Ms. Adrian made a motion that the CPDC enter Executive Session under Purpose 3 to discuss strategy with respect to GC Fodera Contracting, Inc. v. CPDC 459 Main Street litigation and to include Community Development Director Andrew MacNichol. Mr. D'Arezzo seconded the motion and it was approved 4-0-0. Executive Session With respect to GC Fodera Contracting. Inc. v. CPDC (459 Main St litinationl Mr. MacNichol stated this will be a brief update to discuss the Applicant's recent responses and thoughts on necessary plans. The Applicant has signaled that funding can be provided for traffic Improvements and that plans are likely to consist of the standard engineering and architectural sets. There remain no affordable units proposed. Ms. Clish agreed. Mr. Weston stated that funding should support pedestrian needs only given the claims throughout the project and not necessarily towards signals and traffic Flow. Mr. D'Arezzo stated that at least one affordable unit should be provided. Mr. D'Arezzo asked for more information on construction and specifically the need for jersey barriers within the right of way. He noted that both the 531 Main St and the 18 Woburn St 4011 developments required jersey barriers within the right of way for extended periods and such cannot happen at this corner. Mr. MacNichol clarified that the two previous projects utilized parking spaces within the right of way and that there is no street parking adjacent to this site. Mr. D'Arezzo agreed and noted his concern is that a travel lane will be restricted for an extended period of time. Mr. Weston stated that the CPDC should not need to answer construction traffic management for the Applicant and that conditions around this should be sought. He asked for a construction management plan to review. Town of Reading i Meeting Minutes 4., Mr. D'Arezzo stated that a new shadow study should be provided to ensure the reduced height is mitigating impact. Ms. Clish seconded the request. Mr. MacNichol stated that he will relay the comments to Town Counsel and the Applicant. Mr. D'Arezzo made a motion to exit executive session. Mr. Weston seconded the motion and it was approved 4-0-0.
