MEETING HELD IN THE SELECT BOARD ROOM AND REMOTELY VIA ZOOM
Mr. Weston called the meeting to order at 7:34 PM.
Executive Session
With respect to GC Fodera Contracting. Inc. v. CPDC (459 Main St litigation)
Mr. Weston made a motion to enter Executive Session under Purpose Three, relative to the
litigation involving 459 Main Street, because an Open Session may have a detrimental
impact on the Iltigating position of the public body, and to invite Community Development
Director Andrew MacNichol and Senior Planner Mary Benedetto and to adjourn the meeting
at the conclusion of the Executive Session. Ms. Clish seconded the motion and it was
approved 5-0-0.
Mr. MacNichol stated that revised plan documents and notes were submitted based on prior
comments. Updates include:
• There is no found room within the Washington Street right of way for a physical
median that would prevent left-hand turning movements out of the site.
• Affirmation that left-hand turning restrictions would not be an enforceable offense
• Requested lane closure limitations are fairly consistent with MassDOT requirements
for state sanctioned roads. However, the local Reading Police Department charge a
minimum of 4 -hours for any police detail, regardless of actual duratlon, and many
developments wlll look to schedule as many deliveries as practical within that 4 -hour
window. Consolldating deliveries into longer yet fewer total may reduce overall traffic
disruption.
• Reduced size of the project will reduce needed materials to be delivered and more
space is available on-site for laydown and staging.
• The Applicant will comply with any temporary pedestrian safety needs, such as
temporary crosswalks, as identified by RPD during construction.
• Scaffolding along Main Street and Washington Street will be within the sidewalk. The
sidewalk will remaln open to pedestrians.
• A solid fence will be maintained or provided to screen the open parking area.

Mr. D'Arezzo made a motion to close executive session and adjourn the meeting. Mr. Wetzel
seconded and it was approved 4-0-0.
