interest in the license, to the third party. Any such transfer requires the prior approval from both the local licensing authority and the Alcoholic Beverages Control Commission. Any licensee who transfers the privilege of its license, or transfers a direct or indirect beneficial interest in the license, to a third party without the prior approval of the local board and the ABCC will be investigated and prosecuted. Licensees should be vigilant during the holiday season to avoid violations of G.L. c.138, § 69 and ensure that no alcoholic beverage is sold or delivered on any licensed premises to an intoxicated person. Care should also be taken to avoid violations of G.L. c.138, § 34 by ensuring not only that no one makes "a sale or delivery of any alcoholic beverage or alcohol to any person under 21 years of age, either for his own use or for the use of his parent or any other person" but also that no one furnishes, and Icnowingly or intentionally supplies, gives, or provides to or allows a person under 21 years of age to possess alcoholic beverages on premises or property owned or controlled by a license holder. As the festive holiday season is upon us, the Commission extends to you all the sincere wishes of all the members and employees the Commission. We are sure that each of you work daily to ensure that all operations, particularly those holiday celebrations hosted within licensed premises, are structured, advertised and actually operated in compliance with all laws of the Commonwealth. Through our efforts together, we can be sure that each license serves the public need and is operated only in such a manner so as to protect the common good.
